    My mother contacted Ben Buys Indy Houses to get a quote for my grandmothers home in mid January. My grandmother had been sick with ***** and pneumonia and was too weak to live alone, so we were attempting to move her to assisted living and needed to sell her house to pay for the facility. When discussing the purchase agreement, my mother told the representative that in no way would my grandmother agree to sign paperwork to sell her home as she did not want to move (she also had dementia). The Ben Buys Indy Houses rep told my mother that it would be fine for my mother to sign on her behalf, even though she did not have power of attorney, because it was a docusign online document. At this time there was no money exchanged, no down payment made, we received no monetary payments from Ben Buys Indy Houses. A few weeks before closing my grandmothers health rapidly declined and was put into hospice care, meaning we no longer could move her to the assisted living facility. Our closing date was set for February 23, and on the 22nd we decided that with her health rapidly declining she was no longer in a position to sell her home, and would not be able to sign closing documents. We reached out to Ben Buys Indy Houses at this time to let them know we could not move forward with closing. They immediately threatened to *** my grandmother for breach of contract, my grandmother who was 87 with dementia lying in her deathbed. They sent a demand letter for her property via their lawyer, and spared no sympathy for our situation. We offered to pay back any money toward the title company but they refused. When my mother pointed out that the purchase agreement could not be legally binding because my mother signed it rather than my grandmother, they accused her of committing fraud, even though they were the ones who told her to do this. My grandmother passed away on March 7th, and they are still harassing us about this property, that is now legally mine do to a transfer on death deed.

    Numerous statements regarding this complaint are materially wrong. We are in active litigation. The party complaining admitted that she was holding up the sell of the house simply for her own benefit.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 

    The business stated that several statements were materially wrong Everything I stated was true, I did not hold up the closing merely for my own benefit, I only mentioned that because circumstances with my grandmothers health had changed I was hoping to be able to take ownership of the property when she passed, but that was NOT the only reason we did not continue with the sale. This company manipulates and gaslights. Yes they are within their right to **** but they have been extremely unfair throughout the entire process and shown no compassion for our situation. My grandmother has lived in this house for 30 years, I grew up in it, and I do not want to give it away to some cheap flipper.

    I write in response to ******************************* (******************) complaint (Complaint ID ********* against my company, Ben Buys Indy Houses, located at ***************************************************************************************

    Ben Buys Indy Houses, incorporated as Grise Home and Property Group, LLC, is unlike a real estate agent who puts the Seller in touch with buyers who in return takes a commission from the sale, rather Ben Buys Indy Houses make a cash offer to the Seller to purchase the property outright. Ben Buys Indy Houses prides itself in providing consumer sellers with a fast, no obligation cash offer for their properties. Ben Buys Indy Houses is a professional home buyer whose business is to provide a Seller with a fast, no financing cash offer, what that seller does with that offer is at the hands of the Seller. Ben Buys Indy Houses provides these offers at no obligation to the Seller, rather there only exists an obligation once the Seller has executed a purchase agreement, which in return creates a legally binding contract.

    In January 2024, ******************** mother, *************************** (******) contacted Ben Buys Indy Houses to obtain an offer from Ben Buys Indy Houses for Lauries mother (******************** grandmother) *********************** (******************) property located at *********************************************************************************************. At Lauries request, Ben Buys Indy Houses, offered a purchase agreement for the Property, with Grise Home and Property Group LLC purchasing the property for a purchase price of Fifty Thousand Dollars ($50,000). ****** advised Ben Buys Indy Houses that the Property needed to be sold as ****************** was going to be moving to assisted living facility and the Property needed to sell to cover the assisted living expenses. On January 26, 2024, a purchase agreement for the property was executed. Pursuant to the purchase agreement, the closing was to take place on or before February 23, 2024, with the property being vacant at closing. The purchase agreement was sent electronically as most purchase agreements are done so, and at ******* request. At no time did any representative of Ben Buys Indy Houses direct ****** to sign the purchase agreement on behalf of her mother. Ben Buys Indy Houses received back a fully executed and legally binding purchase agreement bearing the electronic signature of *****************************.

    On February 7, 2024 ****** advised a Ben Buys Indy Houses that ****************** had moved into the assisted living facility and voiced concerns that ****************** would be unable to physically be present at the closing at the title company. Ben Buys Indy Houses advised and arranged, with the agreeance of ******, for a mobile notary to come to the assisted living facility that ****************** was at to close the transaction. ****** further provided Ben Buys Indy Houses the address of the assisted living facility where ****************** was at, for ***************** to witness her signature on the closing documents. On February 22, 2024, one day prior to the scheduled closing of the real estate transaction, ****** advised Ben Buys Indy Houses that they were not moving forward with the sale of the property.

    ****************** has falsely assessed at no time was money exchanged, no down payment made. ****************** has failed to realize that Ben Buys Indy Houses remitted ******* money to the title company in reliance of the fully executed legally binding purchase agreement. Ben Buys Indy Houses does not manipulate and gaslight its consumers rather it provides offers on properties in the form of a purchase agreement in which the seller then decides if it will execute and accept that offer or disregard that offer. What Ben Buys Indy Houses does after purchasing the property is based on a business decision of which Ben Buys Indy Houses is legally entitled to as the then titled owner of the property. ****************** fails to understand that Ben Buys Indy Houses is running a business, that runs and operates with the upmost legal standards. Ben Buys Indy Houses secured a legally binding purchase agreement not only with ****************** but also binding her heirs, legal representatives, successors as stipulated within the fully executed and legally binding purchase agreement.

    Unfortunately, ****************** fails to understand the cost of business a business such as Ben Buys Indy Houses incurs if it was to allow all its sellers to breach fully executed purchase agreements, this is neither manipulation or gaslighting, rather its business sense. Ben Buys Indy Houses most certainly offers its sympathy to ****************** and ****** in the loss of ******************, but it cannot ignore a fully executed Purchase Agreement relating to the property.

    Ben Buys Indy Houses understands that ****************** wishes for the fully executed legally binding purchase agreement to go-away, and perhaps ****************** feels that if she insists that Ben Buys Indy Houses is acting unfair and with no compassion as ****************** has stated within her complaint, that Ben Buys Indy Houses will ignore the expenses it has incurred in this matter. It simply cannot. While, ****************** believes that she will retain possession of the property via the transfer of death deed, this does not change the preceding purchase agreement.

    While Ben Buys Indy Houses does offer its sympathy to Ms. ******** family for their loss, Ben Buys Indy Houses does not agree in any fashion that it has been unfair throughout this process.

    My mother and I met with a ********************* of Ben Buys Indy Houses at ************* in January 2024 to discuss selling my grandmothers property. We voiced concerns to ************** at this time that we were unsure of if she would agree to sell her home, even though at the time it would have been in her best interest to. Because my grandmother suffered from both dementia and a hoarding disorder, it complicated both her attitude toward selling as well as her mental capacity to sign a legally binding document. It was at this time that ************** suggested that because the purchase agreement would be sent digitally it wouldnt matter who signed it, because no one would notice. Because of this suggestion, my mother signed the purchase agreement. As my mother was not power of attorney or on the deed of the home, this would make that purchase agreement invalid. Additionally, my grandmother was not able to move into assisted living as initially planned, but was moved to hospice care as she was given weeks to live - which we notified Ben Buys Indy Houses of. Furthermore, My mother and I have in fact offered to reimburse the ******* money that Mr. ********************** mentioned, but his lawyer declined our offer. This leads me to believe that this is less about the money that he has lost and about his greed of profiting from our loss. The fact that he continues to ignore these facts, is gaslighting.

    This company sends brochures using the BBB Accredited Business logo and they are not a member. They do not have real estate license or an SEC license. They call me 3 to 5 times a day. Sometimes they focus on specific properties. I have begged them to stop calling me. They told me they will not stop until I sell my home to them.

    After reviewing my database of cutomers we have no record of this address or this person. In addition to this I am a licensed real estate broker, and I am a member of the BBB so her complaints regarding those two items would not apply.  However, I still cant seem to locate this person in our database of customers. What is the customers mailing address so that we can remove her from future mailings if she doesn't want to receive any mail?
