    I own a unit in ****************************************************************. There was a leak from my unit to the unit below.In August 2022, Building Super communicated that the leak is from a faulty shower pan in my bathroom. It required breaking the floor of the bathroom and placing a new shower pan and piping. Plumber ********** from ** Plumbing Heating and Cooling Corp visited to check the leak and determined by just visually seeing that his expert assessment is the leak is from the shower pan of my unit. As shower pan replacement is expensive and time consuming, I contracted ** Plumbing and asked them to conduct tests and diagnose the root cause of the leak. ** Plumbing refused to give any estimated cost of the leak diagnosis prior to actual scheduled diagnosis. ** Plumbing then informed that tests have been conducted. Everything else is good and shower pan needs to be replaced for the leak, which led me to rely on their assessment and replace it on 25th Aug 2022. However, in the invoice that they sent over for testing - ** has not provided any evidence, no flood tests were performed and there are no details of tests conducted. There is no evidence from ** Plumbing that the shower pan was leaking. ** Plumbing showed wilful misconduct and breached its duty by not conducting any leak diagnosis tests when contracted to do so and then stating that tests have been conducted. The actual cause of the leak: pipe leak was discovered after shower pan was replaced on 25th Aug 2022. There was a pre-existing nail in the pipe causing the leak. On discovery, ** Plumbing did not inform ** about the pipe leak as their misdiagnosis came to light, inspite of being contracted by me and I was regularly in touch with ** Plumbing. They instead reached out to building super and management for approval. They concealed it from me and informed me only after fixing it.Due to their misdiagnosed shower pan replacement, I am left with a damaged bathroom with the mosaic floor and tiles broken

    There are 3 invoices:

    Invoice 1 previously submitted with complaint: Attachment name 2022_TestingBill.pdf for $1502.48. See attached email which clearly states we (me and my wife -co-owners) requested the testing. see attachment of yahoo mail   from Pride states " Plumbers are coming tomorrow (Thurs) around 9 AM to run tests on your shower body and shower pan. He said you requested the test." We fixed up with NY Plumbing to do leak diagnosis and building management Pride only coordinated for access to unit below

    Invoice 2 previously submitted with complaint: Attachment name *** ** signed propoasl.pdf for $4077.36 ($3,745+taxes).  Post NY Plumbing's leak diagnosis and shower pan replacement, I contracted with NY Plumbing for shower pan replacement which was done on 25th Aug, 2022.

    Invoice 3 previously submitted with complaint: Attachment Name:  ************************************** This is for Pipe leak $3019.53. I had contracted NY Plumbing for shower pan replacement and was regularly in touch over phone with NY Plumbing when they were working in my unit on 25th August 2022. However, when leak did not stop even after shower pan replacement and NY plumbing discovered that leak was from pipe, they did not inform me. They intentionally bypassed me, took approval from super and building management. Only after the pipe leak was fixed, NY Plumbing sent me the following message. I then got back to NY Plumbing about their mis-diagnosis asking them why they did not inform me, when I had contracted them, I was in touch and I had requested updates. Why did NY Plumbing not tell me the facts when discovered. Then NY Plumbing after 3 months in December, billed ******************** fully knowing that the invoice is disputed and ******************* can force members to pay.NY Plumbing dues were added to my maintenance bill from the Building  and I was forced me to pay.  

    Please see message from ********** of NY Plumbing, after fixing the pipe leak on 25th Aug, 2022,which clearly shows that NY Plumbing did not inform me when pipe leak was discovered and only informed after fixing it on 25th August, 2022. ********** from NY Plumbing wrote to me as follows

    Good evening to everyone after completion on our scope of work today 8/25/2022 my plumbing technician tested his work which was all good on testing the temporary plastic drapes so the tenant can temporarily use the shower he noticed the water was dripping from the top rain shower head area this was immediately sent to the super attention who then notified his manager and got the approval to fix what was leaking, to fix the lead we had to open 2 spot in the shower area to make the necessary repair. The leak was from a s**** in the overhead rain piping below is some pictures.
