I am writing to formally request a refund of the $225 administration and application fees paid for leasing an apartment at ***** ********** ***** * ****** *** ******** ** ***** ***************************************. Details: Application Submission: Submitted on 6/21/2024 Intended move-in date: 7/21/2024 Delays and Issues: Application not processed for two weeks due to management transition. New management started processing after two weeks and began employment verification. Verification process ongoing for an additional week, as of 7/27/2024, still incomplete. Lease start date (7/21/2024) missed due to delays. Move-out date from current apartment approaching, forcing me to find another apartment. Additional Concerns: Move-in date manually changed from 7/21/2024 to 7/26/2024 without informing me. (attached) Application rejected after I requested a refund. (attached) Leasing officer has been unresponsive to my requests. (attached) Supporting Evidence: Review from another tenant describing similar issues with unresponsiveness from the leasing office. Application details including $225 fees. I’ve been at this apartment for three years. There has not been a consistent manager or staff including maintenance that has been able to keep up with the apartment. I have had three major water damage issues in my unit that has left carpet damage with mold and has caused my family numerous respiratory sicknesses. On June 19 2024 my apartment was flooded by a water pipe they neglected to fix upstairs for over a year. They did not do anything to properly repair the unit. The property manager Aspara and upper management refused to abide by my lease and repair damages in a timely manner or abate my rent. My children and I have been displaced since that day and they have still not done what was necessary so I can move back into my unit. They are still demanding rent and threaten to evict me if I did not pay. The manager does not respond directly to issues. Upper management is the same. I have called code enforcement and seeking legal help to resolve my issue. There are currently two other neighbors a know going through the same issue with flooding in there apartment and mold. They also have not had any proper repairs and both maintenance and management fail to do their job. I literally had the maintenance man tell me verbatim “I’m going to ****** rig this for you because the office doesn’t want to pay for anything.” My appliances have been broken over a year and nothing in my apartment has ever been properly repair and no repairs have lasted. They do not abide by there lease agreement and they have increased rent nearly 500$ for all tenants and have not made any upgrades and half of the amenities tenants do not have access to. Please send out people to investigate not just the office but the structured buildings as well. This is for your **** **** ******** ** ***** **. They reported me to the credit bureau as soon as you move out. I left them with my forwarding address and phone number. NEVER got an invoice or call from them letting me know I was being charged for something. (I lived there for 2 years) so I expected any damages to be covered by my deposit but no I got a call from a collection agency and now in my credit report! **I have paid off “******** ****** *******” on 05/31/2024. I need this removed off my report as soon as possible as it is hindering my rental history, while looking for a new apartment to move into with my children!Business Response

About six months ago, I applied for a specific apartment at Artisan Apartments. When I was about to submit my application, an officer named Greg and the manager, Veronica, informed me that the apartment had already been rented out, so they withdrew my application. I double-checked and triple-checked with their leasing office regarding the $150 application fee, and they assured me that I did not owe any money to their company. Additionally, when I logged into the application portal, it indicated that my application was inactive. However, on June 5, 2024, I received an email from ****** ********* Inc., a debt collection company, stating that I owed $150 as of January 30, 2024. I immediately called Artisan Apartments, but they kept me on hold and did not provide a solution. I am requesting two things: first, an adequate explanation of what is going on, and second, the correction of this debt collection issue.Initial Complaint

I moved out of their property The *********. I paid my balance in full. Received a printout stating that my move out was completed and there were no further actions needed on my part. Later on an itemized statement showing my balance at $0. Nine months later they sold my information to a collection agency with a false balance. I’ve called several times. So since I have moved in to my apartment going on 3 years now I have had issues with the air conditioner. For example my ac kept going out or freezing over. They constantly had to keep coming and cleaning it or fixing it. One summer night it completely went out like would not turn on. So someone had to come from San Antonio that evening to fix it. He specifically told me it will be ok til the end of summer but needs to be replaced ASAP. He said he wrote that in his report for the apartment manager. I spoke with her and she said she was gonna order the unit so by next summer they could replace it. Cause it had to be a certain degree outside. Well fast forward this is Texas and even in the winter we need our ac so it was still freezing over not as often but still they frequently had to come look at it. Now that it’s been warmer and almost summer I asked about and now they are telling me it’s on back order. And so I questioned why it wasn’t ordered last year when I was told it was gonna get order their reply was the owner didn’t approve it. So now it stays hot in my apartment. They gave us one small portable ac which keeps the living room semi cool but the kids and my own bedroom stays like a sauna. My daughter just woke up right now covered in so much sweat it looked like someone threw a glass of water on her. And I have just had enough. They had enough time to fix the problem. I put a maintenance request in now weekly and I don’t even hear anything anymore. Almost like they see and just move on to the next.Customer Answer

Since day 2 of moving into our apartment in April of 2023, I have been in touch with the manager on site regarding a loud sound that happens outside of our bedroom window anytime there is wind or storms rolling in - which is often and has been incredibly disruptive to our quality of sleep as this happens during all hours of the day and night. I've been able to identify that the sound is due to a loose gutter that bangs against the building. After being met with a cold shoulder by the manager on site, I escalated the issue with a regional manager and provided videos along with too many follow-up emails & phone calls to count. My latest attempt to follow-up with both of them on November 22, 2023 went unanswered all together. Recently, a new manager on site reached out to renew our lease at an 11% increase. I explained my concerns and even shared other apartments on the website that were going for even less than what I pay currently. The reply I got was that views and location of the apartment were taken into consideration which is interesting given my view is now of a construction site that starts at 6:45AM Monday - Friday and literally shakes my entire apartment to the point of my furniture and glassware moving. This now combined with the sound outside my window has made an already unbearable situation worse. The mental health and overall well being of myself and my spouse has suffered significantly as a result and has also impacted my work performance as a result.Initial Complaint

Left apartment at ****** ****** **** in perfect condition at end of lease. NRP not only retained one full month deposit, they charges extra amount over $100 without providing itemized breakdown of the total of $4000+. According to NJ law, landlord need to provide itemized list of charges, either in person, or via certified mail. In addition, NRP hired collection agency to harrass me and my roommate, the second lease signer, as well as to damage both of our credit scores.Business Response

I rented an apartment at The Starlings sight unseen other than their website. My lease started on 10/31/2023 but, I didn’t move in until November 11, 2023. Prior to moving in, I explained that I had a disability and requested grab bars in the bathroom. When, I picked up my keys at move in the Real Estate Agent that gave me my keys saw that I was using a walker to assist me. She failed to ask me if I needed an accommodation or follow up with my former request. After moving in I requested an accommodation in the bathroom. This was in November. I was told by an agent that “they usually tell old people that the bathtubs are deep and they go somewhere else to rent”. I explained to her that she was discriminating against a person because of age and/or disability. I continued to call the office and after no follow up, I sent an email. I called again and was told by an agent that she needed information from my doctors office to decide if I needed an accommodation. I pointed out to her that my sources of income given to her was from The Social Security Disability Administration. Finally, I called back and spoke to Colin ********. I explained to him that I had fallen in the bathroom several times. The last time I tried to enter the shower I slipped and hit the side of the tub, resulting in a large purple/black bruise and pain. He gave me the forms to fill out. My request was approved on December 11, 2023. As of date, nothing has been done. I am paying over$1,700 a month but have a bathroom that doesn’t work with my disability. I cannot use the tub/shower because of the height of the tub and there are no grab bars. While I use the commode I have to grip the tub on my right and the bathroom sink on my left. The commode is so low and causes me extreme pain to bend my knees to sit down and to pull myself up. I have to take sponge baths in the sink.Business Response

Gates- My kid goes to elementary school at ******* *******. The schools bus stop is at the back gate. The back gate was only open once since I moved in. I went to the office and asked if there was a way to open it so my kid doesn’t have to walk on the Main Street to walk all the way around to the apartment complex. When he could just walk through the gate. They said no because some lady complained about the gate being open. But that’s dumb the front gate is always open. It’s only been working 1 month since I’ve been living here for 6 months. The front gate has been broken for months now. There’s no security when it come to living here because the gates always broke.which lead to someone walking on the premises and they broke into my car stole my things. Broke my window. I’m not mad at that though. Which is fine it’s low income but if the front gate is gonna be left open they back gate should be to. Or both the gates need to be fixed.How does 1 lady dictate the gate when we all pay rent.Business Response

Unfortunately, the gate referenced in the back is a designated fire gate that can only be accessed by the fire department. It was unlocked only for a brief construction period and authorized by *****. We are working diligently to address the issues with the front gate caused by an unexpected accident. Currently, the property has a Standing and Mobile patrol daily for security. Thank you,
