      I purchased a 2005 **** ***** from Tincher ******** in London, KY on Jan 31, 2022 from a salesman named **** ********* I paid cash for the vehicle and drove it home, after the second time driving the truck I changed the oil so that I would know when it was changed and could keep it changed regularly. When i changed the oil to **** specs for that truck and started it up again I could here a chatter in the motor that was not there before. I spoke to several different people about this and they said that these trucks had a common problem with the timing system that causes the cam phasers to go out on one side. What it boils down to is I have to have the timing system redone. Timing chains, timing chain tensioners, cam phasers, chain guides, and possibly the roller followers for the valves will all have to be replaced and this all happened within a couple weeks of purchasing the vehicle. I called Tincher ******** on Feb 23, 2022 I believe and spoke with the salesman that I purchased the vechile from and he pretty much told me that I was out of luck because I didn't pruchase a warranty for the vehicle. I told him that KY had a lemon law that protects people from this type of thing and he said that was only if it was a new vehicle and because the one I purchased was almost 18 years old no place of business would cover a vehicle of that age and with over 100,000 miles on it. I told him that was a *** way to do someone that is looking to have to pay out almost $2,000 or more for parts and labor to get this fixed. Also I might add, when the oil was changed it was over filled. This was done, in my opinion, and several others to hide the chatter from the motor. Whether Tincher did this or not I cannot say or prove, but I will say someone added either more oil or a ***** treatment to this truck to quieten the noise. I'm just trying to get my truck fixed so that I can use it. It has been parked for the last couple weeks because no service company can get me in right now.

      Business Response /* (1000, 5, 2022/03/07) */ Mr. ******** was offered a Mechanical Service Contract to purchase on this vehicle at time of purchase. He signed Waiver Form stating he elected not to purchase any such plan. Mr. ******** signed document stating he was purchasing vehicle with AS-IS NO WARRANTY Consumer Response /* (3000, 7, 2022/03/08) */ (The consumer indicated he/she DID NOT accept the response from the business.) I called you about this matter and you informed me that no dealership would warranty a vehicle that was nearly 18 years old, that that was the reason it was being sold "as is". I have purchased as is vehicles before and every lot has given atleast a minimum of 30 days if something major happens. What I think happend is this dealership was aware of the issue and hid it in order to sale it quickly and just didn't think someone would find the issue as quick as I did and that is the reason as to why they are not willing to help me. Why else would a company handle themselves the way that you guys are. I notified you all as soon as the problem was found and got shafted for my trouble. Now I am setting here with a busted truck that I cannot drive to keep from blowing the motor up in it. I have been quoted from several different facilities and the prices range from $1500 to $3700 depending if I buy the parts out of pocket or not. KY lemon law states: Kentucky's lemon law helps protect consumers who have bought or leased a vehicle with a fault that affects its value, safety, or operation. The fault or problem is referred to as non-conformityan issue that does not conform to the manufacturer's warranty. In KY, a vehicle is considered a lemon if: It has a fault within the first 12,000 miles on the odometer or 12 months of purchase (whichever comes first). AND The issue cannot be repaired after 4 attempts OR the problem causes your vehicle to be out of service for at least 30 days. Eligible Vehicles Vehicles covered under the Lemon Law include: Those primarily operated on public highways. Those that require licenses and registration. Those that have been fully assembled and are in the possession of a manufacturer or dealer. Those that are new and haven't had a title issued them. By law you are obligated to repair my truck based on the rules as defined by the KY lemon law. No where does it state that it only applies to "new" vehicles that you tried to make me believe over the phone. This is anothe reason that I fully believe that you all knew of the problem to this vehicle before I purchased it. You told me and my father-n-law both to our faces that if anything should happen to the truck to bring it back and it would be fixed. Well that happened within several days and now you do not want to fulfill your end of the deal. I truly hope each and every person reading this runs from purchasing a vehicle from your company. You all are not standing behind your merchandise and promises.
