Tree service sent contract on 7-26-23 with same effective date stating he is required to provide COI. Contractor arrived 7-29-23 to sign contract collect $3,250 cash deposit and attempt to get ropes in trees to have 2-3 climbers start 8-1-23 for removing 3 large oak trees in back yard. Contractor was unsuccessful in getting ropes in trees. He said they would return 8-1-23 and it would take him 3-5 days to complete project. 8-1-23 He didn't show by 9:45 so I sent text to confirm he would be there. He stated trying to get a lift and would be there next day. 8-1-23 contact to see what time he would be there 8-2-23 . He stated to wet and said "rain sleet or shine he would be there 8-3-23. I asked for COI multiple times during this week. 8-25-23 ask for COI again. 8-25-23 Contractor states that his insurance has lapsed and couldn't get policy till 8-7-23. At this time I called and asked for the deposit back since he was required to carry insurance and it had let it lapse. I stated he couldn't get insurance till 8-7-23 at earliest then there was no way he could finish contract by 8-9-23 which is two weeks from the effective date of 7-26-23 on contract. He said he would return that was no problem. I texted later that day that if he needed till Monday 7-27-23 to get cash deposit back that I would meet him in ************* station Parking lot to exchange the deposit for his tools left on site. He said he would take me to small claims court for ***** if I was threatening with cops. I explained that safest place to exchange goods not threatening cops. I also stated multiple times that if he could provide COI and finish job in contracted time that I was willing to work with him. Contractor has not responded since.
