      We made an offer based on bedroom size for our special needs son. The property is *********************************************************************** The bedroom sizes were incorrectly listed by ***********************, Manager with Carpenter Realtors ******* We were checking listings for a home that meets our challenged sons needs. He is on oxygen 24/7, has had multiple surgeries, including two heart **************** surgery. He has special needs & requires special ********************** Correct bedroom size is a must for his health. A single-story home with the 15x11 bedroom would accommodate our special needs son. ***** listing said bedroom 2 was 12X10 and bedroom 3 was 15X11. Our offer was based on bedroom 3 being 15x11 not 13x10. Bedroom 3 is only 13x10. ***************** dont give room sizes, so you trust the listing is correct with the intent to inspect the property for your protection. My wife flew to ******* from NV, to inspect the home. She immediately let the agents know the bedrooms werent as advertised & we were backing out of the offer due to the 13x10 not meeting our sons medical needs & the dimensions being falsely advertised. We would not have made an offer if the listing was correct. **** was ruthless & threatened to *** us due to breach of contract & indicated she didnt have to list the rooms correctly; it was the buyers responsibility to catch the lie before making an offer. The ******* *****estate attorney said we had no recourse, ******* is a buyer beware state, so the agent is allowed to lie. **** said she didnt care if we contacted the Realtors Board because she didnt have to be correct on her listings. An out of state buyer relies on a correct listing & thinks an inspection protects us. **** knows her listing was incorrect. She knows we would not have made an offer on the home if it had been correct & she knows we made the offer based on 15x11 bedroom for our special needs son. They could have & should have released our ******* money, but no ethics here, BEWARE of ****

      As you know, there are always 2 sides to every story. I personally spoke with ***********************, our real estate agent, about her perspective on what happened. First, she told me she did make a mistake in measuring the bedroom that *************** pointed out. When the error was discovered, she admitted to it and made the correction on the listing, but not before the Treskas had made their offer. At no time did **** act in a ruthless manner or threaten to **** She merely reiterated the disclaimer that appears on all material in the Broker Listing Cooperative which states that information is deemed reliable but not guaranteed. In addition, **** would have had little to no personal contact with the Treskas. She was the listing agent representing the seller, and they were represented by their own agent with a different real estate company. So, all of their communication should have been through their own agent. As it turns out, the room size was not the only issue, though. The buyers also had a home inspection done. There were some necessary repairs noted and the sellers offered to make them. However, the buyers refused to allow the repairs to be made and started talking about backing out of the deal. After 3 weeks of argument and during which time they consulted with their own attorney (who incidentally told them they were in breach of contract) , they finally agreed to sign a mutual release and to forfeit their ******* money. The home was subsequently put back on the market and has now resold for a lower price than the Treskas had offered, meaning the sellers were damaged by the buyers actions as well. We have a lot more details we can share if you want to investigate further, but I wanted to keep this as brief as possible. Were accustomed to people getting mad and accusing us of misconduct for doing our best to protect our clients best interests, so were not surprised by these types of allegations. We do the best we can, and most of the time people really appreciate us. Those are the folks that have kept us doing what we do for over 50 years now.       Yes, our communication was through our own realtor and her communication is with the seller's realtor, so in actually it is the same as us getting the information from Carpenter Realty. At this time the facts speak for themselves we did nothing wrong accept make a offer on a house with the wrong information. We would never of made an offer on the house if the listing was correct and not have the wrong measurements. When this was discovered the seller's realtor did nothing to remedy the issue, she just wanted the sell at any cost. Two feet smaller on the two bedrooms is a huge mistake. Carpenter Realty should have owned this mistake and let us out of the agreement and made it up to their client, that was the fair thing to do. We wanted this house because of the bedroom size for our son's special needs, and Carpenter Realty should have owned their mistake and let us out when we first discovered the room size on the first day that we had access to the property on inspection, September 9, 2022. We asked for a mutual release on September 10, 2022. Carpenter's realtor is the one who held it up after that, she knew we were not able to put our son in those small rooms and refused to let us out of the agreement. Carpenter Realty should have immediately owned their mistake and had a heart for our son, instead of holding us to the agreement and having our special needs son, I guess sleeping in the living room to accommodate his equipment. Carpenter Realty could, and should still give us our $4,000 dollars ******* money for this huge mistake as we did nothing wrong. We know there were some other issues with the house that Carpenter Realty keeps coming back to, but the seller could not add two feet to the rooms and that was the issue. If Carpenter Realty would have listed it properly then there would not have been any damages to the seller from us, because we would not have made an offer in the first place. In closing Carpenter Realty states that the realtor relisted it with the correct measurement's (still does not help us) but I know that she only changed one of the room sizes and not the other rooms. She had access to the floor plans from the seller and could have used those, or have a qualified person measure. The new listing has bedroom two as 12x10 and it is 10x10, still two feet smaller. This is just bad business, Carpenter Realty could still make this right, please do.
