    Contract for gym signed 30 Jan 2020, due to pregnancy didn't go to the gym doctor told me I had to refrain from any physical activity, moved onto base housing and didn't go to their location. because of this I tried to cancel and told them I had a profile and that I moved especially since the gym on base is closest and free. I tried to cancel the contract was given no way out unless I paid an unfair amount to cancel. Called multiple times about canceling and was given no date or copy of contract. Called again to cancel it and they told me in renewed in February, I was unaware of this action. They then finally sent me a copy of the contract and they told me I couldn't get out and had to either pay more to get out again. They told me I could get out of the contract if I got orders to another base, however I am currently on hold due to medical issues, and am not projected to leave anytime soon. They are still attempting to contact me trying to get money from me. My husband and I have tried to contact the owner and was given no call at all first. There are a lot of military members I know who are experiencing the same issue with this exact gym. I have not once gone to the gym within the whole 3 years probably only once for a tour. I asked them why they didn't tell me and the other members that the contact was going to expire with in 30 days, they said it takes too much of their time, that Netflix doesn't do it. The workers there are not helpful and in my opinion they are not military friendly, but a gym that is taking advantage of the fact that we military members always have a paycheck and can even get in serious trouble if they send this to collections since I refuse to pay them anymore. They have gotten enough money from me there is no reason why I should give them more. They have taken $32.83-$42.83 every month.

    To whom it may concern:

    ***** **** contacted us on 8/2/23 requesting a copy of her contract. After receiving her request, we emailed her the contract immediately. We then told her to please give us a call at her convenience to discuss the contract. 

    After she got her contract we went over the policies with her via a phone call and text. We wanted to work with her and as the contract states  “to terminate early it is $300 or 50% of the remainder, whichever is more.”Attached you can see where she consents to the $300 early termination fee by allowing us to withdraw $100 a month until the debt is paid off since she did not have the money to pay for it upfront. 

    Her complaint was only filed once she failed to uphold her part of the payment plan by neglecting to make the first $100 payment scheduled for the 15th of this month. 

    Lastly, Never during the contract term at our company did she notify us or mention any medical issues or pregnancy.

    I am rejecting this response because:

    I did tell them that I was pregnant, they told me the only thing they could do was not charge me during those months of pregnancy. That I wasn’t going to be able to close my contract cause of it. I did not want to pay anything at all, I was frustrated by the simple fact that they were giving me no option to get out of my contract knowing that I did not want to renew it. I did call them multiple times telling them I wanted to cancel it. The simple fact that they already know all of this and are telling me to pay even more, I refuse to pay a single cent. They have gotten enough money from me knowing I have never gone and will not go. I only said yes cause they didn’t give me any options knowing all of this. Why after knowing this they still refuse to cancel the contact with not having to take more of my money from me, the money that have collected already is more then enough!

    We reject ***** ***** proposal… 



    Again as stated in our previous email she never notified us of being pregnant. Nor did she contact us prior to this to “get out of her contract.” The day she asked for her contact information we sent it to her and worked with her on her early termination by setting her up for a payment plan of paying it off in installments of $100/month starting 8/15, 9/15, with the final payment due on 10/15. When she failed to make her first payment plan installment on 8/15/23 is when she shortly thereafter filed a complaint against us…

    We have a legally binding contact of her signature agreeing to these terms & conditions. We also have her consent in text messages where she agrees to payment plan to terminate her contract with us. 

    If you read her contract you will see we helped her by giving her the “lesser buyout,” to help in closing her account with us in good terms to avoid collections..

    We have went beyond what we need to do to help **** close her contract with $300 buyout payment plan and which we have proof In text receipt showing she agrees to pay and not to mention the legally binding contract that says she agrees to pay 50% the remainder due to terminate early.

    So with that being said, we are going out of our way to work with her by giving her a cheap buyout than the contract says but while still staying within our policies.. To make sure we treat all customers equal.

    At this point this is all we can do for her. If she don’t want to pay it we can send it to our attorney or collections company where she can set up a payment plan and she can pay them so we can close her account.
