In late 2018, I developed cancer and decided to sell our timeshare. I contacted SMTN and agreed to (stupidly) pay their fee of $1824.00 as they confirmed they had experience selling at my location. Since then I have found this is not true. When I complained about their services they agreed to add enhanced selling for out timeshare. Did my fee not initially include that ! Then last year after further complaints they informed me they worked with an attorney who would get me out of our lease. This attorney was very busy so it would come on a first call basis and I had to respond quickly. Their charges were $5000.00 but because would reduce it by my initial fee. An obvious scam. My own timeshare location would release me for $1900.00 if I could afford it. SMTN misled me get my fees and this company should not be allowed to carry on trading this way. I would like my money returned.

      Business response

      10/06/2021

Business Response /* (1000, 5, 2021/08/07) */ SellMyTimeshareNow is a leading marketing and advertising company that offers owners an online platform designed to attract buyers and travelers and provide the best exposure for the resale of their timeshare. Mr. ********* unfortunately refuses to directly communicate with us by phone; however, we have been able to reach him by email regarding his concerns in an effort to come to a resolution directly with the client. While we regret that Mr. ********* was unhappy with his experience in dealing with a third-party attorney, the services Mr. ********* mentions are provided by other companies, which may offer a credit for fees paid to SMTN at their discretion. In looking at his advertisement, Mr. ********* has received two offers to purchase his timeshare, one as recent as 5/25/2021, but Mr. ********* has been uncooperative in providing necessary information to the real estate agent involved in the transaction. When offers are made on a timeshare advertisement, we recommend that the Buyer and Seller work through a licensed real estate agent to protect their privacy, protect the parties from fake offers, and encourage the use of a licensed title company (often with a credit towards the title company fees if they use SMTN's recommended title company). After thoroughly reviewing Mr. *********'s advertisement, history of activity and offers, and his complaint, we have provided the services promised and this owner has received offers from the advertising, and we will continue advertising his timeshare until it is sold. While we welcome the opportunity to publicly address our clients concerns through the BBB, we always recommend our clients first reach out to our Customer Care team at X-XXX-XXX-XXXX before filing a complaint as we are confident we can address our clients' concerns and ensure a positive outcome. Consumer Response /* (3000, 7, 2021/08/09) */ (The consumer indicated he/she DID NOT accept the response from the business.) Dear Sirs, The response from SMTN, handles the truth carelessly. Firstly they do not mention that they misled me by stating they had sold Timeshares at the location. They advised an initial sales of $2950.00 which since I have lowered to $500.00. Secondly they must offer proof that I received genuine offers for my Timeshare, which whilst I doubt they can, I have emails to prove I have been cooperative. On the last occasion they asked if I could contact the location to write to them confirming amenities could be used all the year round. First of all I had given my word on this and secondly if it was of genuine interest, from a person living in close enough proximity to use the amenities, why did he not visit the location to check out a two bedroom apartment and ask about the amenities ! Also they have ducked the issue about working with an attorney to help release from my lease. A convenient side step. Also I have avoided telephone contact because I am placated by what they think I want to hear, so I now prefer everything in writing. Business Response /* (4000, 9, 2021/08/20) */ We appreciate Mr. ********* responding and regret that he was unsatisfied with our previous response. SellMyTimeshareNow has been in business since 2003 and is a legitimate marketplace for timeshare resale. We do not engage in the practice of presenting false offers, as Mr. ********* is implying in his complaint. With regard to the most recent offer, which Mr. ********* references, the potential buyer asked to verify the details of the property and the ownership Mr. ********* has for sale, which is a common request as many properties will not provide information, such as maintenance fee assessments, to anyone other than the owner of the interval in question. As stated in his response, Mr. ********* placed the responsibility of confirming those details on the buyer, rather than working with the agent to provide relevant information as part of a reasonable request that would have potentially led to the sale of his interval. We remain committed to helping Mr. ********* sell his timeshare and will continue working to find him a buyer until it is sold. Consumer Response /* (4200, 11, 2021/08/23) */ (The consumer indicated he/she DID NOT accept the response from the business.) The response centres on one thing but ignores others. Firstly their response. Does it no seem strange that a person living in the locale did not want to visit the Timeshare to check out a two bedroom apartment and the amenities it provided before buying unseen ? I believe they can not demonstrate a genuine intention of purchase. They still have not answered with proof that they have sold a Timeshare at The Ponds at Foxhollow. They have still not answered why my $1864.00 did not include enhanced selling. They have not responded to the attorney they work with, who charges $5000.00 to get you freed from your lease clause. Business Response /* (4000, 15, 2021/09/03) */ We regret that Mr. ********* remains unsatisfied with our previous explanations and hope that he will reconsider talking with us by phone to help reach a resolution. We would be happy to offer a recap of the conversation in email format to ensure he is satisfied with the conversation and to provide him with an additional level of accountability. As stated previously, we will continue working with Mr. ********* until his timeshare is sold. Consumer Response /* (4200, 17, 2021/09/06) */ (The consumer indicated he/she DID NOT accept the response from the business.) Dear Sirs, Thank you for your email, but past telephone conversations result in nothing more than they think I want to hear to placate me. This can be settled easily in an email but, SMTN are reluctant to confirm anything in writing. If they are willing ( why not if they have nothing to hide ?) to do so, I will then telephone them to find a resolution. Can they confirm if they have ever sold a unit at my location. Can Bunny Taylor prove that the recent interested party is factual. Can Jenny Maldonado, please confirm the attorney she recommended charge $5000.00 to get you out of the Timeshare lease and it was on a first come first served basis ? Thank in anticipation of a suitable response to resolve this matter. Business Response /* (4000, 19, 2021/09/16) */ SellMyTimeshareNOW has provided the services that Mr. ********* purchased - his advertisement was posted on the SMTN website and buyers made inquiries and requested additional information regarding his ownership. He refused to provide the requested information claiming that if the buyer was serious, they could get that information themselves. Unfortunately, since Mr. ********* refuses to communicate with/assist potential buyers or with us via phone, we can do nothing more to resolve his concerns.

When attempting to contact them via phone, email, voice mail no response. When I initially signed up Fall 2020, I had a contact person. I am not sure what happened to him. I stopped getting responses from him Spring 2021. I need help with my ad there has been no responses to my ad that I spent $1200 because I thought this company had a good reputation. I am starting to believe they are scam. When I call the call is picked up some noise in the background then is goes immediately to music and eventually says to leave a message which no one returns. I have tried to email without a response. I did get a live person on the phone and requested a superviosr and without any word I was put into the music queue again. Is there nothing that can be done? This company should be shut down because it is a scam. There is no one acutally working there is my fear.

I made an offer to purchase a timeshare from an agent (Jason L****) from Timeshare Broker Services which is affiliated with Timeshare Closing Services on 30 March 2021. In connection with this offer I submitted a good faith deposit of $8749.00 that was to be held pending acceptance of the offer and completion of closing documentation. The agent has not been able to provide any evidence the offer was accepted before its expiry per the terms of the contract on April 2, 2021. In addition, the contract contained provisions requiring the seller to return documents necessary to the closing within 14 days of receipt. As the seller has failed to return any documentation they have defaulted which the contract also indicates permits me to request a return of my deposit. I have now made several requests to both the Agent and Timeshare Closing Services, LLC to return my good faith deposit and no action has been taken to return my deposit.
