Concrete by design required a 50% down payment to assure a spot on their schedule. After sending my down payment They were asked multiple times where we were on the schedule. Their proposal was signed March 7th I could not get a response until March 28. When they did respond they said they were 2 to 3 weeks out PROBABLY. That response came the day after they cashed my down payment. I contacted them by phone the following Monday. I let them know I could not wait and had another contractor to do the work. At that point the owner of the company began cursing saying he had a contract and he had my money. He continued to curse and hung up the phone.Ive then responded via text message asking him to refund my money that I was no longer interested in doing work with a company that handled things this way. He is now refusing to return my down payment of $5,940.00. All of this can be verified by examining text messages sent from the owner of the company. Please help me resolve this issue and protect other potential customers from experiencing similar circumstances.Thank youBusiness Response

We are sorry you feel this way. We always like to think that our customers will be professional in these types of situations as well. This is why we have the policies stated in our contract in place.
We sent the quote and a prepared contract to you on January 27th, 2022 and unfortunately, never received confirmation until March 10th, 2022 that you wanted to go through with the job. We had been in contact with you between these two dates making it clear that due to the number of our customers, we usually estimate that the projects of our signed and contracted clients will be scheduled an estimated 3 weeks out from date of signing. You also made it clear that you were unable to sign during this 6 week period due to other facets of your construction work (framing, drywall) needing to be completed before we would be able to do any concrete work, and that you did not want to hold your money for few weeks.
You contacted us the day after signing the contract, expecting us to be able to do the project immediately. While this is not usually feasible for any company, we at Concrete By Design were willing to request other customers work be moved around to accommodate your scheduling needs. You then responded with your plans for going with another contractor and you had a contracted with them (You basically signed two contracts simultaneously, one with us and another with a different company). We did not receive a 10 day notice of cancellation as stated as a requirement via the contract you signed. A company such as ours must hold our contracts as binding due to purchase of materials and inventory, hiring of labor, etc. We hope that you take signed contracts seriously in the future, especially you are a contractor too and should understand and appreciate that.
However, we are currently consulting with our lawyer and will let you know the best way to resolve this situation with mutual interest.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

The materials and labor were not ordered or scheduled prior to the cancellation.
The aggressive and inappropriate language and conduct by the Concrete by design owner, deemed any previous agreement Null and void.
My complaint stands as is and I would not recommend this company to anyone.
Their practice of demanding half down on a project before Committing to a schedule timeline is inappropriate.They could not provide services in a timely manner they should refund the down payment.
I strongly feel this review should stand with the Better Business Bureau review to allow warning for other potential Concrete by design customers.

As we trying to resolve the problem as explained in our 1st response , you trying to escalate the problem , not solving it. Again:
1- There is a contract between us that you signed and agreed with all the terms and conditions in it. You seemed that you dont hold any regard or/and respect to contracts and what you sign, or you never read it, which both are bad business.
2- There was no aggressive language used with you other than we were asking you to please read the contract that you signed and allow us to work with your schedule.
3- You had two contracts with two different companies for the same project simultaneously, without canceling the 1st one, which is a very bad business for everyone.
4- We have been operating this way for more than 12 years successfully without any problem such as this.
5- It seems that you mad a mistakes (1st not reading the contract and then sign another contract with another contractor without telling us, and then not letting us to do the work even though we had to work hard with other customers to accommodate your schedule) and yet, you dont want take the responsibilities for all of this.
6- Beside all of the above, we did try to start the project on your time and at your schedule without prior notice after moving few customers in line to accommodate yours, however, you refused, very bad business.

You did not schedule and did not purchase any materials and canceled your own contract through your inappropriate actions on the telephone the first day we spoke about your schedule.
You should not curse and hang up on customers.
You have chosen to keep nearly $6000 of a down payment when you were the one that could not perform your contracted duties in a timely manner.
There was no second contract signed simultaneously. The other company was not awarded the work until after your actions deemed it necessary.
You are leaving me no other option but to continue this complaint review. If this matter needs to go before a judge then I will also be making public the results of the judgment.

I am sorry that you seems to not accepting your actions and mistakes and trying to put all the blames on us. We do have a signed contract and we do have recorded phone calls and all the texts messages saved. I guess the best way is to resolve this matter legally.
