Case Statement: Illegal Towing of Vehicle I am writing to formally contest the towing of my vehicle from my residential property in **********, **********. This action was taken without any prior notice or appropriate communication, raising significant concerns regarding the legality of the towing process. It is particularly troubling that other residents are permitted to park in the same area without facing similar repercussions, which suggests that this action may be discriminatory, especially as I am a resident just like my neighbors.1. Lack of Proper Notification:The management company failed to provide any prior notification or documentation regarding the towing of my vehicle. According to township regulations in **********, it is mandatory to issue proper notification before towing a vehicle from private property.2. The vehicle had California Plates plates; the vehicle was not registered here, and she does not live here and said she was in ********
The vehicle had a tow notice on it for 10 days and was towed on September 16, 2024 and she just noticed yesterday.
I have a call into the owner of the property to advise to discuss with their tenants.It is the resident's responsibility to comply with the rules of the association, including registering all vehicles that are kept onsite. There are tow notice signs posted throughout the community to inform everyone who enters that unauthorized vehicles will be towed at the vehicle owners expense, in compliance with NJ law.

We submitted all required registration documents in 2023, meeting every necessary requirement. However, she has opted to ignore this record due to her negligent and discriminatory behavior. I bought a house and moved into **** **** ********* which is managed by RCP Management. I was informed that the house has water damage to windows and frames due to water leaking from the siding outside the house. The upkeep of exterior sidings is responsibility of the *********/RCP Management Co They delayed the repairs of these sidings which has caused this water damage. when i emailed them to take responsibility for this, they are denying it. I raised a concern regarding a leak in my unit and they were suppose to send out the super. 2 wks went by and no one came out. followed up and I was given the information of the unit owner who caused the leak. The super will not come to my home. He has been harassing me and stalking me based on the management company advise. When i complained they attempted to have my car towed which has become an abuse of power. This management company has done nothing for the community. I have holes in my hallway. Was told by the super i needed to get my french drains repaired and that was the reason for the leak into my condo. When i hired a company to come out the company technician advised there was no french drains. The management company sent the super over to discuss with the technician and all he did was lie. When i complained to the complex about his lying they towed my car. I tried to put a complaint in with the police but they advised this is the management company doing this. I need to be able to put in service tickets without the super taking up a personal vendetta against me by having me towed on the instruction of the management company. They have orchestrated the community to police the community instead of doing the much needed work in the community.Business Response

This person is a resident in the Mill ***************************** for which RCP is engaged as a 3rd party provider for management services. Vehicle/parking restrictions are enforced equally for all residents. All residents are aware of the parking regulations and potential consequences for violations.
All common area maintenance requests are received by management, documented, and completed according to the governing documents.
The ***** holds regular open meetings and all owners are welcome to attend and express comments/concerns to the ***** of ********************

I submitted a request in September of last year to have the tree overhanging our driveway trimmed due to the significant amount of debris and bird droppings on our vehicles. The ********************************* hired RCP Management to provide services to the Association. I own a condominium in the *********************. RCP has refused to provide financial disclosures and statements to me in spite of multiple requests. The Abbington is required to provide audited financials to unit owners, but they refuse to provide me with financial statements. They make up rules and charges as they go along even though these items are not in the Master Deed. I made a capital contribution when I bought the condo and they have refused to confirm what was done with the money. They are absolutely miserable people and extremely rude. I am asking that they provide all the financial statements for the past three years and confirmation as to my escrow. I would not recommend this company to anyone.Business Response

Hello,
RCP acquired ***** Management Group in 2023 and took over day to day responsibilities for The Abbington at that time. RCP is a 3rd party property management company that supports the elected owners that comprise the ***** of ******** which govern the community. RCP does not have authority to act independently of the *****. The ***** meets regularly to conduct the Association's business and the meeting are open for all owners to attend. The 2021 audit is on the Portal. The 2022 Audit is in progress and should be finalized soon. As soon as it is complete, it will be posted to the Owner Portal and the accountant will begin work on FYE 2023.
Working Capital Contributions are 2x the monthly fee, paid by all buyers and the funds are deposited into the association's operating account.

RCP Management company is misusing power, illegally billing unit owners, forcing people into collections and committing defamation of character. Once they became our management they put charges on people accounts between 2k and 4k stating they had no support to the charges and sent you to collections to avoid having to discuss the charges.. this begins to rack up fees with a lawyer. once the case is with the lawyer they then will speak with you and had provided the charges. when i asked where did these charges come from there is no response as the previous management company never alerted me of such balance. And they did the same thing to my neighbor who was elderly. they preyed on this community. They have removed persons assigned parking spots which caused a person in another building to ask me why my number wasn't there. My character was attached for not paying alleged balances that was trumped up by their company and the property Manager ***********************. The management company has towed my friends car for being illegally parked although all cars are illegally parked and i have pictures to show it. (Harassment) I was fined for not putting garbage in the trash and when i asked where are they getting this information from there was no answer. a few days later an email went out stating they will be fining persons who dont do this. But i never leave garbage not in the trash, if my bag breaks i even pick the garbage up and put it in there unlike others. (harassment) now the latest for me (feb 28) they had my car towed. The super watched what car i went to last week and had the car towed. This is illegal. I have paid the true balance i owe and not the fake balance they put on my account from the 4k and the recent 2 fines for 500 a piece for the alleged garbage.Business Response

Hello, the complaint resides in a condominium community that is governing by a ***** of *************** RCP is engaged by the ***** to provide professional management services.
The onsite manager (******) provided the below response with regard to this complaint.
This unit owner has called me a few times to discuss their account in the past year. They are of the opinion that prior management was placing bogus charges on their account. After they stated this, I did provide them with the account histories from the last two management companies where the balance resulted. I also reviewed their past account histories and found no such discrepancies.
To address the matter of the dumping fine, a few months ago, the ***** approved a fining resolution. This new fining resolution increased fines for several different types of violations including improper dumping. The fine for improper dumping is $500 per infraction. ***************** said she did not dump improperly when I spoke to her. I informed her that we did have pictures of the dumping. More specifically, we found a big Amazon-type box with her name and address on it filled with loose garbage. ***************** was provided with these supporting pictures.
Most recently, we towed ********************* vehicle due to non-payment of association fees. ***************** was issued a tow letter in August of 2023, which stated that her vehicle would be towed after a 14 day period if no payment was received. ***************** did not register her vehicle with the association; therefore, we were unable to tow the vehicle at first as we did not know which vehicle was hers. However, ****************** stated he knew which vehicle was hers. I then asked association counsel to conduct a vehicle search to confirm that the vehicle was indeed hers. It was, and we towed the vehicle recently.
My last interaction with ***************** was last week. My ***** member, *****, who handles towing outside of business hours, contacted me to inform me that ********************* vehicle was again on site. He asked that this vehicle be towed again. I felt a little uneasy about taking such an aggressive approach. I then contacted association counsel to see if we were at liberty to tow her vehicle again in such a short time frame. Association counsel informed me to allow, " a reasonable amount of time" before towing again. I then contacted ***************** to inform her that I was specifically calling to help her. I even used these words. I told her that the ***** was advising me to tow her vehicle again, but I did not want to do that. I informed her that she could prevent this from happening again by getting on a payment plan. I told her to contact their office to setup a payment plan. She informed me that she wanted at this time to pay for the special assessment, and stated that she would be mailing a check. I have been monitoring her account on a daily basis to see if it posted yet. It has not posted yet.

I'm lodging a formal complaint against RCP Management Company, specifically my portfolio manager, Nicole G******* The company's practices are distressing and have compromised my financial security through both technical and ethical lapses. Their payment system, Gozego, is highly problematic and has prevented me from fulfilling my financial commitments, leading to an accrued charge of $8680. Despite multiple attempts to address this with the company and Nicole, my concerns have been ignored. Furthermore, RCP Management has inappropriately forwarded my personal data to a third-party agency without my consent, negatively affecting my credit standing and causing unnecessary stress. I've tried resolving these issues directly with RCP Management, only to be informed my account has been sent to collections. Their lack of willingness to address these concerns has led me to escalate this complaint. I demand the following: Immediate resolution of the ongoing technical glitches in their payment system. A detailed breakdown of the $8680 charge and an opportunity to settle this without additional penalties. A formal apology and immediate corrective action for the unauthorized data sharing. Assurance that these service and ethical lapses will not recur. Hello,
This owner has not paid the monthly maintenance fee to the Association for several months and has been notified of the past due balance on several occasions. There are several convenient payment options provided for owners including online payments and payments by check to a secure lockbox. As of today the owner still has not paid.
Due to the owner's failure to pay the fees in a timely manner, the account was turned over to the attorney for collection. The Owner may pay by check or contact the attorney to set up a payment plan if they are having financial difficulties and need to pay the balance down over a few months.
The community manager informed the owner of same in the below emails:
Good morning,
I am in no way being disrespectful. I previously replied that your account is in collections. You need to contact the Attorney for payments. Until you are released from collections you cannot pay online.

There is an alarm sounding from a utility closet outside of our Town Housr Unit, it is constant and is disruptive anytime we do work in the garage or try to enjoy a mild temperature day by opening the windows. The issue has been reported numerous times since January, to every contact I am able to find for RCP Management and the alarm is still sounding. Im frustrated that 1) an alarm sounding means something is wrong and no one is addressing it, and 2) the distraction of the constant noise.
