      We are not a customer of the company, but neighbor to one of their customers. Four times in the past 12 months, they have destroyed the irrigation line that is on our property. Three times they fixed on site. Last week, the ruptured the line and did not fix for 24 hours, with no communication from management of the issue. Multiple calls to the company went unreturned until after the line was fix. We had no understanding of the situation and zero communication. Once we spoke to management, they took no blame and just re-iterated that the line was fixed. Today, a line was ruptured. We put a call into the receptionist who confirmed she sent a note of urgency to management. It's been 6 hours and we have not received a call. The health issue is in relation to our dog. The company was laying mulch and put the mulch on our property and under our fence. The mulch was poisonous and sent our dog to the ER with toxic positioning. The manager showed no remorse and did not offer to pay the bills.

      To whom it may concern,

      It seems to me that we are in the middle of a neighbor war, one of which we want no part. We are planting trees on the **********'s property and we have hit the neighbor's (*****) main irrigation line on more than one occasion. We are doing our best to avoid the line, but the line appears to be on the **********'s property and it is entangled in tree roots. We are carefully digging, but it is hard to see the main line through the tree roots. We have openly communicated with the *****'s throughout the process, but they need to understand that their irrigation main line crosses the property line. We contacted Missouri Dig One prior to digging and received its approval to proceed. We have repaired the line for free. We feel our efforts in attempting to resolve an error caused by the *****'s irrigation contractor should, candidly, be lauded and not condemned. The *****s should remove and relocate their main line or, unfortunately, deal with the temporary unintended consequences. Our men are just doing their job and mean no ill will. 

      Further, we mulched around the trees on the **********'s side of the fence, and the *****'s dog dug under the fence and ate the mulch. Our mulch is a natural product with no additives. Proper training and monitoring of the dog would seem to be the quickest and simplest solution.

      2 complaints: 1. Meyer did foundation and drainage work on my property that was not done to Ladue code, unbeknownst to me, until after the work was completed and paid in full. Ladue inspected and told me the discharge line was placed in my neighbor's property/within the setback. After hiring a survey engineer to submit for my grant by drawing in the drainage lines at a cost of over $500, I did not receive a $10,000 grant from Ladue resulting in a personal loss exceeding $10,500. 2. I hired Meyer to install a flagstone walkway this past summer. I was quoted $550-750 for the Eden stone and $1680 for 1 day labor for the stones and to move some other plantings for a max total of $2430 + tax. I Requested they lay out the stone for approval prior to installing and they agreed.. The day prior, they tagged a palette weighing 1.5 tons at a cost of $780 per ton, bringing the max total to $2850 + tax. Meyer laid out the stone and then returned the following day and dry in-laid the stones (no foundation or concrete etc). I received a bill from Meyer for $4131.38 for the work, almost double the original bid! I was told that because they came more than one day, the labor charge increased even though the work was the ***e amount of hours (plus one additional stone replacement with a spare) and I had made the request for approval prior to them starting. I called and sent multiple detailed emails asking to speak with the owner and never received a call or email back. These are all documented by email and text messages. Due to lack of response, I sent in a final payment of $2910 based on the 1.5 tons and adding sales tax and marked my check PAID IN FULL. This was deposited. I requested lien waivers on multiple occasions and was denied. After multiple calls and emails, the new one, **** ***** called me back. He scoffed at my concerns, told me I was a "problem" and then insulted and cursed me for bringing this up and told me to find someone else.

      To Whom It May Concern,

       

      We have had numerous problems while working for Mr. *******. He has a problem with every job, disputes every invoice, and seldom pays in full. The invoice in question was an estimate.

      We had extra labor and materials. We tried to explain this to him, but he refuses to listen. We had to come back an extra day because he had to see the walk laid out before installation. We bid the job for one day and he turned it into two. We have had a change in ownership during this time and he insisted to speak with me the new owner. I told him to just pay the invoice in question and find another landscapes as we are obviously not a good fit. He sent in payment and shooted us $320.00, in addition to $140.00 we previously discounted after he complained. According to Mr. *******, he applied for a grant a year after we did a drainage job which was paid in full and works perfectly. His grant is his problem. Although we feel cheated, we accepted the money and cashed the check. We consider the matter resolved.

      I am rejecting this response because:

      There were 2 complaints here and only one was responded to directly:

      1. The initial work was not done to code. I brought this up to ******* ********* shortly after the work was completed and no repairs were offered.  Meyer is not denying that the work was not done to code; otherwise a refutation would have been made or explanation  would have been provided as to why the discharge line was done outside of code, and they are not offering to repair this.  Since the owner was hostile and non-cooperative and I no longer trust them to work on my property, the only alternative for me is to hire  another contractor to bid this and Meyer should  agree to be responsible for the costs to bring the irrigation lines to code.   In addition, I paid over $500 to have a survey drawn of the work and I can provide receipts.  I will have to have them redrawn after work is completed so Meyer should be responsible for one of these.  I may not be able to get the grant anymore if funds are depleted due to these delays and Meyer should be responsible for $10,000 in losses since I can provide documentation that I was approved but failed to receive the grant after the survey of work done by Meyer confirmed by work was not within Ladue code


      2. I was given an actual bid for "1 day labor" with a plan to lay it out the day prior.   That does not mean it's OK for Meyer to act as if 2 hours of labor is the equivalent of  "1 day".  Furthermore, I have an email from ******* ********* AFTER I COMPLAINED ABOUT THE WORK THAT WAS COMPLETED, on Sept 7, stating "***.......Any new work (future projects) moving forward will be performed on a time and material basis as there seems to be a pattern of questioning all invoices. Thanks, *******"


      This confirms/proves that my bid was not an "estimate" but rather an actual bid for work.  Furthermore, the bid never stated" time and materials" or "estimate".   Out of good faith, I did send additional money to cover the materials even though the amount of material for a project that should have been accurately bid due to the small area was grossly underestimated by 1/3 and I am not happy about this lack of professionalism from eyer because I would not have proceeded for their bid.
