Our car was totaled so the extended warranty had **** left on it to be credited, both the bank and the warranty issuer sent us a letter saying the funds were released to Fairway and they have been playing shell games as to where the money is and keep claiming they dont have it despite me having confirmation from everyone that they do.Business Response

This complaint should be filed against TD Auto Finance as is evidenced by the documentation uploaded.
Page 1 shows where TD Auto Finance states in their dealer chargeback notice that the amount was credited to the customer.
Page 2 Shows the ************** Statement from TD Auto Finance showing that Fairway Chevrolet was given a Negative Adjustment for that amount (ChargeBack).
Pages 3 through 6 are emails that show our communication with the customer. As you will note in the last email our office Manager ******* gave phone numbers and names for the customer to call to resolve the issue.
Fairway Chevrolet has been and will be happy to help with the situation. As demonstrated Fairway Chevrolet has made multiple calls on behalf of the customer and are will to do more, but has not been provided that opportunity. This is clearly a frustrating situation for the customer, but the party (TD Auto Finance) that can resolve this is not part of this complaint.
Please contact ******************* ************, Controller for Fairway Chevrolet with any further questions.

I am rejecting this response because:
It was confirmed by both TD and Ally that the money has been issued to the dealership. This dealership has a long track record of being deceitful in its practices just read the ****** reviews.
Sincerely,

A year ago I brought my car to Fairway Chevrolet to have the transmission inspected. I approved a full teardown inspection. They found damage in the 3-4 gear area. I approved a complete overhaul and paid in full for parts and labor. Recently I had an issue with my transmission and brought it to another GMC dealership ***************. I approved a tear down inspection of my transmission. They found issues in the exact same location the 34 gear area. The mechanic noticed a part that had not been replaced in the first overhaul that should have been replaced due to the age of the car. I contacted Fairway Chevrolet and sent pics along with the mechanics notes. I was told that the part was not covered and Fairway ***** would not be responsible for the below standard work. Transmission overhaul jobs are not supposed to be required annually. In payed for this job over and should not have to pay again.-*Brookdale Chevrolet Tech notes ***************************** ************** TOW IN - CUST STATES VEHICLE WOULDN'T SHIFT INTO 4TH GEAR,RPMS RUN HIGH AT HWY SPEEDS, CUST HAD TRANS "REBUILT" ABOUT A YEAR AGO AT A ********* GM DEALER, CHECK AND ADVISE TRANSMISSION INTERNAL COMPONENT SLIPPAGE, VALVE BODY SEPARATOR PLATE PASSAGE HOLE WORN. 3-4 CLUTCHES BURNED,METAL AND MATERIAL FOUND. We are sympathetic to the consumers issues with his vehicle. However, we do not agree with his assertions as they pertain to Fairways repair. The vehicle simply would not have run approximately ****** additional miles and ************************************************ researching Carfax history on this vehicle we have an opinion as to what is the likely situation for the transmission failure. On 10/7/2022 it shows a radiator was replaced by ******* ******** with ****** miles showing on the vehicle. An additional service was completed on 10/17/22 by *******. The second service was to change the fluid in the transmission. Of concern to us is why the transmission was flushed. Service interval for the transmission on this vehicle is recommended every ****** miles so it wouldn't need to be replaced for another ****** miles driven. Unless, the internal transmission cooler which is internal to the radiator was leaking and allowed coolant into the transmission. This would explain the current failure of the check ball, and would explain Meineke flushing the transmission. On 10/17/22 Carfax shows the consumer took the vehicle to *********************** Chevrolet to diagnose his transmission failure. When we spoke to *********************** Chevrolet's service manager he did not mention the previous Meineke work, so we assume he was unaware of the Radiator replacement and subsequent transmission flush.
Fairway Chevrolet is unable to assist or issue a refund for this transaction as requested by the consumer. We have acted in good faith and we conducted our repair properly. We do not have the vehicle, and have not worked on the vehicle in over 18 months.

Date of transaction: 6/24/2022 Amount $5,757.53 check #*** - I have put a stop payment of the check (***) which my lawyer said I should do. Invoice # ****** We took our ********* ******* motorhome into Fairway to have the engine and transmission looked at. We recently purchased the RV and the RV had sat unused for more than a year. We asked that the dealership look at and do the following: transmission flush, oil change, tune-up, fuel line and any thing else that they saw that needed fixing. Erik, the service advisor, said they found the rear axle leaking and that the seals need to be replaced. Erik also said that the brake pads needed to be replaced. None of this was done. When we took it home on Friday, June 24, 2022 and parked it in our storage space and turned off the engine, the radiator started spitting out fluid. We then called a mobile mechanic. Mobile mechanic is **************************, Greakly W******* ************. We told him everything that the Fairway said they did. Greakly noticed right away that the rear axle was leaking. And that the transmission fluid had not been changed. As the fluid would have been a bright red color and it is brown. He also said that there was no way Fariway replaced the break pads. He could see that the tires had not been removed. I have tried calling the general manager, Terry H*********, at Fairway more than once. I have left messages. He has not returned my calls. At this point I believe that Fairway did do two things on the invoice. The oil change and the fuel line/pump. I am willing to pay for something. But with all that I have gone through, I feel Fairway should not charge me.
