      I just received a summons that I am being sued again by ************************** representing attorney Firm ******** and ******** which happens to own Capital Alliance. Apparently I was sued and a judgement placed in 2012 that I had no knowledge of and now are attempting to extend for the judgement for another 10 years. ******** and ******** can say their records show that they had tried to contact me on the phone If they did, they violated the fair debt collection act by not clearly identifying themselves. No letters and no attempts to siege my bank account. The first time I heard about this debt was in Jan 2022 when I received a collection letter regarding my former **** card services and the last 4 digits of my card number and I owed 5,900$ and that I could take advantage of one of the two payment plans . One for 40% off if. The other for 25% off. Since I had no clue about the judgement ( i have had bad credit due to other things but since 2018 when my identity was stolen was when I did what I needed to do to repair my credit) since a judgement goes off your report after 7 years, it wasnt there anymore) I wrote a letter asking for more information about the original amount I had originally owed to **** and I included a copy of my permanent and total 100% disability benefits because I am judgement proof I made the mistake of not sending it certified mail. It was extremely difficult to find any information from HBHC because the sold everything to *********** in 2012 and are now an international company. I knew I had a CC with them that had a very low limit. 300 or *************************************************************************************** **** due to inactivity. Nothing about sending it to collections. I cant remember if I owed money This means that they sued me the first time two years past the statue of limitations and that is illegal! Now they are wanting to *** me again 10 years later on a judgement based off an illegal lawsuit?

Please note that our records indicate that you signed for certified mail service of the original claim on June 18, 2012. Furthermore, since service Stenger & Stenger has made numerous attempts to contact you by phone with no success.  Regarding the original judgment being passed the statute of limitations, please note that a judgment in the underlying matter was granted on 07/18/2012 and service of the current action to renew the judgment was served prior to expiration of that judgment.  As such, the statute of limitations has not expired.       I was served papers from this agency on 2 separate accounts they took over. Contacted & came to an agreement. Informed them my friend would be calling to make the payment. Gave them his name so he had permission to do so. Apparently when he called there was information he needed (which he wouldnt have known unless I told him) but I was not told this when I informed the lady that hed be calling. He called, made a one time payment totaling the agreement for both accounts. Heres the best part, none of that was noted on my account, so instead of the agency calling me to question the distribution of the payment, they decided to split the payment in half. Which left one account w an over payment of what was owed & the other account w a balance. (This, according to agreement of balance owed) however since there was nothing in my account about the agreement, it left both accounts w a balance!!!So I had to call AGAIN, to get things ironed out. At this time, I was also told I would be receiving a letter that I had to sign and return to have terms met. Again, something I wasnt told prior. Ok fine.Fast forward several days, as I check the mailbox daily, I finally received mail, but it was a new court date. Why? Because apparently since they dont have their sh*t together, it showed balances werent fulfilled. And because I DID fulfill it, I didnt go to original court date. So Ive now received a letter for a continuous & if I didnt show there would be a judgement against me.So I called AGAIN!!!! Thought things were ironed out. Gal insisted she got w the legal department to get rid of new court date & to make sure the appropriate letter was sent out that I had to return agreeing to fulfillment. I finally got the letter this ***** ***** WRONG! Even though two letters say I fulfilled & $0 balance is owed, the two I have to sign, one states I now agreed to the actual full balance! And I owed over $500? This is still affecting my credit! Unprofessional!!

      Again, if you looked at the files Ive attached with initial complaint you will see that the letters you sent me are very incorrect. And if you took time to look at my file, you will see a consistent track of errors on your behalf. Which has made this process drag out a month longer than it needs to be. Im still waiting for the correct letters Im to return and sign. But thanks for not owning your errors and addressing what the complaint is about. Your response is very copy and paste. Probably a very big reason for all the errors this agency continues to make.

      Better Business Bureau:

      I really want to express that it should never take 5-6 calls after a payment is made to get things settled properly. This was a very bad attempt to collect a debt. Yes, life happens, but this was more stressful than just having the debt out there. The communication was awful. And I pray I never have to do business w you again.

      My employer received a garnishment writ to withhold my wages for a 6 year old debt. This law firm, has never sent me letters regarding this debt to arrange payments or settle, nor did I receive court filings of this garnishment. Now, it has been impossible to get a hold of them to make payment arrangements or reach a settlement. The amount they will be garnishing from my wages leaves me with a negative bank balance. This should not be allowed without notifying someone, and should not be allowed without trying to resolve the debt.

      I have been trying to make a payment with Stenger and Stenger on behalf of one of my employees. They have made it near impossible to make such payment. They have a system of automated messages that take you no where. I have repeatedly asked for a call back. I have received no response.

      I am rejecting this response because: Starting March 23, 2021 began paying settlement of $3,507.81 at $50 a month thru January 23, ****. I made final payment $257.81 on 09/19/2022 for total of $3,507.81 paid and $0 balance 52 months early. I have requested numerous times for a letter showing settlement paid in full with $0 balance and requested the writ for garnishment (income tax refund/credit) issued 08/06/2021 be canceled from the ******************* of ********* Stenger & Stenger have not supplied me anything showing settlement agreement met and writ for garnishment canceled/ recended or ended.

       Stenger &Stenger received your final payment on September 19, 2022; unfortunately, your request for the zero-balance letter made on your September 27, 2022 call and within this BBB complaint was the first request Stenger & Stenger received.The zero-balance letter was sent on the same day, and you should receive it via mail shortly, if not already. The satisfaction has been sent to the court which will release the garnishment.

      I had received a letter from stenger andstenger about a debt from an unpaid credit card I had. They took over my debt and contacted me to collect the debt. I had set up a payment plan and all went well, I had financial hardship and fell behind on these payments. The payments were much higher than I could afford but I really wanted the debt resolved as it is from a credit card I had in 2013. I had contacted them to start payments again, I made payments again and they kept sending me bills with an increasing total balance even though I had made payments so I requested documentation of my total debt owed and showing my previous payments made decreasing the total and why the amount was increasing rather than decreasing. I never received documentation of this. I refused to make any payments After that without knowing the exact amount I owed and why and where these charges were coming from. I felt I was being scammed and did not trust making payments anymore at this point. They eventually garnished my wages. This was a relief to me and that the debt would be paid off and I could move on with my life. The garnishment was fulfilled and I was contacted by my employer that they over garnished my wages and were issuing me a refund Check. After my garnishment was fulfilled, a year later I am now receiving notices that I once again owe them money. I do not understand how I owe them money when they garnished the debt from my wages and the garnishment was fulfilled as of March 2021. It is now March of 2022 and I am now receiving notices that I need to pay again. The manner in which this company handles things is disorderly and I do not trust them with my money or information. I will pay any debt to which I owe as long as it is not through this company that has lost my trust entirely. I feel as if they are taking much more and doing it in a legal manner. I will not just blindly pay, they had the garnishment fulfilled I want to understand how they are legally able to do this.

      *********************************************** is attempting to garnish my check for an account with credit one **** that was a part of a bankruptcy and it has been also removed from my credit report for over seven years Ive called them and explain to them this about three years ago and then most recently they try to file a another garnishment against me which with no grounds this is not even on my credit report I checked all three credit bureaus this account is no longer on there **** about the debt from credit one intern sent it to this company and theyre trying to garnish a check which by law even with that how are you Trying to garnish my check for an account that no longer exist Ive called credit one and Ive called **** and they both say that Stenger and Stenger is going about this by themselves

      I received garnishment papers from Stenger on March 10, 2022. I called their office immediately. We settled on an amount and paid $1,000. I was told they couldn't give me any documentation of the transaction nor the proof of garnishment release to be processed. Today, March 18th I received additional papers for "continuing garnishment" granted by the court. I again, called immediately and was misquoted not only my balance but that the release was not processed until today. *** backtracked and then stated the release was processed on the 14th but there is a delay in the court. He offered to email the release to the court if they didn't receive it, later stating in the call that he couldn't do that. When I asked for any documentation, proof or receipt, I was told that they could not legally provide that to me and there was nothing else to do. This has caused me a great deal of anxiety not knowing the status of my account, blindly giving my bank account info with no documentation of the money that I have paid or the release.

      This company has already garnished my taxes, and now trying to do it again. They are over the statue of limitations, breaking HIPPA, and more. They will not return my call or send any information. I am getting well versed in criminal law, civil rights, statue of limitations, and more. I have had ******** and work insurance. They brought this debt from another company who was also paid. The ***************** is sending proof they already garnished me. ***** ************************* says they would not have sent over this **** or still try to collect on it, over 5-7 years. These bills they are saying I owe is not accurate. They won't even call back or anything to assist me. The ******* court house granted the garnishment, but the paper came a month later. I need help.
