Dental work performed by Mashpee Dental Assocs (MDA) in Mar 2022. Downpayment provided, insurance claim presumably filed with Delta Dental (DD). Never heard another word. 9/28/22 additional unrelated dental work, at which time I was informed previous claim (Mar work) was still "open". I was requested to pay outstanding balance in full. I did so. Asked if claim could be re submitted, MDA said was submitted twice and that it - now you're responsible. Delta Dental however informs me claim at that time had only been submitted once. Letter was sent to MDA 9/28/22 outlining this. Claim was eventually paid by DD, with check for approx 1200$ sent to MDA on 10/15 according to DD. On 10/25 I requested to MDA in writing that - what was now an over payment for service, given the insurance - be returned to me. No response. I called MDA on 11/14 and was informed that check would not be sent out until another claim (Sept 28 work) was settled by DD. First of all, this may not be legal pursuant to https://malegislature.gov/Laws/GeneralLaws/PartI/TitleXX/Chapter140D/Section22. I stated again I wanted my over payment refund from the March work. I checked with DD regarding other claim (Sept 28 work) and they inform me that check was sent to MDA on 10/11. However, the check for whatever reason, has not "cleared" If a check to another claim is missing (sent by DD, but not cashed by MDA), why should I be penalized in regard to the return of another unrelated claim? Again, is this legal? Re issuing the check in question takes another 30 days. Meanwhile I should not be penalized by retention of my 1200$ due to this fact. I feel MDA should refund my Mar work over payment at once. Please know I have had an exemplary record of payment with this office. Never has there been an outstanding balance. I have copies of documents denoting proof of payment, proof of insurance coverage relative to Mar and Sept work and all correspondence with MDA. Can furnish upon request. All I want is my refund. Tx
