*** ***** joined our club using the online portal on our website. None of our staff would or did tell him that the agreement was a month-to-month agreement. We don't sell month-to-month agreements anymore. The only term we have is a 36-month term. I have attached a copy of his membership agreement for your review. When I signed up for my membership, I was not advised that it would be a three-year contract. My contract states nothing about a buyout in the cancellation section. I attempted to cancel via the phone and was told I would have to pay almost $2,000 to cancel. I have also had issues with weights not being consistent at any of the THREE locations I have been to. I can't get a good workout if I don't know what weights I'm actually using (ex; 50lbs is not the same 50lbs at all locations). What am I paying for?Business response

I signed a contract with the gym manager who lied about the guest policy and was in violation of our contract. Upon signing my contract, I specifically told the manager (**** *******) how I would like guest privileges for my husband as he and I work out together. **** told me that I would get to bring him to the gym with me if I upgraded to the highest membership that includes bringing a guest at all times so I agreed and bought that membership. After a few months of consistently coming to the gym and bringing my husband as a guest with no issues, the same manager approached my husband stating that he should get a membership at the gym as he was a guest. This was odd since the entire reason i signed up and bought the highest membership was to bring my husband whenever I wanted and my husband didn’t have to pay for a membership. Fast forward another two months or so after still consistently bringing my husband as a guest several times a week, **** ended up texting my husband that they have this rule about 1 guest only coming a few times PER YEAR under my membership. We were shocked as this was never mentioned to me in the initial contract meeting, or the last time **** spoke to my husband. I double checked the contract to see if this was correct but it is mentioned nowhere in my contract. I showed up a few days later and asked **** for any kind of written policy on this since it wasn’t in my contract and he would not provide it to me and stated it was a ‘new policy’. After a few minutes of back and forth with him trying to get more info, he then stated this has “always been a rule” and it included one guest to come with me one time per year now. The manager lied about the guest policy, refused to provide proof about current policy and the guest policy is not mentioned in my contract, making the club in violation of clause 18 (miscellaneous) since they never mentioned it. I am requesting the contract and my payments to be cancelled without penalty and possible refund.Business response

Our policy is you can bring as many different guests as you'd like, for obvious reasons they would be protentional members but our policy doesn't allow a member to bring the same guest continuously. We do give trial visits which can be 1 visit to 3 or 4 visits and this is up to the managers discretion.Customer response

I am rejecting this response because:The manager is guilty of lying by omission. I was not told upon signing the contract that any policy of this type existed and it is stated nowhere in my contract. The manager also refused to provide this “policy” to me in writing when I showed up to the gym location and asked for it after this issue escalated. No information on this policy was given to me other than word of mouth by the manager who lied several times about what the policy was in the first place. I was purposely misled and lied to by the manager who told me upon contract signing that I could bring my husband whenever I wanted as any times as I wanted. The contract is null and void per the gym not holding up their end of it per clause 18 (miscellaneous)

I had signed up for this gym in June. Ever since I’ve had so many issues with closing this account. I was never told this would be a 3 year contract, like many before me. I moved and was able to close the account, however it has been a struggle. They use Rise Financial for their payments and financial things. The ladies for Rise Financial has given me many issues that I seem to not be able to get help with. I was lied to about the contract and then their financial office told me the wrong information of my balance. They told me I owed 203.48 for BOTH accounts together and that 1 payment of 203.48 will close both of the accounts, one that they made me sign my younger sister onto. Then they told me I owe that amount again since it was payment for 2 separate accounts. They were super unprofessional this whole time doing a number of other things.Business response

She does still owe $203.48 and was recently sent to a third-party external collections company because of non-payment of the $203.48. I asked to cancel due to health reasons. My doctor filled out the form they stupidly require because my HEALTH is none of their business. Come to find out the form isn’t good enough they have to speak with the doctors office to confirm that they in fact filled out the form. Obviously they did because I do not know my doctors license numbers. They called the doctor ONCE before the holidays and never me or them again to advise if anything else was needed. I call again because it’s about time for the monthly payment so I double checked that it was cancelled and they had all they needed. The phone rings and rings and after my third call in finally someone answers who clearly is foreign and is used to being yelled at all day because this place is a literal scam and they know it. Anyways, I ask if my account closed and they say no. I said okay that would have been nice to know because the monthly payment is about due. He said oh by the way don’t forget on the first you owe your annual renew basically insinuating they won’t have this process still completed though I started it before thanksgiving. It is our policy to verify all completed disability forms. We have left at least 3 messages, a message was left for them today, for someone at the doctor's office to call us back to verify the form, but no one has called us back. In November of 2022, I joined Everybody Fitness in West Chester. I told the manager before signing that I would be leaving to go away to college in August of 2023. He assured me that it would be no problem cancelling my membership when that happened. I would just need to call and let them know. It has been anything but easy. I was not told I was entering into a 3 year contract, and that Everybody Fitness would refuse to cancel my membership and continue charging me every month. I have called, emailed and still have not been able to cancel. I am attending school at the University of Alabama over 8 hours away. On October 16th, I called Rise Financial multiple times asking exactly what was needed. They stated I needed to send my tuition statement and my class schedule. That was sent immediately via email and I asked for confirmation of receipt. I got no reply. I called on October 27th and they hadn't even reviewed my email and the criteria needed has now changed. They now state I need to send a photo of a paper copy of my tuition statement (the digital pic apparently doesn't work) and pic of my student ID. I informed them my student ID is only digital and on my phone. They couldn't tell me if this would work. They continue to string me along, all while I am paying a monthly membership I am not using. This is a lying, dishonest company that targets teens/ young adults. I want my membership cancelled immediately and my money returned for at least the month of Oct and no charge for the month of Nov, and no yearly membership fee should be charged.Business response

The proofs of move/college that he provided do not have his name on them or the name of the university he is going to. It only shows he is enrolled in classes. I joined Everybody Fitness several years ago before covid, enjoyed their services and gym and had no complaints. But health concerns a few months before covid shutdown prevented me from conttinuing. I've tried repeatedly to stop them billing me--emails, phone calls, in person visits--to no avail. I havent been there since 2019, but they continue to bill me every month.Business response

We have not heard from her since June 2020. At that time she requested a disability form from us. The form was sent to her and that's the last we have heard from her. All she needs to do is send a 30 day notice to cancel to ************************* and request cancellation of her membership since she is no longer in her term. She is in her auto renew time. I was never told before I signed my membership that I was in a 3 year contract and they won't let you cancel and they keep charging my credit card every month I got a hold on someone last month and they said if I want to cancel I owe $1,400 now and a month later I lost my job and going back to college and I called them and there voice-mail is full I just want to cancel and be done with everybody fitness why is there contracts for gyms doesn't make sense and the equipment is oldBusiness response

*** ******** was told that he was entering into a 36 month agreement. He even signed our acknowledgement sheet, which I have attached for you. The acknowledgement sheet states that he received 2 copies of his membership agreement and understands the membership is a 36 month term. At this time there is no option to cancel his agreement at will.

August 5-2023- September 18-2023 $55 and $30 I have contacted their financial department multiple times through phone and left voicemails and multiple times through emails and sent them photos of my new mailing address of proof that I live more than 25 Miles away to cancel my membership and I have not received any responses. They continue to charge my account and will not do anything to resolve the issue.Business response

On 8/26/2023 I went into everybody fitness after visiting their website. I asked to see the facility and was told i would need a background check done to have a tour of the facility. The person behind the counter told me it would cost me 20$ for the background check and that i needed to give information. I gave my name, age, and phone number. They also asked for a picture so i could be in their system. They requested that i authorize the background check with my signature, that i was giving my permission, and then said that i needed to give my initials to confirm that i was asking for a tour of the facility. I was given 2 weeks to give them 20 dollars and even given a souvenir keycard and a receipt of my background check purchase would be emailed to me within a few days. When ii got the money to pay, i was told that i was a member of the gym and that monthly payments would happen around the 21st. I checked my email and found that the background check was actually a gym membership contract. i called to have them dissolve it but the contract disallows me from canceling in person, or over the phone. I was then informed that i could cancel if i pay them 1,200$. I want the contract dissolved, and i do not want to be a member. My member number with everybody fitness is 7231-112593 The website ********************************* No where does it tell you the terms of the contract, or what you are actually signing up for.Business response

*** ******** complain is not truthful. We do not run background checks on members. He is trying to cancel his membership after the 3 day cancellation period. There is no option to cancel at will.
