My mother contacted Ben Buys Indy Houses to get a quote for my grandmothers home in mid January. My grandmother had been sick with ***** and pneumonia and was too weak to live alone, so we were attempting to move her to assisted living and needed to sell her house to pay for the facility. When discussing the purchase agreement, my mother told the representative that in no way would my grandmother agree to sign paperwork to sell her home as she did not want to move (she also had dementia). The Ben Buys Indy Houses rep told my mother that it would be fine for my mother to sign on her behalf, even though she did not have power of attorney, because it was a docusign online document. At this time there was no money exchanged, no down payment made, we received no monetary payments from Ben Buys Indy Houses. A few weeks before closing my grandmothers health rapidly declined and was put into hospice care, meaning we no longer could move her to the assisted living facility. Our closing date was set for February 23, and on the 22nd we decided that with her health rapidly declining she was no longer in a position to sell her home, and would not be able to sign closing documents. We reached out to Ben Buys Indy Houses at this time to let them know we could not move forward with closing. They immediately threatened to *** my grandmother for breach of contract, my grandmother who was 87 with dementia lying in her deathbed. They sent a demand letter for her property via their lawyer, and spared no sympathy for our situation. We offered to pay back any money toward the title company but they refused. When my mother pointed out that the purchase agreement could not be legally binding because my mother signed it rather than my grandmother, they accused her of committing fraud, even though they were the ones who told her to do this. My grandmother passed away on March 7th, and they are still harassing us about this property, that is now legally mine do to a transfer on death deed.
