We just learned that the vehicle we purchased from KDK was sold to us with the wrong sized tires (tires are too small for the vehicle). We learned this only because the ABS, 4WD and other warning lights came on to indicate there was a problem after we put the spare (correct sized tire) onto the vehicle… The warning lights came on, the car pulls to the right and there is a thumping/grinding noise when we drove the car. We called KDK and they were defensive saying they bought the car from an auction and don’t check tires (they were brand new when we bought the car and cannot know whether it was sold to them that way or if they put the wrong sized tires on it before we purchased it). We asked them to look at it and assess the damage and he hung up on us. We’ve spoke to ******* tire and ******’s and both said that the tires never should have been put on this car as it could cause damage and one indicated that it is unlawful and both said it is unsafe to drive the vehicle with tires that are too small. A quick google search indicates: If you were in an accident that could have resulted because of tires in the wrong size, the seller could be liable. Selling vehicles with incorrect tire sizes is a form of negligence that puts your safety and your life at risk.Business response

Good day, When speaking to who I presume is Mr. ********** about the tire size issue of the Vehicle purchased on Sept. 23 2022 it was explained that the vehicle was sold AS IS and that our inspection does not check for tire size when we do not replace tires. at that time Mr. ********** continued to talk over me and threatened negative reviews and a BBB Complaint. We do not respond to threats and will always end the conversation at that point by simply saying goodbye and ending the conversation. Just to revisit The vehicle was Purchase AS IS in September of 2022. 18 months ago!

I am rejecting this response because:
“As is” applies to any unknown issues that may arise. It is the responsibility of a dealership to make sure the vehicles they are selling are safe.
I have now talked to the Infiniti dealership in *****, ****. They have backed up both ******’s and ******* stating any tire on the vehicle not the recommended size, will cause issues, can lead to damage and is a safety concern. They, being a reputable dealership will not see a vehicle without making sure the tires pass inspection, which includes making sure they’re the correct tire size.I have also called the **** Attorney General’s Office, which referenced me to the National Highway Traffic Safety Administration.
Talking with NHTSA, case reference #*******, they have also advised that those tires should not be on the SUV for safety reasons.My understanding of ****’s law is that a dealership must disclose any safety issues. Specifically unsafe tires. This was an “obvious” safety issue as the correct tire size is in the manual as wheel as the driver side door.
***** said, they only check for tread.We took the word of the dealership that the SUV was safe and had newer tires. It is not the responsibility of the consumer to make sure the tires are the recommended size.

According to the Uniform Commerical Code which **** has adopted, an Implied Warranty of Merchantability means that a sold item must be fit for the ordinary purposes for which such items are used. Selling a vehicle with incorrect tire sizes would breach this implied warranty if it renders the vehicle unsafe or unfit for normal use.Initial Complaint

I purchased an extended warranty in December of 2022, traded the truck in on October 2023, after many attempts was finally able to get (KDK) to send me the cancellation form for the warranty, the warranty company cancelled the warrant on 10/27/2023. In December I called KDK to see why I hadn't received my money back after confirming with warranty Company that it had been cancelled and the KDK Mitsubishi would issue me the check, talked to the finance manager and he said he had my check, but needed proof of the loan being paid off, even though I had all ready sent in the paperwork from the dealership with the trade in , he said he would hold it for 3 days then mail it to my original finance company, so I contacted Associated Bank to send him the proof, since they were the original finance company, they said they would send me it if they got it. Well after not hearing anything I contacted the bank again last week, they said they sent KDK the information that it was paid in full, but KDK never sent them the refund either. So I tried contacting the Finance Manager since I kept his texts and he said he no longer works there and to contact KDK, which I have tried and cannot get through or the phone hangs up, I even tried using someone else's phone in case they blocked me. I only had the truck and warranty a few months and would like my money that is owed to me. I am attaching the Warranty info (I also talked to them again and they said KDK is responsible to issue me the money) I am also attaching the email thread. Warranty # *********** ****. I am at a point where I believe they stole my money.Customer response

On 11/07/2022, I walked into this dealership with intent of buying a vehicle. During the closing of the sale, I opted in for an extended warranty. Within the past year, I have contacted the dealership multiple times to seek how to go about filing a warranty claim. After speaking with the finance manager, I was told I would receive an email, which has not arrived to this date. I feel that the dealership has not been transparent about the services of which have been sold to me.Business response

I purchase used vehicle from KDK Mitsubishi on Dec 26/2023 I bought vehicle service contract for 2209.00 I found out it already had a extended warranty from previous owner that was transferable. I went back to dealer and sign from to canceled service contract and they said it would take 30 days and it went pass that and more, Went back many times and got nowhere with them called American Auto Guardian Inc. they give me the date that the contract was canceled on 5/19/2023 and the canceled # T1037402. Went back to dealer and they said it will be credited to my auto loan account, have called GM Financial and it has never been done. Good Afternoon, It has been brought to my attention that this warranty was cancelled on 05/10/2023 and a check was mailed to AmeriCredit on on Mr. *******s behalf, upon further inspection into this complaint it was discovered the check was not cashed.. we have cancelled the original check and as of 12/12/2023 a new check was issued and mailed to AmeriCredit and should post with in the next week. the finance department did try to reach out to Mr ****** once we discovered this was an issue but have been unable to reach hi. Yes, I purchase a 2018 Ford fusion with KDK Mitsubishi picked it out ordered everything online was texting the young gentleman. It was delivered by one of their employees at night so we didn’t really get to see it really good over the next few following days we started noticing little things there was a slow leak in one of the tires we were told at all four tires were brand new, and when we took it to a local tire shop, they informed us they were not new, and that there was an old very old can of fix flat that have been put in the tire and then we took it to a mechanic shop to have it looked at and were told that the rear differential was bad and now all four of the axles have to be replaced as well as the car having a severe alignment issue. We were told that it was aligned and it has not been aligned. And now we have to pay almost $4000 to have this car fixed. We have had it almost a month have not even made our first car payment and this car is not drivable because it is not safe to drive. Also the brakes are worn out the brakes are nearly worn. If all these issues were fixed, it would make a great car, and it breaks our heart because we really were set on this car and feel like we were taken advantage of because the sales people said that it was good to go and clearly it was not.Business response

I purchased a 2015 Chevrolet Tahoe on September 14, 2023. The purchase was done online because I reside in a different state. in the beginning the transaction was seamless because everything was done via email/text message. If I had any questions they were answered promptly. I was sent pictures of my vehicle and not once was I told or did i see that there were multiple sensors that were not working properly. My truck was delivered on September 15. I was under the assumption that it will be delivered via tow truck, but that was not the case. My vehicle was driven from Ohio to Michigan. When I received my vehicle. I noticed I had a crack on my windshield, which was not there from the initial pictures that were sent to me, and I also have some sensors that were not working. I texted my sales rep to advise him of what was going on and he stated he would get the situation taken care of. my last exchange with my sales rep was on September 21, 2023 where he exclaimed to me that he would put a service request in and have a response to me by the morning. I have not heard from anyone at this establishment in over six weeks. what started off as a simple crack has now spread from one side of my windshield to the other. I understand my vehicle was purchased as is, but during the transportation, my vehicle was damaged , all I’m looking for is the replacement of my windshield and for my sensors to be fixed. because that is what was told would happen from the business.Business response

I previously attached a screenshot from the dealer which shows my case should've been escalated to management. I understand the car was purchased as is but the damage was done after signing and was done during transport. If nothing coudve been done, the rep should’ve stayed that instead of having me wait for a response from upper management

I bought a 2015 Buick Encore June 13th 2023 from KDK Mitsubishi. Everything was done online/over the phone and the vehicle was delivered to me by employees with the company. The car had temporary plates on it, it is now August 9th, 2023 and I have yet to receive the title to be able to get this vehicle registered. I called them 2 weeks ago on 7/28/2023 to check on this, and they advised they hadn’t received my down payment yet which is why the title wasn’t sent out yet. I paid it that day, and the representative, *****, advised he would see if they could send the title via overnight shipping. I then stopped getting any correspondence. I called, left messages, and sent texts with absolutely no return calls. It was only when I threatened to file a complaint did ***** text me. He advised the title was sent out June 27th and I must have lost it in the mail. This is impossible because I never received it in the mail, and when I spoke with him on 7/28/2023 he confirmed the title was not sent out yet. He sent photos of the title (which, if it was already sent out how would he have photos?) and suggested I take the photos to the department of motor vehicles to try to get it registered. Photocopies of the title are not accepted at any DMV. I am requesting KDK Mitsubishi to fix this issue as soon as possible as I never received the title and cannot get it registered until I have the title!Business response

This vehicle was titled in June and was mailed out on the date mentioned in the complaint. It is very possible to have gotten lost in the mail, I do have a call into the client to make sure we have the correct address if she has not received the memorandum titleCustomer response

I am rejecting this response because: I did receive the title, FINALLY, on 8/11/2023. This title was absolutely NOT sent out in June. Per the photo I attached, the envelope is dated 8/2/2023 by the post office in ********** **. This would mean the title was only sent out after I called. The lying is why I am not satisfied with this response. Please do better next time for your clients as this was an extremely unpleasant and stressful experience.

I purchased a ****** Avalon in January. I was told I needed to put down another $2,000 to get the payment where I needed, so we put $4,000.00 down expecting the payment to drop. We found that they added a car warranty and used the additional $2,000.00 to pay for it, and my payment did not go lower. We immediately called and requested they cancel the warranty and refund the $2,000.00. We were told that they had to apply the $2,000.00 to the loan instead. We were told it takes 6-8 weeks to process. It has been 20 weeks since we made the request. Now the finance manager that did this is no longer with the *** and it is being pushed out longer. I feel they took advantage of me because I am a woman and a senior citizen. This is wrong.Business response

Purchased a 2018 **** Ecosport from KDK on October 15, 2022. Kept asking what the loan would be and was told about warranties with no figure amounts. 3 hrs have passed and I am signing my retail agreement on an iPad. Never saw the amounts till going home. He flew so fast with this. Called him that night that I did not want all these warranties. He said come in Monday, the 17th to cancel all three of them and that it would take a little over two months to go through. Waited and called in December and January and was promised they were sent in which they were NOT. I never was so disappointed when writing to AAGI in February that the documents were never sent. So I sent them copies of them. A week or so after, I was told I would receive the $2,595.00 and it would be sent to KDK. I waited and never received a call from KDK about the check. I called the billing department and they sent the check right away. But when it came to the other two at $695.00 each, I found out they were uncancelled warranties and invalid forms and was not refunded the amounts. I feel I should have been informed of this on the day of signing as it was Never mentioned and witness by several people. In the past six months I was being taken advantage of and very disappointed with this dealership as I have many times to get this rectified. This was no fault of my own, but definitely an inconvenience. The person handling was the finance manager, **, rather saying his name, I posted his initials.I dont want this to anyone else. They did forget to mention to me that ice built in on my inside windshield due to the repair job on passengers side. Of course left a message with **** with no return call back. If all of this could been handle right away, there would be no problems. No customer service at all. They know about reporting to BBB about this matter and did not care to rectify this matter. I believe I am owed $1,380.00. Misinformed 2 days after buying the car. Pls. Help. Thx u.Business response

I paid $29,000 for a car that had no warranty. The car has not been able to pass emissions. And was tuned prior to me purchasing. The car is also modified before I purchased and they have been working on it but come this Wednesday the car will have been there for 3 weeks with no resolution or even idea. They have told me to do numerous things that I have done with there being no help to doing those things. The car also has had issues with chugging when started. And the city of ********* has many complaints and even my father had an issue. I think they have knowledge on what’s wrong with the cars before they sell and choose not to fix them. Their general manager “**” is very rude when trying to ask for solutions. And as a result I have now lost my job to no transportation and am going into debt with this matter that should have never been a issue. I think them to be a dealer of cars is not right and be revoked. I have also spent $750 plus of my own money to fix this issue which is also another reason to being in debt. I understand that there was no warranty other than “Powertrain promise” but I was not even made aware of any underlying issues. I hope you can take action and help the city of ********* with their unjust business.Business response

I am rejecting this response because: of the fact yes it said “as is” with no warranty but one of the documents says a return policy within “x” amount of days on the agreement I had never been shown when we were going through paperwork. I’m glad that they are working to fix it but this doesn’t change the fact I have spent $850 on a $30,000 car and in result in serious financial debt due to losing my job over the car not being road legal. This car was not even accepted as an exempt to give me time to fix this with the dealer. I understand the issue with the car you can’t necessarily see within pre-inspections but this is a major issue for such a high value car. And when I bought the vehicle I never was made aware of anything and was expecting it to at least be able to be registered at the *** so I could drive it in the road. Sure now we’re at the point where hopefully the car will be fixed but this whole situation is unjust, especially for such a high “accredited” business. I’m also glad the city of ********* is realizing more and more that they are not trustworthy. I can have more than 20 people attest for their bad used cars being way over priced, with a ton of problems. Now if it was just my car and here and there cars had problems I wouldn’t have been so frustrated but the fact I have seen many many people with picture evidence of serious damage and issues with the used vehicles they are selling is outrageous and should be looked into because it can’t be a coincidence.
