Thank you for your inquiry, however your details are not quite accurate. This service provided by *********** General Hosptial on 7/29/2019 was billed to your insurance carrier Met Life under claim #SLN14943M and it was your insurance who denied the claim because the policy was cancelled prior to the date of accident. This left you responsible for the $1,652.98. You then later spoke with my office on May 14th 2021 and we discussed the entire history with you at which point you asked for a reduction to the balance which we agreed to $1,322.00, if paid immediately. On May 26th when we asked if you were taking the settlement and you stated that your insurance made a mistake and the policy wasn't cancelled and they would be calling us to rectify. For the record no call was ever received. On June 30th 2021 you then stated that the other party was at fault and you wanted their insurance billed since yours was cancelled and you were advised that is not how ********** No-Fault Laws work and you then stated you could not pay the balance or the settlement.

I believe this pretty much covers the history regarding our many conversations and attempts to help you with this, We will still as a courtesy offer the settlement to you of $1,322.00 otherwise the account has been marked disputed.  ***Final comment-Validation demand letters are for the first ******************************************************* your case expired April 24, 2021. There is no requirement by law that says they must be responded to years later, and especially after numerous prior conversations. Thank you again for your inquiry.

Attempting to rent an apartment, issue with past rental and an amount reportedly owed. Paid the amount requested, but this organization will not supply a receipt for the payment. I cannot get an apartment without a receipt from this organization that the payment has been made. I've called every day since 8/10/23 and no one can produce a receipt for the payment nor explain why I have not received one, as I was initially told it would arrive via email within 48 hours. The records show you calling in on the 8th to make the payment through our website and that your release letter was sent this morning at 11:11am EST.  There is a process for posting web portal payments which is done once a week since it is not just yours but many others that have to go through a clearing house which delays the process by 72 hours.  That's the banking regulations and beyond our control.  Please check to make sure you received your letter and if any problems call my # directly ************ and I'll be happy to have it resent. Best of luck in your new place.

RE: acct ********************($603) I dispute this account. I request an itemized bill for all charges for this acct. & a copy of a completed and executed agreement, including signature pages, for the debt. This violates HIPPA law as I do not give any consent for any of my information to be released to Quality Asset Recovery, so I am unable to discuss any of the details of the invoice with them. They are in violation of several articles of the Fair Consumer Reporting Act including 15 usc 1681a(m)Credit or Insurance Transaction That Is Not Initiated by the Consumer. The term credit or insurance transaction that is not initiated by the consumer does not include the use of a consumer report by a person with which the consumer has an account or insurance policy, for purposes of(1)reviewing the account or insurance policy; or (2)COLLECTING THE ********** USC ******************* on sharing of medical information.Except for information or any communication of information disclosed as provided in section 1681b(g)(3) of this title, the exclusions in paragraph (2) shall not apply with respect to information disclosed to any person related by common ownership or affiliated by corporate control, if the information is(A)medical information;(B)an individualized list or description based on the payment transactions of the consumer for medical products or services; or (C)an aggregate list of identified consumers based on payment transactions for medical products or services.15 USC 1681E(B) Accuracy of report, since pursuant to 1006.2(g) Creditor means any person who offers or extends credit creating a debt or to whom a debt is owed. The term creditor does not, however, include any person to the extent that such person receives an assignment or transfer of a debt in default solely to facilitate collection of the debt for another. Quality Asset Recovery as the creditor on my report is inaccurate. If these items aren't removed I will be forced to take legal action.

Good morning and thank you for your inquiry.  I appreciate you going through the effort to copy the legalese terminology however HIPPA is for the protection of treatment information and has nothing do to with the financial aspects of a service.  That said we will be closing your file due to the age and small balance. Please allow at least 45 days for the bureau to update their records.  Thank you again and hope you have a nice day.

On December 5, 2022, Quality Asset Recovery received my dispute letters requesting verification of the debt they are reporting to the credit bureaus using account number ****************. I did not recall having any obligation to any creditor in the amount they claim I owe. As of today, I have not received a reply to my request for verification of the account the debt collector is reporting to ***********. In essence, the debt collector violated 392.301(a)(3) of the ***** Finance Code when they continued collection activity on an account they failed to validate after they were notified in writing within the specified 30 days. I am respectfully requesting the prompt removal of the account from my credit report. I am making every effort to resolve this matter without presenting my case before a courtroom jury in my community. I look forward to their cooperation in this matter.

Thank you for your inquiry. What the internet doesn't tell you is that the ******************************************************************* you case was February 2022, so sending a validation request 10 months later is past the required time limit. That said your balance is minimal so we will be closing it, however the provider will still consider the debt as owed.  Please allow at least 60 days for the credit bureau deletion to proceed. Have a nice day.

This illegitimate business has placed a collection on my credit report for which I am not responsible. I have always had full coverage insurance and my bill was paid in full to the doctor. *** I'm seeing where they are charging me 400 dollars for something I don't owe. When I called trying to explain that I do not owe a bill to any hospital or doctor they hung up in my face. I need this item off of my credit transunion has already agreed with me that the bill is not accurate and removal has happened now I need this company to clear my equifax and experian credit files. I have never even received a bill in the mail for this so called collections from either the company or any hospital or doctor's ****** that I've been to so how am I being put in collections for this thing I know nothing about

Thank you for your inquiry. Our company is quite legitimate and has been for 20 years. This bill for Omni Healthcare was submitted to your insurance carrier ********** in the amount of $421.94 for services on 5/27/21 and it was your insurance that applied the contracted amount of $408.94 to your deductible. You should have received your Explanation of Benefits from your carrier as a notification along with 10 billing invoices from the medical provider before they sent it to collection.  I see that you did call our office today and were given a settlement discount for $350.00 as a courtesy. The account will be sent at the end of the month with my credit report update for removal. Thank you again for inquiring however in the future please have some actual details in the future before stating wildly inaccurate accusations without actual merit.

For the past year I have been attempting to remove this delinquency from my credit report. Quality Asset Recovery, LLC claims that I owe them $913 for a collection account to which I had no knowledge of. I reached out by telephone in order to receive some information regarding this account however the representative I spoke with could not give me any straight answers and had missing and incorrect dates on file. I successfully disputed this account through TransUnion however both Equifax and Experian have yet to remove it from my credit report. I do not take ownership of this account and do not believe I am financially responsible. I would like any and all information in order to validate this account ie: itemized statements for services rendered, Dr. name and info, dates of services rendered. I also believe my HIPPA rights have been violated as it seems QAR has medical information about me to which I did NOT agree to have released. I request an original SIGNED agreement stating that I would be paying this debt and that I agreed to have my medical information released to QAR. This is in violation of FDCPA. It has been detrimental to my credit report and scores and I respectfully request it be removed. This is unacceptable.

Thank you for your inquiry. This balance for ************************** dates back to 4/2017 and the $913.60 does represent the patient responsibility left by your insurance. For further details you may contact the medical provider at ************ and reference account #******.  We will close and delete the file from your report as a courtesy while you investigate this, however you will need to allow at least 45 days for the update.  Additionally, HIPAA protects the information regarding medical treatment, not financial transactions therefore there has been no breach of your personal information and no violation has occurred. Again thank you for your inquiry.

Thank you for the inquiry. I have not been able to locate any account under this name, address or phone number. There is nothing in the details of the complaint that identifies an account number, balance due or Creditor.  Simply sending a quotation of the law without context of an account cannot be addressed.  If you would like us to investigate further please provide details of your account and we will be happy to further review for you.

I would like to formally place a complaint against Quality Asset Recovery. This company is currently reporting a collection account on my credit reports and I'm not sure what the account is about or who they're trying to collect for. This prompted me to contact them to ask for validation for the account as per the FDCPA. The account number I am referring to is *****************. I have sent letters requesting they provide validation on 10/4/2021, 11/22/2021, 1/3/2021. As of today, I have not received any information from this company. On each letter I provided my current and accurate address so there is no reason why I should have not received there response. The information I requested was: Complete payment history, the requirement of which has been established by ****** v ******* Date of Last Activity  The agreement that bears the signature of the alleged debtor wherein he agreed to pay the original creditor.  Proof of photo identification Letter of sale or assignment from the original creditor to your company Proof that this debt has not been written off as a tax liability. Any other intimate knowledge of the creation of the debt by you, the collection agency.

      Business response

      02/22/2022

Thank you for your inquiry and the additional of the legal case law.  However what you are omitting is the 30 day period under the FDCPA is when the account is placed in collection which in your case was back in November 2018 therefore sending a validation request 3 years later is past the required time to respond.  For your review, Section 809(a)(4) of the Fair Debt Collection Practices Act (FDCPA) requires that “if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion, is disputed, the debt collector will obtain verification of the debt . . . and a copy of such verification . . . will be mailed to the consumer by the debt collector.” Based on legislative history, Federal Trade Commission (FTC) interpretations, and relevant court cases, it appears that sufficient verification would include, at a minimum: an itemization of the amount due; the name and address of the current and original creditor; the name and address of the consumer; a statement addressing the dispute; and a statement that the product or service has been provided but not yet paid for.

Now, regarding the balance of $1,641.96 which is owed to ********* ******** as a remainder of your Lease with them. My office made many attempts to reach you back in 2019 and left several messages and the only actual contacts was with a female individual (it would be unfair to presume it was you but it was your cell phone that was called) who immediately hung up on my office. If you like to resolve the matter please feel free to call ***-***-**** and thank you again for your inquiry.

      Complaint: ********

Thank you for responding. Must I remind you, even AFTER 3 years, what the court truly requires is the original contract signed by a consumer addressing the collection agency to provide them a legitimate debt validation. Validation should include specific documentation from the original creditor. FTC Staff Opinion has concluded that a printout of the amount owed is not sufficient evidence. If this is all your company can provide, then you have not conducted a reasonable investigation to ensure the debt you are attempting to collect on is actually mine. SEE: FTC STAFF OPINION Validation of Medical; Debt Verification required by Section 809(b) – itemized printout; Party responsible for mailing the verification. IF you can not provide the information I am requesting, then it must be removed from my credit report. I am allowed by LAW to request this information.

That it unfortunate you feel that way as we have been responsive to each of your requests.  A PDF is a PDF, if you couldn't open it then it is not compatible to whatever operation system you are using and what operating system we are using. Sending it again will not correct that issue.  Additionally, this is a debt going back to ***************************************** addressing the issue is completely outrageous as we have responded to your emails each time which just started a few weeks ago. I personally prepared the documents and gave them to the mail department so you should have them by next week. Hopefully this will satisfy you as we will not be engaging in any additional emails as it appears attempts trying to be helpful and responsive in this forum are being unappreciated.
