I have been trying to cancel my membership for months now due to an unexpected disability. I was diagnosed with testicular cancer and after having 2 surgeries and a form sent in from my doctor, I was told that this was not enough. Sadly, I now have had a third surgery called RPLND that led to complications resulting in my near death. The complications led me to a 4th surgery (abdominal) to save my life but also including having to get a colostomy and a large open wound that will take time to heal as well. It is sad when someone has been through what I have that a simple 500.00 approximately that I was left owing could not be cancelled. Any help that I can get to resolve this matter would be greatly appreciated. My next step will be contacting local news for help. I am not sure what more someone in my condition can do at this point.Business response

Certainly we feel for the situation that *** ****** is in. Our policy to cancel due to disability requires permanent disability, which his disability form did not state. Having said that however, and after corporate review, under the circumstances based on the number of recent surgeries and health issues he has encountered we are going to make an exception in his case and cancel his membership effective immediately.Customer response

Get multiple calls a day from them telling me that I owe them money and a new card needs put on file. I canceled my membership. I was the. Told by someone on the phone I signed a three year contract, this is not true when I went into sign up. I was told what I was signing for was the rate was good for three years and that I could cancel anytime they’re constantly harassing and it’s becoming an issue. They don’t even give you a copy and you never see what you sign. It’s just on a digital pad. Beware!Business response

*** ******** signed a 36 month agreement with us on 4/8/2022. I have attached a copy of that agreement. He was also emailed a copy and given 2 copies of it when he joined. There is no option to cancel the agreement at will. He needs to adhere to the terms and conditions of the agreement.Customer response

***** ********. I was never given one when I sign up at first. I was told by the guy that it was only an agreement on price. Not a standing contract I was told I could cancel anytime. I was also told that the gym was 24 hrs 7 days a week and that I would be able to scan on the weekends. This is not true. They are still not open 24 hrs on weekends. The sauna was suppose to be fixed and has been out of service every visit. This place has predatory practice for baiting and switching. I will not accept this action at all.Business response

The club is open 24 hours from Monday 5am - Friday at 10pm, on weekends Sat & Sun 9am - 6pm. The sauna was replaced a year ago and works perfectly. Our records show he has not been to the club in 357 days.Customer response

I am rejecting this response that is absolutely untrue. Once again you just showed that you are not open 24 hrs everyday like I was told. And I was in there three months ago. Sign on sauna said we will not be fixing. You continue to lie and misinform through this and the sign up process I will take matters to court if need be. This is unacceptable!

She did not cancel her membership with us. She called and told our of our CSRs that she wanted to cancel but she was still in her membership term and was advised that she could not cancel. Her account is now with an external collections company whom we have no control over. She was told multiple times that she was going to be placed with a collection agency due to nonpayment of her membership. I have attached a copy of her signed agreement which clearly shows the terms and conditions she agreed to.Initial Complaint

Today on 5/6/24 someone called my mothers residence to try and get in contact with me. My mother gave me the number that i needed to get in contact with and mentioned that it was a financial matter. I spoke with that person who happened to be a debt collector and they were extremely rude, and got extremely nasty on the phone with me because i was confused what this was all about. Finally when that person calmed down somewhat they told me the phone call was in reference with everybody fitness and that i have a balance owed which is of surprise to me. I moved almost a year ago and expressed to rise financial and the gym that i had moved to the Columbus area and i was not under any impression that i would keep getting charged. I called rise financial right after and they said they sent mail and emails to me. I didnt get the mail, but while on the phone i did look up an email they had sent me in march. A gentleman named ****@risefinancial.biz in the email (which i have attached the conversation) sent me an email regarding my account which i promptly replied back with my concerns that i had cancelled the membership a long time ago and that i wasn;t aware of oweing a balance. So while on the phone with Rise today, they informed me that **** is no longer with the company. That individual never responded back to me asking me for a current address or any further details. So now Rise financial is blaming me for them dropping the ball. I Remember communicating that i have moved and wouldnt be able to keep going to that gym so i didnt think anything more about it. THen i got an email in March saying i basically owe them, and i responded back right away and **** at Rise could have told me that they needed more information, but they failed. Once **** quit or was fired the company should have siezed his emails and followed up with me but they failed that too. Now Rise financial keeps hanging up on me and is refusing to work with me. I have attached a copy of the call log showing how many times we attempted to contact *** ******** regarding his membership. **** no longer works for us so we had several other people reach out to him via email (3/24 4:10pm) and phone calls (see attached call log). He did not contact us again until he heard from the external collections company that his membership was sent to due to non payment of his membership. I have been trying to cancel my membership due to financial hardship and health issues. I did exactly as they wanted and got a Verification of Disability form signed by the clinic I receive all my health care from. Initially I was told it was fine. Later I was told it wasn't good enough because it has to be the same physician that I see more than once. You never see the same provider twice at any of the clinics here. They called the clinic and got verification that the clinic signed my form. Everybody Fitness wanted more information and the clinic informed them that it is a HIPPA violation for them to discuss my health care with them. Because the clinic won't break HIPPA, Everybody Fitness refuses to cancel my membership. I have documented health issues since childhood that are preventing me from returning to the gym.Business response

We did question the validity of the disability form that she submitted to us. We don't accept verification of disability forms from walk in clinics or urgent care facilities as it is not possible for those types of locations to diagnose a long term and/or permanent disability. In November 2021 she also had a membership with us which we cancelled due to a claim of disability. She then came in and joined again in November 2023, which is her current membership. Why would she join again if she knew she couldn't work out? She has told our billing department that she cannot afford the membership any longer, which is not a valid reason to cancel.Customer response

I am rejecting this response because:They do not tell you that it can't be from a clinic. Where we live, everyone has to use the clinic for care because there is no where else for those on state insurance. It was explained to them that we tried to put in an effort to get healthy but it turns out that I can not workout without ending up in severe pain and unable to walk.
The original cancelation was done before the gym even opened because it was not opened when originally said to be opened.
Lets see these keyboard/phone warriors who are only interested in money try to workout with Kyphosis and Lordosis and see how far they get. You don't know until you try. I tried and tried again and waited a couple of weeks and returned again only to end up getting home in so much pain I can't do it.
The clinic who sees me has it documented about my issues. I have gone to the clinic since 2015. They do both walk in and appointments. Even my therapist is willing to submit proof that I can not do it because of my mental health issues as well.
All we are asking is for them to have compassion and cancel my membership and they will never see or hear from me again.

After reviewing your request we see that t he club you signed up for the first time was a new club being built, therefore you could not have been able to use the facility. Although we do not have an obligation to accept documentation that we question to be valid, corporate has decided to grant your cancellation.Customer response

They are extremely manipulative, they use insecurities and information they pry out of you, by asking the same questions over and over until you answer to push you into a three year contract without disclosing details. I got up to try to leave saying I left my credit card in my car and the woman (Amanda) told me to leave my belongings at her desk to ensure I would come back to sign the contract. They have you sign via a computer that is far enough back that you can’t read the print whatsoever and the sales person will jump through the pages until they get to the signature lines and just tell you to sign. They don’t disclose what you are signing and by the time you finish they print it off and tell you you’re locked in, that there’s no way out. (There’s really a three day period you can back out, which they didn’t tell me about even AFTER I had called two days later and described how manipulative the sales woman was, that I didn’t want this membership that day and that I wasn’t given an option, I just wanted out of the contract. I was told it was too late.) I asked for a record of all of my phone calls to show I had called within that three day period and they have refused to provide them. I continuously tried to communicate my frustration and I was ignored. I felt harassed at this establishment from the moment I stepped in and refused to return. Now I am being threatened with collections and court by their choice of an extremely unprofessional debt collector. He immediately cusses and threatens you when you pick up the phone. My calls are recorded and many others have proof of these conversations with him as well. This was by far the worst experience I’ve had with a business and I do not believe this behavior should go unreported. I encourage everyone I know to steer clear of this gym.Business response

We thoroughly go through the agreement with each prospective member. In fact the staff person who sold the membership to *** ******* is a long time, well respected employee of ours. She is very thorough. We have attached a copy of the membership agreement. Also you will find attached a copy of our acknowledgment sheet, which is signed using pen and paper. We have no record of calls that she made asking to cancel her membership. We do have 1 call from her dated July 24, 2023 inquiring about relocation. She was told to send in two valid proofs of move but we never heard back from her. We, however, attempted to call her regarding her past due balance no less than 70 times (call log attached) and was still unable to contact her. It seems that she is trying to create a narrative that makes us look like we did something wrong. That is definitely not the case. Her account was sent to an external collections company, whom we have no control over their behavior, after not paying for her membership for 90 days.Initial Complaint

I went and signed up at everybody fitness on May 10 2023. with the expectation that it is prepaid and not a contract, I asked if I want to cancel at any time I can and the employee and owner who was present when I signed up told me I can cancel at any time with no consequences. Well in January of 2024 I called to cancel my membership and they told me I have to pay the remaining balance on my 3 year contract. I explained to them that when I signed up for my membership the employee and owner explained that I can cancel at any time and that it wasn't a contract. they then explained to me that it was indeed a 3 year contract, so I went to my email and found the contract and read it thoroughly. And nowhere in the contract does it state that I have to pay the remaining balance if I want to cancel the contract because I simply choose to. I explained that to the customer service and they told me although it isn't stated in the contract that I have to pay it anyway whether I want to or not. I explained to them that if it was stated in the contract that I was more than happy to pay the balance but since it wasn't stated in the contract that I was not obligated to pay it. So, I stopped the payment through my credit card company and didn't want to pay for something I wasn't using. Ever since then I have been receiving threatening phone calls from everybody fitness and today was the final straw when I received a phone call from their so call attorney who was not only threatening to take me to court if I didn't pay the balance of 1100 dollars but also calling me stupid. To sum it up they are trying to make me pay a fee that isn't stated in their contract, also I am in a contract that I didn't know I was in because of the misleading information from the owner and employee.Business response

The complaint made by *** ****** has been reviewed by management. I have attached a copy of our acknowledgement sheet, which is signed by *** *******, which states that he received 2 copies of his signed membership agreement and understood it is not a month-to-month membership, but a 36-month term and that he understood his 3-day right of recission. After the 3-day cancellation period there is no option just cancel at will. Also, in the membership agreement that he signed section 18 states: "18. MISCELLANEOUS: I acknowledge that neither the Club, nor any party on behalf of the Club, made any representations or promises upon which I relied that are not stated in this Contract. This Contract contains the entire contract between me and the Club and replaces any oral or other written contract." At no time did the salesperson or the owner tell him that he could cancel any time.
His membership has been turned over to a third-party collections agency due to nonpayment of his membership agreement.

I ordered a gym membership for my 16yo daughter, ****, in March at the West Chester, OH location as she worked three doors down. I attempted to cancel the membership on 4/16/24 due to her changing jobs in another city. When I spoke with the representative, she said we signed a 3y contract which I do not recall doing nor have I ever seen a gym membership for more than 12 months. I truly would like to not be further charged for the membership. Don't need refund for the first month since she used it a couple of times.Business response

*** ******* signed up using the online portal on our website. The 36-month agreement is available to view before signing up. After signing up, the agreement is emailed to the buyer. We can cancel the membership, per the agreement, if there is a permanent medical reason (must supply a disability form completed by a doctor) or relocation further than 25 miles from any of our locations has happened. Please let us know if either of those instances are the reason you can't use the gym. Otherwise, the agreement is not able to be cancelled at will.Initial Complaint

On Wednesday, March 20, 2024, I received a call stating that they were the collections department of everybody Fitness. I was told by the man on the phone that I owe over $1000 because I did not make one of my payments and then did not continue paying after that. The man on the phone was extremely disrespectful stating that there is no reason I should not be paying my bills. I informed him the reason I stopped, paying my bill was because my boyfriend who was physically abusive to me, goes to that gym, therefore I do not feel comfortable going there and did not have the financial situation to be able to continue paying that bill. I was told by the man on the phone he would be taking me to court he rudely hung up on me. he called me names, and he was screaming , he was being extremely disrespectful not listening to a thing I had to say and blaming me for my financial situation. The man was basically telling me I had no reason not to pay my bills. I am 19 years old, and cannot afford to have a $3000 court fee because of this. I would like to see if there’s a way I can expunge this or figure out what I can do to make this right. I do not have the finances to be able to continue my membership or even pay off that bill anytime soon , if we could, I would like to file a report on that man. The call with him was made at 12:33 on March 20 with a number coming from North Carolina… please reach back out with any information. I’m THOROUGHLY embarrassed, hurt, and disgusted with the way I was treated. Being told word for word “everyone is in abusive relationships. She did not speak with anybody from Everybody Fitness. The person she spoke with is from a third-party external collections company. The name of the company is internal credit systems. They are based in North Carolina. Again, this was not a person from Everybody Fitness. Moved over an hour away from this gym and provided multiple forms of proof of that move and was still charged and also received a threatening letter saying I was not going to get out of my contract and was still responsible for all of the months I have not even lived in the area even after submitting all of the forms of proof needed!Business response
