On approximately 09/07/2023, my wife's (Taneash, the Car Title is in her name) 2012 Chevrolet Captiva (Vin# *****************) (201K miles) was towed to Durabild Transmissions on 46 Lowell Street in Nashua NH. We were interested in getting our transmissions fixed/rebuilt. On 9/11/2023 @1:52 PM, Skip at Durabild called to tell me (Michael) that the vehicle needed a new transmission with a proposed price of $5,515. I asked about rebuilding the transmission or getting a new one, Skip at Durabild was non-committal about those options, and I was non-committal about a new transmission.. Neither my wife nor I ever gave Durabild Transmissions consent or permission to perform any work or take any actions regarding said Chevy Captiva, beyond the initial diagnosis. We did not want the part installed. On 9/13/2023 @ approximately 8:45 AM, I personally visited Skip at Durabild and instructed him as such. I left with the intention to return with AAA to get the vehicle. After a round of phone calls, where Skip's story and facts changed a number of times, Skip at Durabild Transmissions informed me that unless I paid him a 35% "restocking fee" of $1,200, he would not let us have our lawfully owned property. We dispute Durabild Transmissions demands that we pay them $1,200 restocking fee for a part we did not want, nor for which we asked, nor gave consent to obtain, and of which Durabild Transmissions never took delivery. We never signed any contracts nor gave verbal consent for Durabild Transmissions to take any action on the vehicle beyond the diagnosis. We were never made aware, prior to, of a "restocking fee for parts we did not want. If we had been made aware, prior to, of a "restocking fee" we would have never done business with Durabild Transmissions. This is a vehicle with a KBB value of $253-$1,250. That is why once Durabild proposed a price of $5,515 for a new transmission, I was adamant that we did not want Durabild to move forward with any actions on this vehicle.Business response

If NOT PAID IN 3 DAYS STORAGE STARTS AT 85.00 PER DAY. I HAVE SECURITY CAMERAS THRUOUT THE SHOP. I HAVE SAVED THE RECORDING FROM 9-13-2023 WITH MICHEAL SAYING HE WISHED TO NOT FIX THE VEHICLE.CUSTOMER AUTHORIZED REPAIR BY PHONE 9-11-2023 ORDERED TRANSMISSION ASSEMBLY FROM ********* CHEVROLET 9-13-2023 CUSTOMER CHANGED HIS MIND. GM RESTOCKING FEE IS 30% .AT 1:30 ON 9-13-2023 THE CUSTOMER SHOWED UP WITH TH POLICE, I NOTIFIED POLICE ABOUT RESTOCKING FEE WHICH IS GM POLICY CUSTOMER COUNTER OFFERED DIAGNOSTIC TIME AND THE CAR TO WAVE THE RESTOCKING FEE. I DECLINED AND TOLD THE POLICE THAT IF NOT PAID IN 3 DAYS STORAGE STARTS AT 85.00 PER DAY GM RESTOCKING FEE IS 30%. I HAD ALREDY TOLD THE CUSTOMER IF NOT PAID IN 3 DAYS STORAGE STARTS AT 85.00 PER DAY TOLD HIM AT THAT TIME THE PARTS WERE ORDERED THRU ********* CHEVROLET AND I WOULD CALL THEM TO SEE WHAT THE RESTOCING FEE WOULD BE, HE AGREED. THIS IS RECORDED. THE RESTOCKING FEE IS 30% WHICH IS 1200.00. HE NOW OWES 85.00 PER DAY STORAGE AND AS OF WEDNESDAY I WILL FILE WITH THE STATE A MECHANICS LEIN AND ABANDONED VEHICLE. THE VEHICLE WILL GO TO PUBLIC AUCTION AND I WILL FILE COURT PAPERS FOR THE BALANCE DUE.Business response

This job was authorized as stated before or I never would have ordered the transmission. As stated before recorded on surveillance when the customer showed up he told me he wished to no longer proceed and I informed him the transmission had been shipped and there would be a restocking fee. He agreed until he found out it was 1200.00. I have to pay GM 1200.00. The vehicle was abandoned with me. I will waive all storage charges if the vehicle is picked up by Tuesday October 17 2023 and paid for in cash. This is fair and just on my part eventhough I have spent several hours including having to police at my place of business.
