    In October of 2020, my wife and I entered into a contract with Timeshare Repair Team (TRT) to cancel our Timeshare that we decided we did not want. The contract included an upfront payment of $18000 for them to work on helping us get our timeshare cancelled as well as try and get a refund for payments we had already made to the timeshare company. The contract also required that we would pay TRT 1/3 of any refund payment we received upon the cancelation of our timeshare. The contract states that the process could take up to 3 years and that there was no guarantee of cancelation. The signed contract states that after 3 years, if the timeshare was not cancelled, we could get a full refund of our upfront fees. Over the past month (starting the beginning of October), after giving TRT four years to try and get our timeshare cancelled with a refund, I requested via multiple emails and phone calls to cancel our contract and refund our upfront fee. The company has not returned any of my attempts to talk with them about this. In a review online, this seems to be a common practice of TRT.

    They guaranteed being able to get a timeshare to close my account and not owe and it has been over 3 years. In the contract with Timeshare they said if they cant resolve it in the 3 years they would refund the money paid by me to them. Every time I spoke to them they just said it takes time and that there's a process. I since have emailed them requesting my refund a few times to several employees and no one responded. I have called several times and no one answers the phone now. It goes straight to vm and they dont call back.

    On 01/19/2021 I ******* ******* signed a contractual agreement with Timeshare Repair Team to assist me in exiting my contract with ******* *** **** *********. I was going through a divorce and was no longer financially capable of maintaining the payments. In the signed contract it stated under #3 Company Guarantee. The upfront fee shall be 100 percent refundable if the customer does not receive a cancellation of it's timeshare contract(s) with the company's assistance." After not continuing to be able to pay, I began to receive letters of a future foreclosure sale due to non payment. Keep in mind in under section 5. Customer's obligations to timeshare developer. "The company does not require or encourage the customer to breach or default on any of customer's financial or other obligation to the developer or anyone else." on 12/26 I emailed the final notice of foreclosure to Timeshare Repair Team advising them that the property was sold due to non-payment ( not "with the company's assistance." as per the contract) I was then advised that since I was "out of the contract" that a refund was not due. The foreclosure/sale was due to non payment, this was not the "company's assistance, it was due to my circumstance...which was used for their gain and benefit. I am solely asking for the amount to be refunded since they did not fulfill the agreement.
