During this process, we confirmed that the insurance company would only approve a partial replacement of his siding. Due to some rough weather last year after a storm, my siding came off my house as well as the roofing and guttering. I contacted these folks, they did the work and my insurance paid for them. To Whom It May Concern:

We want to address the recent complaint filed by ****** ******* with the Better Business Bureau. In the interest of transparency and accuracy, we present the following details: We strive to uphold the BBB Accreditation Standards and prioritize ensuring that all customers are fully informed and comfortable with our services. On September 27, 2023, we entered into an agreement with Ms. ******* to replace the siding on her home. After negotiating with her insurance company for several weeks, we obtained partial approval to replace the siding. Ms. ******* understood her insurance company did not approve the complete replacement, told us she was not interested in paying the difference and authorized us to replace only what her insurance company would cover. We then worked with Ms. ******* to select the colors and scheduled the partial siding to be replaced on May 29, 2024.

We sent Ms. ******* an invoice for $4,378.98, the total amount due for the work we had performed for her. Attempts to contact Ms. ******* during August, September, and October were unsuccessful. We finally spoke with her regarding the balance due on November 21, 2024. During that call, Ms. ******* shared that she had some concerns about the siding, and we worked with her to schedule a time at her home on November 26, 2024, to review the concerns with her. During that call, Ms. ******* shared that she had submitted a complaint to the Better Business Bureau.

We look forward to resolving Ms. ********* concerns and collecting the final balance due for the work we performed.

Advocate replaced our roof under insurance. *******, gutter guards and downspouts were included in this claim. We gave Advocate a deposit of 10k and signed a scope of work agreement authorizing them to order siding, chosen from their samples, to replace the siding on our entire home that we would pay out of pocket. They completed the roof and we agreed to hold off on gutters pending the siding installation. We released 10k for the roof to them. We were then told we would need to pay an additional $3500 for an offset of what insurance covered and what it would cost for gutters. This was quickly resolved and advocate agreed to absorb that cost. A month later we were told they had our materials and were waiting to get us on the schedule to install siding. After countless attempts to reach out for a schedule date with no answer, we were told the siding they told us a month ago they had was actually never ordered and was discontinued. It was not. We got our deposit back and went with another company. The new contractor found serious defects on our roof. Advocate inspected and found defects as well but claimed it wasnt that bad. Another 3rd party report, my current contractor report and city building code violations support that my roof needs to be replaced due to poor craftsmanship. I was routed to their in house lawyer ********************* who has refused to offer any kind of solution and has reminded me that Advocates contract calls for mandatory arbitration and protects them from being liable for any legal cost associated with doing so. Arbitration cost on average *****k according to my lawyer. Advocate also reminded me that arbitration is mandatory to even take them to small claims I have indisputable evidence that my roof is defective and I am now stuck paying out of pocket to replace it due to poor craftsmanship and a refusal to make it right by Advocate and its on staff lawyer.

    ****************,

We are very confused. We have in writing from you what an excellent job our crew did including cleaning up afterwards. Based on our communication, it seems you have some confusion with regard to how insurance companies compensate for individual scope of work line items. More than ****** homeowners chose Advocate because we perform our work according to manufacturer specifications and municipal codes and we stand by our work with a 2 year Advocate warranty in addition to the warranty offered by the manufacturer. As you are aware, in your case your project is not eligible for a warranty (yet) because in order to be eligible for a warranty the homeowner must actually pay for the work that was completed. You have failed to do this. When a homeowner refuses to pay the balance due, their file is flagged as not paid. In the retail world (such as ******* or Camping World) it would be considered theft if someone walked out of a store with a product and didnt pay. With regards to your project, Advocate is happy to meet with any municipal inspector or the material manufacturer or insurance company to review any items of concern. We are confident all items have been installed to meet or exceed the specifications required and as such it would qualify for a manufacturer warranty and would pass inspection of your municipality.  In the event the roof did not pass the manufacturer or municipalitys inspection for some reason we would absolutely address it as we have said already. We do not, however, make decisions about warranty items or line items of concern voiced from friends of homeowners or another roofing contractors that have been hired by homeowners to create an estimate for work to be completed (especially in the very rare situation that a homeowner chooses to not pay us for the work we were contracted to perform and completed). We would love nothing more than to get you paid-in-full with your warranty in hand supported by both Advocate and the manufacturer so we can turn this into a 5 star experience like thousands of others who have reviewed us on ***************** BBB, Yelp, Nextdoor and other sites.

There is a lot to unpack here.  It seems that some of ****** posts on different online platforms have been modified and mention different things. This variation combined with ****** repeated phone calls and multiple emails over the last 48 hours leave us confused. While we generally prefer to work out any discrepancies face-to-face with our customers, we will attempt to reply to everything all at once on this platform since the ****** have chosen this communication method.

The photos uploaded by ****** are different from the photos taken after ********************** completed the roof installation. As a standard operating procedure, ********************** takes pre-construction photos, during-construction photos, and post-construction photos documenting the work completed by our crew. These photos are used to provide details of completed work with insurance companies, mortgage companies, municipalities, and material manufacturers to prove our work meets or exceeds municipal codes and manufacturer specifications.

Thankfully, it is very rare and highly unusual to have customers make false claims against us and publicly try to hurt our reputation in an attempt to get us to pay them a large sum of money. We literally had the ****** attorney tell us that if we didnt abide by ****** demands, ****** would launch a social media attack on our reputation.  Posting photos that are out of context and without a timeframe that establishes facts is both defamatory and libelous. To avoid this escalating further, we would encourage you to modify your posts to accurately describe facts and not make false claims. While we did not take our photos for the purpose of defending ourselves against false claims, the photos are beneficial for establishing facts and recreating an accurate timeline.

More than ****** homeowners have chosen ********************** since 2012 because we perform our work to meet or exceed all manufacturer specifications and municipal codes, and we stand by our work with a 2-year ********************** warranty in addition to the warranty offered by the material manufacturers. As you are aware (and it seems to be contributing to your frustration/confusion), in your case, your project is not eligible for a warranty (yet) because to qualify for a warranty, the property owner must pay for the completed work. ****** has failed to do this as of now. When a homeowner refuses to pay the balance due, their file is flagged as "unpaid". In the retail world (such as ******* or Camping World) it would be considered theft if someone walked out of a store with a product they didnt pay for.

After reviewing this file with our teams, we take accountability for two (2) mistakes: 1. notifying ****** that the siding material they chose was not available and 2. not communicating as expeditiously as we should have with regards to the siding material order. To clarify, we make money by installing roofs and siding. Thats literally our business model.  We notified ****** that material was not available because we genuinely believed that the material was no longer available (based on several distributors telling us that).  There is a reverse financial incentive for us to lie about the availability of a given product (meaning by incorrectly telling ****** the product was unavailable we lost the job and therefore lost revenue and profit).  From ****** perspective, we refunded them the deposit for siding (because again we genuinely believed that the material was not available) and ****** went on to hire another contractor to complete that work. This was refunded in good faith even though ****** still owed us a balance due on the roof. This has become a learning experience for ********************** and we are going to be modifying our operating procedure to prevent this from happening again.  We apologize and take accountability for this mistake.

To suggest that ********************** liedrepeatedly is not only false but completely illogical and outrageous.  There is absolutely no reason whatsoever why we would want the siding material to be unavailable.  This ensuing negative campaign combined with an attempt to hire an attorney to sue ********************** for damages is absurd.Suggesting that ********************** lied in order to somehow benefit from not doing a siding project is verifiably false, defamatory, and libelous.

With regards to your roof, there is nothing presented to us that indicates your roof (the work ********************** completed) is not up to code or installed according to the manufacturers specifications.  There is an implication from ****** that our work is bad and/or not to code, however, there is no reported leak, no reported damages, no issues related to our construction presented that would justify any damages.  Suggesting that **********************s work is bad and not to code, is verifiably false, defamatory, and libelous.

It is our understanding from your attorney (that **************** himself removed pieces of the facia after our work was completed) which left that section exposed to the elements. Suggesting that ********************** caused this is verifiably false, defamatory, and libelous.

PROPOSED RESOLUTION: As we have previously stated already multiple times, we propose meeting on-site to review the timeline and the photos uploaded by ****** and compare them with the photos ********************** took throughout the process.  While we are open to modifying the meetings guest list, our initial thought is the meeting should include ********************** representatives, ******, the other contractor ****** hired to complete the siding work, any inspector(s) ****** hired, a representative from the material manufacturer (which is who would have to warrant that the installation was according to their specifications), any municipal inspectors (if applicable), and any other people ****** would like to have present. During this meeting, we can recreate a timeline using our photo library, along with the photos ****** took and any photos taken by ******' contractor or inspector.Once we piece together the timeline, all of us will be able to see the condition of ****** home before, during, and after ********************** performed work. If the facts show that the products we installed do not meet or exceed the manufacturer's specifications and municipal codes, then we (of course) would fix any deficiencies. And, if the facts show that **********************'s work was performed correctly and the issue surfaced after your other contactor was on-site and performed additional work on the roof, siding, or gutters.... would be reasonable for ****** to pay the balance due to ********************** so that 1. ****** would be eligible for a manufacturer warranty, and 2. because that's what we (****** & **********************) mutually agreed to when we entered into an agreement?  ********************** would love nothing more than to get you roof warranty in hand supported by both ********************** and the manufacturer so we can turn this 1-star review into a 5-star experience like thousands of others who have worked with us and shared their experience on ***************** BBB, etc.

It all started with a door to door Advocate salesman looking for damaged roofs in summer of 2023. So we contracted them to replace our roof. We discussed and added partial gutter replacement where a tree branch had fallen on the house a few months prior. ******** said it would be about $1,000 extra out of our own pocket. We later decided not to go through with the gutter work since it was cosmetic only. There was damage to our driveway that cracked from the dumpster or the shingle loader. Not sure which one but they told us they contacted the 3rd party and there was an adjustment. We never saw any paperwork regarding that incident showing how they arrived at the estimate needed to repair. But we decided to accept it. We thought we were paid in full on amount owed to Advocate. A few months later we received an invoice saying we owe Advocate $1521.29 in addition to the credit received for driveway. On the invoice it shows a charge for gutter that was not done. Also, my research concluded that roofs need vents which I think Advocate should have known. I realized the salesman had no experience with roof construction, only sales. So he came back with a person experienced with roof installation. We were notified that they could not find the color and material we wanted to match our new roof. We wanted black steel turbines for our grey roof, not brown aluminum. It took me 10 minutes to locate them online thru ********** so I bought them myself. But Advocate has a charge of $250 for "additional turbine vents homeowner wants added" on the invoice. I included a copy of the ********** receipt in emails. I have been emailing the salesman, the sales manager, the Invoice Supervisor. I called the invoice supervisor last week and today and have only gotten voicemail. Messages do not get returned. Since they are ignoring me, I decided to post on BBB.

In May, Advocate construction came to our door and told us that our roof had hail damage and we could get a new roof through our insurance. Our insurance approved the roof for the house and garage as well as “detatching and re-setting” the gutters on both structures. In July, our roof was replaced. The gutters WERE NOT adjusted. Advocate just removed some of the existing hangers and screwed in some new hangers. Many hangers were left untouched. I placed small brown nails in each hole from the previous hangers and they all line up. Clearly not adjusted at all! This has now caused unneeded holes in my gutters that **ll leak and create issues **th the fascia. Snow and ice **ll buildup that **ll rot out the wood in time. This crew just did a cover up to make it look like something was done correctly. Gutters are supposed to be set 3 inches down from the roofline. We have a balance remaining **th Advocate, but a majority of that balance is the cost of the gutter job that was not completed. We have been in contact multiple times **th Advocate over the last 3 months to no avail. Their response to us is always, “we told you we **ll not be doing any work on your gutters.” At one point, (in a text that we have from them), they were prepared to walk away from us and let us keep our balance. Now they would like us to pay for a job they never completed. I feel that is fraudulent. We have before pictures that came directly from our insurance company, and after pictures that prove this. We would just like a resolution to this, because right now we still have to fix the gutters. The money that they believe they are “owed” is what we need to fix the problem. We do not want any additional work done by this company. The before pictures included are marked **th a “B”. The after pictures **th an “A”

This company broke a rafter in my attic and said they were not going to fix it because they did not break it.  I have cameras and when I went to inspect the work they did I noticed that they clearly tried to cover up the mistake but couldn't so they were already being deceitful as far as accepting responsibility for their mistake.  I have the 8363 dollars that I intended to pay them but now I do not trust they will fix their mistake.  My son in law works construction and inspected the roof and told me it would have to be repaired by coming in thru the roof of the attic and taking it down that way.  They continue to send me bills but refuse to honor my request at fixing the damage they did to my roof. They sent me 2 different letters  and have threatened to put a lien on my house but I did not react to them because I want them to fix my roof.

    Good afternoon,
We are working with the homeowner to see if we can assist them. We have reached out to the homeowner, and will continue to do so.  When Advocate Construction starts a project we take pre-construction photos, as well as do a site inspection.  When we inspected the truss in the attic, it appeared that the crack in the truss had happened a long time ago, before any re-roofing took place.

At Advocate Construction we try and ensure we meet or exceed our customer's expectations.  In this case, we are trying to work with the homeowner to fix this issue, even though it is not our issue, as it is pre-existing.  There are several ways this can be repaired, and we hope to work through this issue together.  We have completed over 16,000 successful projects and we look forward to working together on this one as well.  Thank you.     sjm

    Complaint: ********

I am rejecting this response because:

they were not in my house until after they finished the job.  I have pictures as proof.  His excuse was not to fix it.  They did not inspect it before the job was done.  They said it was old because of the dust.  I have insulation that is powdery and that is what they are claiming is old.  It is not old.  There is roofing stuff in my attic where they were working.  They tried to fix it with a 6 inch nail in the rafter where they tried to fix it.  It is in the underlay.  They didn't say anything and covered it up.  I would like for them to send me their bonded insurance person.

    Sincerely,

They have lied, they have never been in contact with me.  I would like to know who their insurance company is so I can reply.  I don't know what else to do.  I want them to fix my roof that they broke.
