    Additional Complaint Information

    Customer Complaint:
Although this collection agency has provided responses  to consumer complaints presented to it by the BBB in the past, the most recent responses date to November/December 2013.  The number of unanswered complaints posted since that point constitute significant complaint activity in our files.  The complaints allege that the company failed to provide requested information about the debt in question, did not honor debt settlement arrangements and did not address questions that disputed the debt itself.

The consumer has alleged our office is in violation of certain US Codes which is incorrect. The consumer contacted our office on August 21, 2019 and settled the account. The consumer was advised prior to payment that the account would be updated with the bureaus, but would not be deleted. The account is closed in our office with a zero balance and should be reporting as such with the bureaus. As the debt was settled and the account closed with a zero balance there is not a debt to validate. The consumer is not the original creditor. It does not appear that our office received a request from the consumer for validation prior to the account being settled, nor are there any notes to indicate the consumer disputed the account prior to payment. In addition, at the date and time of this response we are not in receipt of a complaint filed by the consumer with the ***** There is nothing to investigate as there is not a debt to validate.

Attached please find the two Fraud Affidavit packages and request for supporting documentation sent to the consumer.  We have not received the completed Affidavit or received the supporting documentation. We are unable to perform a proper investigation into the consumer's allegation of fraud until this information is received. Lastly, for security purposes, we do not provide rental applications.

I am a victim of identity theft. The following accounts were opened without my knowledge, consent or authority. I have no idea how the theft took place, nor do I have knowledge of the suspects. I did not receive any money, goods, or services as a result of the identity theft.

      Business response

This is the first we are seeing this complaint. We have not received anything prior to this. The consumer settled this account on February 17, 2021. Prior to payment, the consumer was advised the account would be updated as settled with the bureaus and would not be deleted. The consumer acknowledged the same. On January 28, 2022 the consumer alleged Identity Theft. Our office mailed the consumer a Fraud Affidavit with a list of requested supporting documentation. The consumer has not provided proof of residency during the time in question which was March 13, 2015 through November 27, 2017. Upon receipt of the consumer's proof of residency during the time in question, we can investigate this matter further.

On July 10, 2019, my signature, a copy of my ID and social security card were used to obtain an apartment at ********* Apartments in Nicholasville, KY. The rent amount was $774.00. The person paid $694.55 on the day they forged my signature on the lease. After the initial payment, the person made no attempt in paying for anything else. The lease was terminated on November 7, 2019, due to not paying rent. The apartment company sold it to Fair Collections and Outsourcing who have opened a collection on my credit report for $6,115 on December 12, 2019. On September 13, 2021, I disputed the account through ********. I have contacted the collection agency and they provided me with an itemized bill, the residential apartment lease, and the utilities and service addendum on November 11, 2021. I have asked both the collection agency and the apartment complex for a copy of the identification card used at the signing of the lease, but they could not provide me with that. The only thing the collection agent offered was to reduce the amount owed. In 2019, I was a dependent 19-year-old college student living on campus in Bowling Green, KY. According to my 2020 tax return, I made less than $10,000 in 2019. I could not afford the rent, nor did I have a reason to as I was staying in a dorm on campus. The forged signature looks nothing like my real signature. I have plenty of documents to support my signature. I discovered this fraudulent activity when applying for an apartment in November 2021.

On January 18, 2022 our office sent the consumer a Fraud Affidavit for completion and a request for a form of government issued identification and proof of residency during the time in question which is July 10, 2019 through November 7, 2019. Upon receipt, our office can further investigate this matter.

I have sent multiple certified mail letters asking for validation and the method of how they validated multiple fraudulent and questionable items on my credit report and have not received back anything in over 35 days for these accounts that are clearly inaccurate and fraudulent accounts. This credit bureau / creditor is disregarding the law and taking advantage of me and this has caused big stress on my life. The most recent certified letter I sent was 10/07/2021. The attached file is the letter and FTC I sent to them. I DEMAND that all the items are deleted and if action is not taken I will sue in small claims court in my city and the company will have to come and represent themselves.

Upon receipt of the consumer's complaint the account was reviewed. Our office had several conversations with the consumer regarding the charges and the credit reporting. The consumer paid this account in four payments in March 2017. Since the account is paid, there is nothing to validate. In addition, the account has been reviewed for fraud. A Letter of Un-substantiation was mailed to the consumer. The account should be reporting as settled in full with a zero balance.

Our office did not receive a validation request from the consumer. Our office spoke to the consumer on December 4, 2018 at which time he was advised that upon any payment made the account would not be deleted from his credit report, but would be updated with the bureaus. The consumer acknowledged and accepted and a payment was made. On October 10, 2019 our office spoke to the co-consumer. The co-consumer was advised that upon any payment made the account would not be deleted from her credit, but would be updated with the bureaus. The co-consumer acknowledged and agreed and a payment to settle the account in full was made. The consumer continues to dispute with the bureaus that the account should be removed as it has been paid. Both the consumer and co-consumer were advised prior to any payment made that this account would not be deleted from their credit reports. The account should be reporting as settled with a zero balance. If this is not how it is reporting, please have the consumer provide our office with a recent credit report and we will make another request to the bureaus.
