I am filing a formal complaint against ***************************** and Forward Financing due to their misleading business practices, deceptive advertising, and unauthorized financial transactions.Upon securing a business line of credit through these companies, I was provided with inaccurate financial figures and misleading promises that have significantly impacted my business operations. The repayment terms presented to me were misrepresented, and the actual deductions from my business account far exceeded what was initially agreed upon.Specifically:Misrepresentation of Terms The funding agreement was marketed as flexible and revenue-based, but in practice, the repayment amounts were rigid and not reflective of my business's actual earnings.Unauthorized Withdrawals Despite authorizing only $500 weekly payments, Forward Financing deducted $1,400 without my consent, which resulted in my account going negative.Predatory and Unethical Tactics The misleading nature of this funding arrangement, along with the lack of transparency and unwillingness to accommodate legitimate financial concerns, has placed my business at serious financial risk.Threats of Arbitration Rather than addressing these issues professionally, the company has instead resorted to threats of arbitration to enforce their unfair ************ a result of these unethical business tactics, I have formally reported both companies to the necessary regulatory agencies and will be seeking legal representation. I am requesting that the BBB investigate these practices and take appropriate action to prevent further harm to other small business owners.I am getting threats of arbitration and *** filings. Initial Loan Date: December 2024 Loan Arranged By: ****************** and Alternative Funding Solutions Issue: Deceptive and Predatory Lending Practices In December 2024, I was recruited by ****************** and Alternative Funding Solutions for a financing arrangement in which Forward Financing was supposed to provide short-term funding for only three weeks, after which ****************** would step in to pay off the loan.However, despite this agreement, Forward Financing has continued to withdraw excessive and unmanageable amounts from my business account, far beyond what my revenue can sustain. According to the contract, payments were supposed to be revenue-based, and I was told I could request lower payments if needed. However, Forward Financing has refused to honor this clause, making it impossible for my business to stay afloat.Their refusal to adjust payments, despite my financial hardship, is causing severe financial distress and may force my business to close. As outlined in the attached documents, I was immediately confused as to why my payment amount was so high, given that it is supposed to be revenue-based. Your advertisements and contract explicitly state that payments can be adjusted to align with what I can afford. However, it is clear that the deductions are based solely on what your company chooses to withdraw, rather than a true reflection of my business's revenue. The so-called "reduction" still does not align with my income, making it impossible for me to sustain operations. If this continues, I will be forced to shut down my business.
Furthermore, the "purchase price" was never properly explained to me. The third party from Alternative Funding assured me that I did not owe this amount, leading me to believe that I was misled. This situation feels deceptive. Additionally, despite my ongoing communications with both **** and ****, this issue remains unresolved. Not only have my concerns been ignored, but funds were also withdrawn from my account after I explicitly instructed them not to proceed with the deduction.
Due to these continued unauthorized deductions and the financial strain this is placing on my business, I have no choice but to stop all future payments. The current arrangement is not sustainable and is actively putting my company at risk.
I am currently working with a bank to secure an *** loana legitimate loanto repay what I originally borrowed, minus the payments I have already made. However, given your companys approach, I no longer wish to continue doing business with you. Instead of supporting businesses, your practices appear to be predatory.
Additionally, my concerns regarding payment adjustments have been consistently dismissed by **** and ****, who have only responded with threats of arbitration rather than attempting to find a reasonable resolution.

Hi Nella,
Our product is revenue-based, and according to your contract, you agreed to remit 18% of your monthly revenue, which is how your payments were calculated. This means we are only looking at your revenue, not your profit or your operating expenses. This was explained to you during the funding call that took place before you were funded, where you verbally stated you understood and agreed to all terms.
After receiving the benefit of Forwards funding, you made just three (3) contractual payments before requesting payment assistance, and Forward immediately placed you on a reduced payment plan that matched the agreed-upon percentage of your actual revenue. Then, after continued discussion of your financial downturn, we further reduced your payment as a sign of good faith, despite the fact that your payment should have been higher based on the actual revenue seen on your business bank statements. Weve conducted a full review of all correspondence on your account, and can verify that Forward employees have consistently and quickly responded to your outreach offering reductions and requesting bank statements reflecting a downturn in revenue to offer the proper contractual reduction.
Our contract also makes very clear that Forward is a distinct entity from any ****************************** (***), who may have acted as your broker. In signing the contract, you agreed you were not entering the Agreement based on any representation made by any broker, ***, or intermediary, and that you were relying solely on the terms of Forwards Agreement. Also during your funding call, Forward specifically asked if your ISO made any promises that were not reflected in your contract - you verbally confirmed they did not.

I entered into a loan with financing in 2023 under false claims by the representative. I had originally borrowed 30k which was paid weekly in the amount of $1300. When I inquired about the huge amount of percentage, I was told it was on a sliding scale. When looking at the interest rate, it comes to almost 50%. I paid this religiously for months. I complained to trust pilot and was contacted by someone at the company and they stated if I change my complaint, it will help with my payments. Little did, I know that this would be a modification and that in the end, this would impact my future loan chances. On or about June 29th Forward Financing took ********* unauthorized from my business bank account. as a small business, this had a huge impact. I have put a stop payment on all future payments with forward. From talking with other lenders does have this reputation. I have had the loan since September or October 2023 barely paid down half. According to my calculations, I should be paying close to 5000 per month and within three months or at the latest five months they should be paid off. I have received threatening emails saying that they will put a UCC lien on me. I have asked that they refrain from correspondence and I have brought this up with the BBB and the Attorney General of Boston. I was working on a great relationship with ** but I had an issue come up last week. Revenue dropped precipitously beginning in May and on May 17 I called ** but had to leave a message. No call back for almost two weeks. I had a check that HAD to clear so unfortunately I had to put a stop payment on the ** weekly payment. At that point I had paid off 33% of the note. That did finally prompt a call from ** but it was to another company I was working with to notify them I had placed a Stop Payment on their payment. That in turn prompted that company to cancel that note and call it due. Who does that? The only purpose was to hurt that relationship. ** did offer to Cut my payment in half for 4 weeks but the larger damage was done. PLEASE GIVE SECOND THOUGHTS TO WORKING WITH **. I am a veteran owned business asking for assistance or guidance. I'm over the threats and ignoring my emails. I renewed a loan with Forward Financing 09/19/23, website is confusing borrowed $85K payback $130K and I have paid $45K already. My weekly payment was $2897.75 I'm going through a lawsuit with 25 other franchisees against our franchisor for fraud and racism to where it has reduced my revenue to zero because the business has shut down due to the franchisor was my sole vendor for the business.(Forward Financing is aware and unsympathetic. I attempted multiple times to arrange a temporary payment plan but the refused and would hurl threats and ignore my emails. I am currently pay my business creditors with my military retirement and disability pay while trying to get another business up in running so I can resume normal payments in the future. I attempted have a temporary payment plan of $250 a week for 4 weeks at a time and gradually increase but the increases they wanted I can't afford. Then they implied they would take my military retirement and disability pay, take my home (have 2 kids), and my cars. They also made unauthorized debits against my account after attempting to request a payment plan. They would debit my account multiple times with different amounts and dates then what was agreed upon on our contract(mind you the account had no money so they bank account was overdrawn, which was on the verge of being closed by the bank which forced me to do a stop payment which breached our contract but they breached first with the unauthorized debits. I want to protect other military members from this company, they are very aggressive and predatory....I could not recommend anyone to lend with this company. Looking for assistance to negotiate a payment plan or debt settlement and if you are familiar with the process to blacklist this company at a DOD level to protect other veterans. Initially I accepted a reduced payment of $1297.56 on 1/12/24 because my lawsuit was supposed to conclude but did not. I contacted Forward financing again informed you I can not afford due to business closure and the settlement was not met and sent bank statements. I began to receive threats and Forward made unauthorized debits I did not agreed to and informed you I can not afford. I sent multiple emails stating my situation. Attempted multiple unauthorized debits for $579.55 weekly & $65 daily payment which kept my overdraft for multiple weeks which put my account pending closure due to bank policy. I was accused of dictating terms were I was letting you know what I could afford to pay temporary. I said I guess going through arbitration may be the only answer because the creditor got hostile and started implying threats of legal action, because I could only afford $250 a week temporary.

I did not commit to the agreement of $250 a week because 2-3 weeks later you want to quadruple the payments, because I cant afford to. Then the associate on the phone proceed to admonishing me letting me shes in control. I don't think forward financing is being honest not sure what to do. If you look at the text message I received yesterday it doesnt line up with what they are saying.

I needed a short term loan for 1 month for my company. I didn't realize by paying early I would still have to pay ALL the interest. The loan was taken out on 8/8/23 and paid off 9/13/23. I needed $10,000 but the repayment amount is $15,905 with a daily payment of $158.00 taken out of my checking account. this also includes a $495 financing fee. Purchase amount of $9,505 so $6,400 is what it cost me to get funding for ONE month. This was in part my not understanding the loan terms but it feels like this type of interest should not be legal. Companies that are desperate to get above water can't afford this kind of payback amount. It is so hard to function in todays world and companies like this are just taking advantage of desperate business owners, especially a woman in a small business. The loan amount was paid in full 9/13/23 and was taken out of my bank balance. I did talk to their customer service department and they would not budge on the $6,400 amount and I was forced to pay it so my credit rating would not be compromised. It is beyond my comprehension that a company can get by with charging that much financing for a loan for just a little over 30 days. I would like to see the company reimburse me at least $5,000 of those fees and they would still come out way ahead on a 35 day loan. It surely cannot be legal to charge these fees on a loan this small and for that short of time. Thank you for your help.Business Response

On October 5 2023 I was sold a bad loan. I borrowed ******. They deposited $14,210, which is minus a their processing fee and they want $21,900 to pay it back. I did not understand the contract or the cost of the funds. I have paid them $2346.45 and they refuse my $****** payment today to cancel the contract. Forward Financing is a loan shark company they are rude and like sending threatening emails ,text and phone calls.Back story my account was over drafted because of their daily ACH pulls . I blocked them until I could get my bank account straightened out once I got it straightened out . I noticed they started pulling money out once again which threw up red flags because they were blocked .So with the help from my bank we noticed the amount they started pulling was not the authorized amount I originally agreed to and they changed the company ID so they could get around the block I still had on my account .I never once agreed to a new amount never received a contract for this new amount.The original contract I signed was never signed by them and I know as a business owner both parties have to sign the contract and it has to be presented to both parties for filing purpose.But because they changed the amount without my authorization the original contract is voided.
