      F&D Construction did a complete tear off of my roof. I have had persistent problems with intermittent leaking. I have a mansard roof with dormer windows, which I learned through this experience is considered a "complicated" roof. F&D provided a 10 year workmanship warranty and a 30 year shingles warranty. Since they installed the roof, I have had numerous issues that they merely triage or refuse to address. For starters, the day after the roof was installed, luckily it rained, and I noticed that water was pouring into my house because the roofers failed to replace rotted plywood around my dormer windows. They also failed to medal wrap sections of my mansard roof which eventually attracted a woodpecker. In addition, the roofers failed to replace the plumbing vent on top of my roof. After much debate, F&D came back out and explained that the medal wrap was never part of the statement of work and charge me an additional $600 to cover the exposed wood to resolve my woodpecker issue. The owner, Brian, and I had several conversations regarding the leaking; he attempted to remedy the issues by only tearing off and replacing a section of the mansard roof that meets the dormers. To this day, I continue to have issues with water leaking through my dormer windows. And to add insult to injury, now my shingles are covered with mold. I have called F&D numerous times, and IF they're responsive, they merely triage the problem. They've had their workers come out take pictures and reattached broken shingles. Regarding the excessive mold, they claimed that they needed to talk their "shingle rep" to see if the shingles can be replaced. And they are outright refusing to address the leaking issues by refusing to call me back to discuss the matter. All of their field workers claim to have recommended that the roof be completely replaced, but the owner (Brian) is refusing to take responsibility for the poor workmanship by honoring his company's 10 year warranty.

      This letter is in response to above named customer complaint.  Ms. ******** enter into an agreement with F&D Construction on 8/20/18 to do a roof tear off and wrap 4 front windows with metal. At the time of the contract, I was not the owner of F&D Construction at that time but in good faith I did continue the 10- year warranty that was provided by the past owner.  Ms. ******** did reach out to us regarding a leak at one of the front windows. My estimator and I went out and after looking at it, it was deemed that the window and storm window itself was bad and the interior was all- ready damaged from the existing roof and the bad window. We have never been notified of and I quote Ms. ******** “water pouring in my house”. Ms. ******** agreed to it and asked us for a price to replace all 4 front windows.  After presenting her the price she decided to hire someone else to provide and install new windows along with new metal wrapping. At this point 4 years went by and didn’t hear anything from Ms. ********. Regarding Ms. ******** statement about the woodpecker. She approached us about the existing exposed hole and that a woodpecker was getting in there. We did give her a price of $600 to wrap the fascia board and she agreed to that as that was never part of the project as stated early the project was for a roof tear off and metal around 4 front windows, (No soffit, fascia or gutters were included in this project) Roof was done in 2018 and the woodpecker call came in approximately year and a half later. Also Ms. ******** claims in her complaint that the roofers failed to replace the rotted wood around the dormer windows. Please see attached photo that was sent from Ms. ******** stated that the wood was replaced around the dormer.  Also, my shingle rep has been made aware of the algae (Not Mold) on some of the shingles. When he is in town next, he is going to stop at the above address and inspect it. That warranty is not generated though F&D but through the shingle mfg. itself. We have always been responsive to Ms. ******** and always had someone out there that same day depending on the time or the next day. I also sent someone out there to break up ice (No charge) from our last snowstorm that was created from heat loss at the property. Sincerely, Brian President

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. Upon signing the original contract, I was not made aware that the business was in the process of changing hands. Also, the current owner (Brian) maintained the business name, online reputation, field employees, and overall business branding and image - this is also evident on their current website, which states they’ve been in business since 1979, although Brian took over the business during 2018. It wasn’t until I started having problems with their workmanship that I was informed of the new ownership. However, from day one of the project, Brian requested payment of the roof, presented himself as the owner, and made decisions regarding which (if any) repairs would be addressed.  Brian reassured me that my warranty would be honored.  Unfortunately, this turned out to be untrue. Regarding the owner’s response to my first contact regarding the window leak. I have screen shots of text messages and pictures regarding the leaks. The roof was installed on 11/8/18. On 11/9/18, one day after the roof install, I texted Darryl (the field estimator), regarding a leak and I sent pictures.  Shortly after, Darryl came out and acknowledged that the new shingles were put over rotted window decking, which was the cause of the leak.  The rotted decking was NEVER brought to my attention during the roof installation. In an attempt to remedy the issue, the company removed a portion of the shingles around the mansard, replaced the decking around the dormer windows, and reinstalled the shingles on the mansard section - they charged me an additional $2,460 to replace the window decking. They also had to address the chimney boot that they failed to replace during the original roof installation. Since the installation of the roof and the dormer window decking, I have been experiencing issues with leaks.  The incident that the owner responded to - “My estimator and I went out and after looking at it, it was deemed that the window and storm window itself was bad and the interior was all- ready damaged from the existing roof and the bad window.”  - this leak happened AFTER the company installed the new roof, dormer decking, and dormer wrap. If the roof was “bad”, it was because F&D installed a bad roof.  However, the owner refused to take responsibility and blamed the issue on the windows.  The owner and I briefly discussed his company replacing the windows; however, I wanted to get more opinions and estimates before doing so. After discussing the issue with numerous window and roofing companies, I learned that the leak was coming from the dormer roof and the dormer decking which were all installed by F&D and supposedly warranted.  Roofers explained that the transitions from the top of the roof to the dormer roofs were installed incorrectly by F&D, which was causing water to pool on top of the window dormer.  I also learned that the dormer deckings were flashed incorrectly, so water was getting behind the flashing and ultimately leaking into the house. When I brought this to Brian’s attention, he explained that he did not believe me. I even asked if he would come out and tear off the wrap around the dormers and do a thorough inspection of the decking and IF he discovered that it was in fact the windows, I would pay for the project.  He adamantly refused my proposal and told me to sue him.  He also reminded me that he was not the owner at the time of the roof replacement, so therefore, he did not have to honor the warranty.  However, at the time of the dormer decking installation, when I paid an additional $2,450, he was still presenting himself as the owner. Regarding the woodpecker, Brian stated - “She approached us about the existing exposed hole and that a woodpecker was getting in there.” - I informed Brian that the shingles did not cover my entire roof; and I only learned that after a woodpecker started pecking on my house.  I sent pictures and Brian explained that the bottom section of the roof is not “part of the roof” and was not included in the original roof estimate.  Despite providing pictures showing the wood between where the shingles stop and the gutters begin, he refused to consider that section part of the roof and charged me an additional $600 to put metal flashing around that section of my “not roof”.  Regarding the algae around shingles, Brian nor the estimator provided a timeframe as to when this issue would be addressed and how it would be handled.  Since our last communication regarding this issue, I had another leak around the window dormer that was replaced by F&D. I reached out to Darryl with pictures, and he had field workers come and remove ice from around my dormers.  The field representatives also acknowledged that the roof should be replaced; however, they are not the decision makers.  They removed the ice, took pictures, and explained that Darryl and Brain will reach out to me to discuss a remedy.  Shortly after the ice removal, I reached out to Darryl and he said he would be in touch but he never contacted me again.  It was at that point when I decided to initiate a complaint with BBB to get a response and put consumers on notice. Lastly, while anticipating Brian’s continued reluctance to do the right thing, I got curious about ALL aspects of my experience with F&D.  I requested a copy of my permit from the company, and they failed to respond and provide a copy.  I later learned from my township that they NEVER pulled a permit for the work they performed on my house - despite one being required. Also, upon reviewing my records, I need to update the amount that I paid the company.  I paid them a total of $13,600 for work that is currently in dispute. This is by far the WORST experience I’ve had with a contractor!  Regards,  ********* ******** * ********

      In response to Ms. ******** last response- pre-exisitng damage is not covered under any warranty. There are 4 dormers on the front of the residence and only 1 had a leek. Which in turn was deemed the window was bad. Also F&D cannot be held responsible for the work done by the window company and another roofer that Ms. ******** hired from the Lancaster area to do work. Ms. ******** can contact the Town of Amherst for a copy of the permit that was filed for her job. Also I would like to state that in no time did I say she can sue me. We have been in contact with her every time she had called/texted. No further work on F&D part is warranted. I will follow up with the shingle rep to see when he will be in town and planning on going there to look at the algae that is present on a few shingles. Sincerely, Brian
