      I received an email from "Adrian" at Rushmore Press in December 2020. He gave the "growing business designed to help new authors spill" I agreed to republish under them. And as time went by they submitted to ****************. FROM RUSHMORE: Good news, ******* has accepted our submission for your book and they would like to offer us a 7yrs exclusive contract. They wanted to know if you can narrate the audio book in a studio setting or if you know an actor that can do the narration for us. ( Not True: ******* confirmed that this conversation never took place). We have some contacts that were recommended by *******. So, if you don't have one, I highly recommend we go with something of proven quality because we can't afford to miss out on this opportunity. We can only do this once because first impressions last." (NEVER TRUE ******* never recommends anyone nor imposes a timeline. Books can be submitted multiple times until standards are met). The ISBN and book didn't exist yet.

      Business Response /* (1000, 5, 2021/07/29) */ Hi ****, We understand the misunderstanding between the ******* contract that was discussed with you by Daryl. This case was highly noted by our management. We understand as well that you have been given an option to provide your own narrator for ******* submission and the QA guidelines was provided to you as well. The decision to go with our preferred narrator was merely suggested for better submission request but you were given the option to have the final say. The ******* project was never sealed and the original contract of agreement for publishing was never voided and in continuance. It would be unfair for you to request a refund for the publishing contract when majority of the work was already approved and we are almost done with the publication process. We are as matter of fact just waiting for your approval on the interior layout. We recommend that you view the terms and agreement of your publishing contract for better understanding. This is not at all acceptable.And for your dishonesty, you will own this, which I will certainly post on every social media platform. I agreed to republish under them at a one-time specific fee for the promised advertising, not promised sales. Nothing is guaranteed. As months pressed on, I originally sent them the wrong manuscript, and had to re-proof to resend. The final manuscript was sent about three weeks ago on July 8, 2021. On July 9, 2021, Daryl from Rushmore sent me an email stating that he was my publication manager and that: "I will be the direct contact of your assigned literary agent and together we will guide you thru the entire process of our 1 year advertisement program." A few days later he called to ask if I was ok with Rushmore Press submitting the book to Amazon's *******. I said it would be fine. Then I received this from Daryl: "Good day and I hope all is well. Good news, ******* has accepted our submission for your book and they would like to offer us a 7yrs exclusive contract. They wanted to know if you can narrate the audio book in a studio setting or if you know an actor that can do the narration for us. Not True: ******* confirmed that this conversation never took place. Also, they list narrators, not actors. We have some contacts that were recommended by ******* . So, if you don't have one, I highly recommend we go with something of proven quality because we can't afford to miss out on this opportunity. We can only do this once because first impressions last." NEVER TRUE ******* has a list, but recommends no one, ever. I told him that I didn't know of anyone to narrate. He then replied a couple of days later with a sample Narration from an 'Actor' named only, "Bill" Before he sent me the sample file, I had acquired a desired narrator, who is not a professional, but has a tremendous speaking voice. Daryl, however insisted that: This seems to be a very risky thing to do knowing all of these details. First off, we need to be really confident that the person doing the narration can really deliver under strict compliance of *******. True: ******* has strict high standards. These are the QA requirements for *******. (insert ******* QA requirements) As your publication manager, I would prefer that we go with someone who has a proven credential and track record. Given your situation, it seems that you need to do the initial investment just to have your guy build a studio and purchase a computer that we are not even sure yet if it can deliver within the ACX standard. True: no one is ever sure Your option seems risky with no given guarantee that we can deliver within the standard and timeline that ******* is giving us. NOT TRUE: ******* never imposes a timeline. Books can be submitted multiple times until standards are met. I just want to make sure that we do not lose this opportunity by taking a risk with someone who is inexperienced and does not have a ready set up yet. NOT TRUE: this was a high-pressure tactic to coax me into accepting "Bill", the actor/narrator at half his fee of $5.900. Oh yes, ******* had never heard of "Bill" I prefer experience and credibility if I am to choose for your best interests. But then again I will leave it up to you to make the final decision. Daryl had, over telephone conversation, told me that ******* only accepts published books. Which is true, however, an ebook is also a published book. Since Rushmore had not yet published mine, there was no ISBN to submit yet. When I asked about where we were with my publication, Daryl abruptly dropped the pressure sale for "Bill" with a promise to get back with me in three days.) The work performed is not $2600.00 dollars worth. There will not be any advertising because I will not Allow Rushmore Press to publish any of my writings. I demand a refund due to Rushmore Press's dishonesty. Since Rushmore has given such a dishonest reply, I feel the burden to make sure authors are aware of such business practices. I'll pass on my concerns to the editors at *************. *************, and every news agency across the globe. We made our investigation and Daryl simply delivered to you the audiobook opportunity within the extent of his knowledge and understanding. However on the legality point of view. No consumer right has been violated. No money was solicited from you by force. Disagreeing with the audiobook proposal does not imposed any violation on your publishing contract. If you wish to void the publishing contract. We will respect that as part of the agreement is you retain all rights to your book. We would like to remind you though of your signed contract in where you agreed to the refund policy. Services were already delivered and we are beyond the refund timeline. If you feel that you have consumer rights that was violated, we advise that you consult a legal advisor to guide you. Surely, a man of your status knows that social media justice does not impose anything. If it will satisfy you to discredit Rushmore Press online,we cannot stop you from doing it. Rest assured that our legal counsel will look into protecting the company from any libelous attempt and make sure that any lines crossed will have legal consequences. Rest assured that Rushmore Press business practice has always abided in accordance to the fair trade and policy law. By the way, Better Business Bureau is a private independent platform to solicit accredition fees from US Business owners. This is not a legal platform for consumer mediation.
