On August 26th 2024 I was notified by my bank USAA that a writ of garnishment was placed on my accounts from Jacob law group. This resulted in funds being placed on hold in not only my account, but also my son’s account. This happened after Jacob Law Group had been contacted and notified multiple times by my wife (caregiver) that I am a combat veteran rated at 100% and I am considered judgement proof and protected. The dates they were emailed and had corresponding phone calls were June 25,2022 and November 7,2023. They pursued their harassing and illegal debt collection practices even after they told me on the phone in 2023 that everything was handled and taken care of.Business Response

Thank you for the opportunity to respond to this inquiry. ********* ******* ******* **** our client, placed this account with our office on December 28, 2021, for collection of a past due debt that originated with *******. On December 30, 2021, our firm mailed an initial letter in compliance with the Fair Debt Collection Practices Act to the Consumer. On June 7, 2022, our office filed a lawsuit on behalf of ********* ******* ******** *** as the plaintiff in the Circuit Court of Crawford County, Arkansas. Per our records, this lawsuit was personally served on the Consumer on June 18, 2022. After no Answer or responsive pleading was filed by the Consumer a default judgment was enter on August 5, 2022.
Subsequent to the judgment being entered, a bank garnishment was filed and served on USAA Federal Savings Bank. On August 26, 2024, the Consumer’s spouse called our office and stated that funds that were garnished were exempt funds. At the time we had nothing showing the amount of funds that were exempt, nor did we have an answer from the bank stating the amount of exempt funds.
Further the Consumer has stated that the subject debt had been forgiven by ********* *******, LLC in May of 2024. Nothing has been provided to our office showing this.
On September 6, 2024, our office received a copy of an answer to the bank garnishment from USAA Federal Savings Bank, through their attorney. Per this answer, the total amount of funds that are subject to the garnishment was $673.37. No funds have been received in our office.
Although there appears to be funds that are subject to the garnishment per the answer from the bank, the garnishment is in the process of being released and the judgment satisfied at the request of ********* ******* ******** ***. If any funds are received as a result of this garnishment, they will be returned to the bank with instructions to release them to the Consumer. We spoke to the Consumer’s spouse on September 6, 2024, and provided her with this information.
The consumer may contact our office at ************ with any additional questions or concerns.Initial Complaint

We have been in communication with the consumer on 9/29/23, 10/16/23, and 11/08/23. The last several contacts the consumer was calling in to lower his monthly payments due to losing his job and his payments were adjusted due to his hardship. The consumer has paid a total of $3400 on his account as of 12/15/23. I will make sure an agent reaches out to the consumer today to give him his account number and an update on his current balance.Customer Answer

I had a garnishment against me. I paid the amount off with Jacob Law Firm....but by that time my employer had already sent $468.86 to the law firm. I called and spoke with a few people and I needed my money back that my employer sent to them since it meant that I paid them twice. It has been a month and nobody will call me back so I can get my $468.86 that I have paid twice now. The original amount was $1,568.42 and I paid that but I am desperate to get my overpayment back. I am a single mom that basically didn't get a paycheck for a month due to the garnishment. I call everyday to get someone to send my overpayment back but nobody does. They said that they had to figure out the way "proper method" to send the money back. Really? Well they were sent a check so my guess would be to send it back the same way they got it!Business Response

We have spoken to the consumer two times since the complaint was filed. We admit there was some miscommunication at first on if refund was going to be sent to employer or consumer(Garnishment Overpayment.) It was sent to consumer(4/26/23) and she had not received causing her to be frustrated.( I do understand its not a small sum). She spoke to our cash department and they agreed to give it one more day. The consumer called in on 5/5/2023 and stated was not in mail so we requested our accountant to ACH the refund into consumers account they provided details to on 5/5/2023.Initial Complaint

I had accounts land with Jacob Law Group, Oxford. As I was in the midst of a divorce, a single Mom, and fighting chronic illness, I could not pay them but asked about a settlement offer or manageable payments. I was given monthly payment terms way out of my budget or threat of court or garnishment. I told her I was planning ti start a 2nd work-from-home job in 3 months but she wouldn’t wait. I arranged 3 payments but told the rude female employee I could not afford them.. She would not wait. I wrote their office noting the one high payment caused an overdraft and requested new payment options. No reply. Today I spoke with this same condescending employee and she was rude, insulting, and inflexible and said it would be garnished. I asked to speak to a superior. She would not let me. Very rude and wouldn’t even let me talk. I have sent an email to company owner ******* Jacob. I am very upset.Business Response
