On February 22, 2024, **** (salesman for Ambassador Pools of **********) visited our home and pitched an above ground pool. We gave him a refundable deposit of $1,000 (check) toward the purchase of a $32K pool to secure the price. **** gave us the number of someone who had this pool installed but after several attempts to call his customer, we received no call back. So we visited ****'s house in *******, **, as another option as he also had this pool installed. We decided we didn't care for the above ground look and changed our mind about investing. We told **** who told us our check was never cashed so no worries. That was not true. It was cashed by our records. So I called Ambassador and spoke with two people, the person who answers the phone (female) and the store manager *************************. I have been calling for weeks to no avail. No refund, no satisfaction, no response but "we'll look into it". It's now April 2 and still nothing. So we must go another route looking for our refund. The contract states "$1,000 deposit refundable" and we made sure we had that option when we signed. I purchased an above ground pool from Ambassador pools. From the beginning of the installation process the companied business practices and business ethics came in to question. The failed to meet their own imposed services. The individual to prep the ground did not show up on the day he was suppose to which was the day before pool installation which lead to the install crew being delayed. Once the pool was assembled the individual that was suppose to install the pool liner did not show and one of the assembly crew were asked to install the liner. This individual verbally stated that he had never done it before but would try. The liner was installed incorrectly and after i spent $960 to have the pool filled, it had to be drained by the company and a new line installed. this resulted in the pool having to be refilled. The pool holds ****** gallons but the company owner refused to completely refill the pool. I called him three time and left messages but it was not until i told him that he had until the next morning to call me back or i was going to file this complaint, did i get a call. ***** Company owner) then told me that he would send me a copy of my warranty but was not going to finish filling the pool because he only put the one truck load in as a curtesy. I find this business practice to be unethical. He has also not carried through with his proposition to send me a copy of the warranty. Though not illegal it does speak to his business practices. I am seeking a refund on the water that i will have to pay to have refilled in the spring. The pool was to be closed full so no further water deliver would have been necessary.Business response

As i explained to **** over the phone, as is per our agreement we do not include water at any point in the process, however because repairs were made because of wrinkles i ordered a water truck with **** gallons for a pool that is ****** gallons as a courtesy to help out (which is not required under our warranty and agreement). The pool needs to be drained down in the winter to close the pool and now it is so there isn't extra work to do, if more water was added it would have had to be taken out as it does every year, in the spring the customer can fill the **** gallons and use his pool. Pool was installed and leaked. Pool also was not recessed 2 feet as contracted for. Ambassador had not fixed and ignored contacts. Only when I reversed the 10% deposit did ambassadors owner ***** contact me and every time it hs been an unprofessional, aggressive and name-calling approach. ***** called me late at night berating me to undo the credit reversal, telling me I was unethical and stole money from him. He totally does not get that he needs to supply a working intact product to be paid. Me reserving 10% was the only recourse I had, and he owes me half that for not recessing the pool as we agreed. . This business needs to deal with its customer promptly and politely and fix issues at install. The fact that I could not get a call until I reversed the 10% charge speaks volumes. But even more shocking is still no one has dealt with it at all. Two months and the leak still has never been fixed and my pool is a joke.Business response

******* paid in full for the pool and decided to file a chargeback to her credit card company in the amount of 4040$ with out saying a word to us. She did however wait for me to notice and wanted to renegotiate the price when i reached out. I wasnt interested. As usually happens, in beautiful karmic fashion here pool started leaking and it wasnt until then that she was interested in actually paying us for a complete job. My response to her was: give us the money owed on the pool and i will send a guy out same day to fix any and all issues, not only now but for the life of that pool. If i fix the pool i will never get paid, that im sure of. ******* has no problem not paying people for the hard work that they do and im sure im not the first contractor to go through this. Even if the BBB (cuz i love you guys) wanted to act as escrow and hold the money were owed under our contractual agreement, that she had taken out of my bank account i would do the work and trust i would get paid after. Ive been doing this long enough now to know ******* will not pay, and unfortunately after a certain period of time im going to have to give this over to collection. I run an honest clean shop and what ******* did is in direct conflict with my own values and the standard to which i hold my employees.
