Scott Daniels was contracted by my mother (who has dementia) on 1/7/23 to provide auction services for my parent's estate. The contract states that we would be paid approx. 45 business days after auction close, with a full accounting thereof. The highest yielding auction was held 3/11/23 and we have not been paid a dime (~ $10,000). The auction consisted of my dad's vast ****************** collection.I've had multiple ************** over the past 8 months trying to resolve payment and return of unsold property, only to receive multiple excuses and extensive delays. Much was due to Scott's extremely disorganized accounting practices. I questioned him on the accounting of many items & the response was always that he would have to look into it. He strung me along for months.When he sent me the adjusted 3/11/23 End of Auction report, I signed it on 5/22/23 with corrections, & said I would pick up the check and remaining items on 5/27/23. That day, he made an excuse that he didn't have a check because he said he still had items being returned & *** non-deliverable issues. This was a breach of contract. On 6/2/23, I emailed a list of outstanding items for pick up or payment. On 6/8, I told him I did not want the list to hold up payment from the 3/11 auction. On 6/15, he emailed that he would send the final accounting, checks, and returned items within the next 2 weeks. This didn't happen.After MANY emails, I finally received a check for $11k on 11/30/23, post-dated for 12/26. On 12/26, I received a letter stating he put a Stop Payment on the check because he says I disputed the funds. I merely asked for the accounting of how he came up with the amount on the check.Throughout the entire course of business, there has been unorganized accounting of the items taken from my parent's house, there has been a multitude of promises made yet undelivered, and there has been very skeptical business practices, specifically not identifying items sold or in his possession until asked.
