They sold a car to me which they stated had no issues this car has been worked on 4times and it still is not driving properly now i wamt a refund because they ssid the engine light on is normal for this type of car and that is not true.Business Response

We have gone above and beyond for this vehicle. Replaced numerous parts including suspension parts, alignment and a transmission at no cost to the customer. Our warranty is just 10% parts and labor for the engine and transmission. We did not request the customer to pay anything. After driving the car for a while a check engine light came on for emissions which is not related to anything covered under warranty and is normal on an older car with higher miles. There is no reason to give a refund in this situation, we even offered to swap her out a car and she did not want anything else. The customer has already received her title and at this point we will no longer offer to swap her out vehicles nor be offering her a refund.Initial Complaint

The company has been contacted several times including certified letter. They refuse to pay. We will be forced to file mechanics lien on these units transported if payment is not made in FULL. 2013 ******** and 2010 Hyundai ******* were transported on 8/1/2023 from Z66 Auction in Tulsa, OK to their dealership Windy City Motors, Wichita, KS. On our end we show it was been paid back in September of 2023. I have attached a copy of the original invoice we were sent as well that does reflect a different amount of $400. Additionally we do not consent to any mechanical liens for something that we show as paid. We would like to get this resolved.

The date of this transaction was on 3/09/23. The initial contract was cancelled due to fraud. Over $3000.00 was added to my contract that I didn't agree to. New contract made on 4/10/23. I bought a vehicle from Windy City motors and the vehicle hasn't worked properly since i've got it. The vehicle has continued to shut off consistently and now it's to the point that it shuts back off when started. I've had this vehicle for 4months.I've reached out to the dealer and they don't want to make it right.They also had the vehicle for the first 2 in a half months off and on acting like they were going to fix it when they weren't. Every time I got the vehicle back the vehicle would be doing the same thing. Shutting off randomly.I didn't feel safe driving this vehicle.Credit acceptance the loan company also has internal notes on my old contract and new contract for this same vehicle in which they said they could not email me but the attorney general would be able to get this information from them. So yes, the loan company credit acceptance also knows about the car constantly shutting off. I've been making payments on this vehicle as well as paying for the insurance for a vehicle I've been unable to drive comfortably, dependably, nor safely. I'd like to have my down payment of $3000 dollars back and I plan on surrendering this vehicle to credit acceptance before my next payment due on Sept 10th 2023, I asked for a hold harmless so they go their way and I go mine but unfortunately they don't offer this. Not because I can't afford it but because it doesn't work and hasn't since I got it, no one is willing to fix the issues with it because the issues will cost more than the car is worth. Timing chain issue, crank bearing has gone out, oil leaking in the combustion chamber, a leak in the exhaust, and a fuel pump issue. In which I was told it was only a fuel sensor that needed to be replaced but there's a lot more wrong than a fuel pump censor for the reason it won't stay started.Business Response

On March 9, 2023, **** purchased the 2011 GMC Terrain on credit from Windy City. As part of the purchase, **** purchased GAP and a service contract. After the purchase, **** wanted to cancel the GAP and service contract. Windy City cancelled the products and on April 10, 2023, **** signed a new retail installment contract without those items. About a week later, **** had issues with the vehicle. Windy City took the vehicle to All Things Automotive who could not duplicate the problem. All Things did clean the throttle body. Wind City paid for the diagnostic and throttle body cleaning. Thereafter, **** returned with additional issues with the vehicle. Again, Windy City took the vehicle to All Things who could not duplicate the problem. Windy City returned the vehicle to **** and have not heard from her since. Windy City is not aware of any issues with the vehicle that would be covered by the implied warranty.Business Response

At this point in time, Windy City is not aware of any issues with the vehicle that would be covered by the implied warranty or express warranty because the last inspection by All Things Automotive revealed nothing was wrong. If **** believes the vehicle is not operating properly, she can have it diagnosed by a third party at her cost and provide Windy City with the results. Windy City will review the results and advise whether any of the items list if there are any, would be covered by the implied or express warranties.Customer Answer

I am rejecting this response because: They are aware. The car was shutting off the day I bought it & was heading home... I reached out to ****** the owner to let him know. All things automotive did look at it & said they couldn't get it to shut off but it was misfiring as well as sputtering. All things said there was things wrong with the vehicle at the time but ****** told them not to fix those things. At this point i'm tired of going back & fourth with Windy City Motors LLC (******) about this... I asked for my down payment back & for the contact to be canceled he told me he couldn't do that & that it was between me & Credit Acceptance. Credit Acceptance said he could have canceled the contract & gave me my deposit back but he told them he didn't want to & because I was unable to drive the vehicle for the time I had it without it shutting off until it wouldn't start at all & I knew he'd give derogatory information saying he kne nothing about this , I gave all documentation I had text messages & phone calls between ****** & myself from day, screenshots, pictures & documentation from the different mechanics who declined to work on it, contracts, written documentation from other customers who has had the same issues as me, & much more to the BBB, District attorney, my attorney, consumer protection, traffic safety patrol (because the vehicle wasn't safe to drive) & I stated to ****** in many text messages that I didn't feel safe driving the vehicle because of how it randomly shut off & could have caused a horrific accident not with just me but my kids as well, & I also sent all documentation I had to Dealer Enforcement. If ****** wants to give my $3000.00 deposit back I can & will cancel all complaints with all of thee above if not it is what it is & everything will pursue as it is. Unless my deposit is given back Windy City LLC & I have nothing else to discuss it's going to be between them & the above authorities that i've submitted my complaints & documents to.

Bought a 2018 Silver Malibu and the car is having issues since day one and it has never been resolved. The business is requiring me to pay over 1/2 the repair cost, including getting a diagnostics. I bought this car in January of 2023 and have not been able to drive it for one full week. it had a 30 day warranty and i took it back to them within the warranty period and they never fixed the original problem. On January 14, 2023, ***** purchased a 2018 Chevrolet Malibu with over 140,000 miles. Included in the purchase was the implied warranty of merchantability and a 10 and 10 express warranty covering 10% of the parts and 10% of the labor on engine and transmission issues for 30 days or 1,000 miles whichever came first. On March 3, 2023, ***** had ****** Chevrolet inspect the vehicle. ****** recommended replacement of the catalytic converter and gaskets. Even though the catalytic converter was not covered by the express or implied warranty, as a gesture of goodwill, Windy City paid for the repair. Now, ***** claims the vehicle is having issues, but has not identified them. If the vehicle is having issues, those issues need to be diagnosed to determine whether they are covered by the implied warranty as the express warranty has expired. Windy City will diagnose the issues but only if ***** agrees to pay for the diagnostic fee if it turns out the issues are not covered by the implied warranty.Initial Complaint

Basically I purchased a vehicle on March 30 at the establishment during the time of my purchase I paid cash for a car that was listed as a 2006 ***** ******* with no mechanical issues since purchase has been made that post has yet been taken down upon this disagreement that was had today they removed their post upon May 3 I’ve posted my vehicle on the store to resell the vehicle because in April 13 which was a Thursday I started to notice problems with the car I called to ask about the issue and the worker Steven began to be distributed by me asking could the Exhaust be checked or was there a whole in my muffler or switching vehicles he told me he would get back with me never got back with me so the following Friday I drove up and spoke with sunny another employee in regards to the matter and he assured me he would fix the problem he would be going to Auction for more vehicles and we could trade the car for something of equal value so the following week of 26 April I contacted him because he said that he is going to the auction on the 25th and he didn’t get back with me and had my personal telephone number as well as I took it and he never got back with me he says that he broke his arm and was in the hospital and would be out of the office and then explain to him that I know that it was approaching the time of my warranty expiring and I wanted to get the issue settled before it was no longer their problem he assured me that He had something for me but he never got back with me so the morning of the 27th I contacted him He said that he was in a lot of pain he was at the hospital the 28th he was out of the office for the 29th rolled around he was non-reachable so I went back to the facility on May 3 where they had another supervisor there who looked at my engine underneath my hood and had me go to a buddy dealer of theirs to get a hose put on that I was concerned about because I was told that morning that there is a hole in the muffler and then there buddy dealer mechanic If you doors down at *** ****** place the hose on the radiator tube that was loose that they told me was for the air and since then the car begin overheating And it quit working on the highway smoking another vehicle trailed me to the corner of ***** street with the vehicle then completely stopped and I had to leave it for tow home I didn’t reached out to them today with the vehicle very upset in regards to I haven’t had it in a month and it is now not working in there basically like it’s your problem prior to this in April when they pretended to find me a match told me verbally to sell the car and then posted the car on May 3 and took it down since the car wasn’t working I want it to dissolve the matter it didn’t get dissolved and now I desire to have my money back and sue for false advertisement and sell upon False pretenseBusiness Response

The discrepancy with the year was a typo that was corrected right after posting and was advised to Ms. ********* at time of purchase as also evident in the paperwork she signed at time of purchase.
The vehicle was in good condition for it being a 19-year-old car with 238k miles. During the warranty period we replaced a seat as well as the brakes for Ms. *********. After the warranty period of 30 days expired she asked for more repairs in relation to a minor oil leak unrelated to the engine or transmission. We verbally offered to pay **% of the total costs of repairs which our buyers guide stated was the maximum of our coverage. Ms. ********* declined and stated she would resell the vehicle on her own which we advised was her right to do so and she had already received the title. I advised her she could finish registering the vehicle in her name and resell it if she wanted to. She also posted the vehicle for sell on ******** for more than she purchased it for and claimed in the ad that the car ran and drove good with no mechanical issues.
We feel Ms. ********* was attempting to take advantage of our kindness in demanding a full refund after the warranty period ended. She did so in such a unprofessional manner that a police officer passing by stopped to ensure everyone was ok. The *PD does have a documentation of this incident and Ms. ********* was asked to leave the property and not return.
We feel we offered a fair resolution by offering to pay **% of parts and labor even after the warranty expired and to parts unrelated to the engine or transmission, to which Ms. ********* declined because she wanted to sell the vehicle for a profit.
We feel Ms. ********* wanted to cause such a scene at our location while customers were present in an attempt to force us to give her a unwarranted refund because she no longer wanted the vehicle.

Bought a vehicle from windy city motors LLC on August 8th 2022 l. The car quickly developed problems shortly after, with windows not working, gear selector sometimes works, very high oil consumption, and now doest run on the 59th day. I regret to hear of the customers concerns however we were not notified within our 30 day warranty timeframe. Had we been notified within 30 days we defiantly could have done more for this customer.
