    We were going to buy a set of showroom display cabinets. -We went to Lindsay’s shop to see the items on 9/19/24 -We agreed to pay her $50 to deliver -She asked for half ($750 in cash) and to deliver between 9-10 that Sunday. -Daughter and I felt sick within hours We are both in treatment for CIRS due to toxic mold exposure. Our symptoms were consistent with re-exposure. I checked out a photo I snapped of the items and there was Black mold. Sunday she texted my husband at 10:52am, an hour+ after she was supposed to deliver. Gave new time of 12:30-1. We called when she didn’t show to tell her we wouldn’t be home and not bother packing everything up at that point b/c of the fact that she failed to deliver as agreed, and the mold. No answer. Texted her at 1:53, no response. At 2:34 she texts and said she was leaving now We told her we weren’t home. She responded at 3:18 saying she was in our driveway and could just leave them outside and I could Venmo her. We said no and informed her that my husband was heading out for work travel and there’s no way I could manage them myself. We told her at that point that she could just return our money and sell to the next interested party. We even offered to let her keep the $50 delivery fee. Her response was to tell us “No, I’m not doing that, we had an agreement and me being late is not cancelling that”! We reiterated that we could no longer take the items and wanted to be refunded. The following day I reached out via messenger and explained our additional concerns about the mold contamination. I told her before we came to her shop that we had been living a nightmare caused by toxic mold. She failed to disclose that her shop was full of water damage and black mold when it would have been very obvious to her. At no time was it discussed that the money paid to her was non-refundable, or a deposit. We gave her half because she asked for it. If we don’t get our money back after this, we will be filing in small claims court.
