      June of 2023 LVAC hired ****************** to illicit $301 dollars from me for 2 memberships that was done by deception of LVAC employee whom claimed he needed our ID's while on the premises and to sign a waiver packet to walk around and see the gym and its features. I never agreed to join neither did my passenger that day, Yet I got billed for almost 2yrs even after calling over a dozen times, several letters telling them to stop billing my debit card which was used to buy a smoothie by **** the LVAC rep who also got our ID's when we first came in. **** also went to the smoothie bar and got the smoothie and bottle of water. I also told ********** couldn't join anyway as I have a double disability emphysema, and osteo arthritis no disk between ******** a triple hernia, 1cm T4 shift to the right and was just rear ended DEC 2019 causing more nerve pain and increased spasms. Yet they are messing up my perfect credit record of no late payment, no collections again after it was removed in JUNE 2023 credit reports. now ****************** is doing it again when I provided the letters from my bank who also investigated the LVAC claims and found them to not have any proof that I joined or authorized LVAC to auto debit or charge my card nor have any documents with my signature,

      I signed up for a gym membership in 6/22 with my fianc. I have nowpulled my credit report because the account is in collection and I have TWO ACCOUNTS on my report. Im being told I was made a guarantor for ******************************* which I 1. Was never informed of and 2. Have no idea why a 40 year old man would need a guarantor for a GYM MEMBERSHIP. I have spoken at length to both LVAC and **** at ***************** who can not verify the information and only continue to tell me if I post the balance of the account they will remove it from my credit report. They even suggested I drive down to allied and give them a copy of the contract to ensure it is correctly reporting.

      I am rejecting this response because: THAT IS NOT MY SIGNATURE! I do not sign my name like that, so Im not sure who you got to sign it but it WASNT ME and its not the signature I have on MY ORIGINAL COPY. 

      also after little research Ive learned this is a common FRAUD practice from LVAC and the amount of people who they have mislead and taken advantage if through fraud is enough to start a class action which I intend to do. I have legal counsel that are ready *** willing to take the case as well.

       

       As far as settlement you wont ever get a dime from me. I have no desire to negotiate with a company that lies to their customers and then attempts to back it up with fraudulent signatures and more lies. This isnt my first account with ********************** and I never have needed a buyer/guarantee on ANY account myself or my spouse have had here, so explain to me the reasoning behind needing it more for a grown man with his own card and money to pay. It makes zero sense and if it makes no sense its A LIE.

      Feel free to waste your time and energy trying to collect on this account. My income is federally protected from garnishments, so you can look at the balance owned and be reminded its because you have no morality in your business practices.

      LVAC has the automated payments set up in which they charge you 167%, on top of your bill, in fees plus a late fee. What is supposed to be a $15 payment turns into 45. And they will keep running your card without your knowledge until they get a payment through. And then they call you to collect the fees. So if they run your card more than once, thats 25 for each time it gets declined. This happened to me twice and refuse to let me out of the contract.

      I signed a two year contract with LVAC December 2023. I did not like the idea of signing a contract and asked a multitude of questions. I specifically asked the salesman about the cancellation consequences and he told me there would only be a $50 fee to break the contract. I was very careful and even repeated this back to him to confirm. Today, February 12th, 2024, I called in an attempt to cancel my membership. I do not want to go to this gym anymore as my ex domestic abuser goes here. For my safety and health I will not go to this gym. Unfortunately, the woman over the phone told me it would be $475 to cancel. This is ridiculous. They are currently advertising $15 month to month memberships with zero obligation and a $5 starting fee. I have no access to my online account with them and no one will respond to my emails.

      I am rejecting this response does not contain a cancellation clause outside of circumstances due to relocation. You cannot enforce a "buy-out" if it was not previously stated in the contract. I was given the impression by your sales representative that a cancellation fee per any circumstances would be $50. I have provided reasonable notice and a reasonable explanation to cancel my membership. I do not want to attend your predatory gym for my personal safety as my abuser/stalker is an active member at. He lives in my apartment complex and is constantly aware of my whereabouts. If he harasses me on your property, I am not afraid to take legal action.

      A total of 4 unauthorized charges appeared in my bank account (2 of $25 on 11/28 and 2 of $5 on 12/2/, from LVAC, within the last two months, in addition to the membership payment which is on automatic withdrawal. ($15). This is not the first time LVAC has withdrawn unauthorized charges, in addition to the monthly membership fee that is $15 each a month for my and my son's membership.

      Hi,Member number 10290305.On December 21 i was charged $10 which i didnt authorize. I don't even understand what it is. I wasn't even at the gym on the 21st. I was on the 20th, had a session with ****, didn't purchase anything.Then today on December 27 i was charged the monthly fee of $25 which is fine. But then immediately afterwards i receive an email saying i owe $80. When i open my account i see a bunch of returned payments of $25. First of all, please turn off the auto pay! I'm going through really hard times and i was just laid off work. You guys keep charging my card and keep adding those fees, nobody's going to win. Ill end up in collections and you will end up without your payments.Please waive all the returned fees and disable the auto pay. Trust me, even if I'm late ill still pay. But i can't pay monthly charges on top of all those returned payments due to auto pay attempting to charge my card non stop.This is the best i can do right now and its a win win for everyone.       Under my contract if I moved out of the area where there are no gyms I could cancel my contract with a $50 fee. I did that and informed them and they told me I would need to send a utility bill, lease or ID with new address on it. I informed them that I was living with someone temporarily so I would not have any way to get those things with my name on it. Yet I gave them my new address and they sent my bills there for the full amount I owed. Since I refused to pay because I informed them of my move and they sent personal information to my new address they sent me to collections.

      I am rejecting this response because: they did not inform me that a change of address or credit card bill would suffice otherwise I would have sent those immediately. Please ask them to pull the phone recordings where they tell me it has to either be a lease, utility bill or new ID/drivers license. No where on those calls was I given all those options that they stated in their current response.

      I signed up for a gym membership in Las Vegas at LVAC and then moved to **********. I followed the steps to cancel the member ship, showing documentation via email of my move, but they kept charging me and saying that was not sufficient to cancel, even though on their website it says to do exactly that.Then the bill went to collections on within the last few months.
