      Discriminating against black home owners. Since I was unable to have her poke at my personal life I moved November 1st 2023. I’ve sold the home on November 15th to my cousin. When she met with **** she felt uncomfortable **** drilled her asking her would I be on the property. She knows that that’s my sister and acting funny to the point where I had to refund her for the sale. I resold the property again. When they reached out to **** she had different rental requirements and a higher deposit and first month then she originally added to the first applicant. She told a married mother of 3 that she and her husband could not afford $230 lot rent and that buying the mobile home from me was a mistake. Since then she had filed a complaint with your office. I received a letter from the dmv saying that **** has tried filing for an abandoned title for the home. She isn’t trying to rent the property. But trying to steal it’s when I reached out to you guys back in June I warned you guys. But nobody had listened. With text evidence and testimony I have enough for a discrimination case. But I’m trying to settle it graciously. I want you to look into her dealings I’m not the first or the last person she is doing this to.

      *********** ******* appears to have moved herself from the lot, but she has left her home and other personal property on the lot.   We are not able to rent this lot until her home is moved.

      The proper procedure to transfer title to her home is in this clause of our rental agreement:

      “If the lessee desires to sell or otherwise transfer ownership of lessee’s mobile home while located on the leased premises, lessee shall notify lessor of the proposed sale or transfer.  Thereupon, lessor will evaluate the mobile home, and the proposed buyer or transferee to determine whether the mobile home can remain in the park or must be removed.  The proposed buyer or transferee must submit a rental application.  If the proposed buyer or transferee is approved, and lessor determines the home may remain in the park, the buyer or transferee must sign a lease before the sale or transfer of the mobile home may be completed.  If the mobile home or the proposed buyer or transferee is not approved to remain on the leased premises, lessee will be responsible for removing the mobile home from the leased premises. If the home is not removed, lessee agrees that the lessor shall be entitled to recover from the lessee the expenses of such property removal together with the enforcement expenses associated with repossession of the lot.” 

      I did receive two applications to rent the lot.  I approved the first one, this applicant was a young woman, with not much experience being a homeowner, but she was willing to learn.  The applicant never came back to sign the contract.  Lot rents and deposits were raised throughout the park in the fall of 2023.

      The second application was a family of 5.  The parents had a record of recent evictions.  This was a disqualification for renting the lot.  I did tell the woman applicant that she should have gotten approval to rent the lot before she purchased the home.  

      There has been no contact with the DMV from us to acquire the title to her home.  *********** is responsible for removing her home from the lot.  

      The lot that ***********'s home occupies is bordered on both sides, as well as across the street, with black homeowners who have successfully rented lots from our company for many years.

      I am rejecting this response because:
      We have not entered into any type of agreement. You refused to sign the lease. So we can’t quote what isn’t a contract. I was advised by council I had 2 options. To stay in the home and face eviction. Or to sell the property. In my first lease I had the right to sell. The First Lady you “approved” that didnt come back because you badgered her. You spoke on my previous tenancy trying to get her to say I was stil going to be living there when I already signed a new lease and began moving. You were rude to her, to the point she didn’t feel comfortable being around you nor dealing with you. Which I have documented. The family of 5 have you on auto recording telling them they couldn’t afford to rent the lot. And federal complaints have been made with proof of discrimination.

      The person I rented the land from has died and **** has taken over. She offered a 2 month lease and I ended up getting her to agree to a 1 year lease and on the same day she denied my residency for 1 year. She penned an eviction notice to my door. I own the home and I'm just renting the lot from her. She is not following the rules for mobile home rental. This has been ongoing for 3 months now. I want to continue residing where I have been there.

      We purchased the lot on which ***********’s home is located in June 2023.    We have sent several letters and text communications since then in an attempt to answer her questions, explain our contract, go over the rules of the community, and try to develop a good working relationship. 

      When the property was purchased, the owner was deceased and the estate could not find the lease documentation.  *********** did provide us with a copy of this lease and we have honored it. This lease began October of 2020, and it terminates on September 30th, 2023.  We did send her a letter formally terminating this lease.  The previous owner is deceased, that business entity no longer exists, and that lease cannot be renewed.  She was informed that this was the purpose of the termination letter.  The remedy is to sign a new lease with the new owners of the property.

      We understand that she wishes to remain in the community.   We have agreed to rent the lot to her, if she is willing to provide the information we require and agree to the terms of our ageements.   At this time she has not provided the information required, and has not agreed to the contract terms.  If I understand it, these are the points of disagreement between us:

      She has to provide her social security number.
      We use social security numbers to identify the person who is signing the rental agreement.  

      She has to agree to abide by the rules of the community.  
      At this time she has not complied with the rules of the community.  One example is, she currently has parking space for 2 vehicles.  There are 4-6 vehicles that are parked improperly on the street and on other people’s lots.  

      She has to provide a rental application from the other adult that is in her home.
      We require all adults that live in the community to fill out an application for identification purposes.   The father of her child is at her home on a regular basis.  She states that he does not live there, but has not provided his home address.  He is the person that I have seen regularly at this lot.  He works on the cars that are parked improperly.  I have tried to talk with him in the past, and did not have a good experience.  For us to have a successful business relationship with *********** we have to be able to communicate with the other adult that will be at her home.  

      These are the requirements that all the other people who live in the community comply with.  We have rented lots in this community for over 50 years.  Our goal is to have a safe, clean, quiet community, and we believe our business practices support a good living environment for everyone.

      I am rejecting this response because:
      She’s not honoring the fact I’ve already paid a security deposit to previous owner of land that she’s  now responsible for. Her application is for a rental unit not land. In the lease I received and thought I was starting it’s granted me my lot and a half, 2 additional parking spaces and it says extra parking is $25 a month. I’ve previously sign a lease for land rental no problem my home is privately owned. I recently turned in my application with no further response.

      As previously stated, to rent the lot *********** must provide the information we require and agree to the terms of our contract.   At this time she has not provided the information required, and has not agreed to the contract terms. 

      She has to agree to abide by the rules of the community.  
      At this time she has not complied.   One example, she will have to reduce the number of cars, and park them in the appropriate parking spot.  She may also be required to clean up her lot and properly dispose of tires that are stored outside.  Based on text messages from her, and her comments here,  I do not believe she has an accurate understanding of the rental agreement or the rules of the community.  I have offered to go over it with her in person, to make sure we both have the same understanding of the documents, but she has declined my offer.  

      She has to provide a rental application from the other adult that is in her home.

      We are willing to honor her claim of a previous deposit.  We did not refuse it, but since we had no documentation, we asked her to provide a receipt.  We want a good relationship with all of our tenants.  When we rent any property we always read through the contract, word for word, with each tenant.  We want to make sure it is properly understood.  I would like to ask again that she come to my office and allow us to go over the contract details with her.   If we can start off with a good understanding between us, then we have a good chance to have a positive, long-term business relationship.

      9/21/2023 I received a letter & my first months deposits and rent returned saying that she would not rent the lot to me because I won’t meet with her in person to review the lease. I met with her 4 times before and I’m uncomfortable, as soon as she can’t intimidate me she threats me with not signing the lease , She believes I’m unaware of what I’m signing. The letter also states I’m unwilling to provide information on an unidentified men in my home. For these new reasons she says she’s won’t sign my lease and I would have to move my home
