I inquired about a property inspection. I was sent an agreement via email which I read. In the agreement, it stated that they gave my information to a 3rd which I did not agree with. I told them that I don't wish to have my information shared and that I would look for a different inspector. I then received a confirmation by email that the inspection will occur. I replied stating that I do not want them to do the inspection and please cancel. No reply was received from the them. I then received an email for an invoice. I never signed any agreement with them.

The client emailed me saying that he did not like the inspection agreement because of the third-party sharing and wanted to cancel the inspection for that reason. I replied back to the client stating that I had edited the inspection agreement, removing item 15 from the agreement that had the third-party sharing.

I then expressed to him that the third-party sharing was solely in conjunction with the free warranties provided to him with his inspection. My company provides 3, 90 day warranty’s and a five year roof leak protection through residential warranty services. I’ve been explained that for this reason, I would not be able to provide the free warranties with the inspection, because without setting up his account with the warranty company, it was impossible to provide the warranties.

This was emailed to him, and I added notes to my inspection report waiting for his response. The day before the scheduled inspection, I received an email from the client telling me to cancel the inspection. I promptly replied and told him that the inspection was canceled.

Therefore, I canceled the inspection and voided the invoice. I also notified the inspector that was scheduled to do the inspection that it was canceled. In my response to the client, I explained that by law, all home inspectors are required to have a signed contract. We are not permitted to perform a home inspection without one. I also explained that every home inspector that is licensed would be providing a similar contract.

There are other inspectors that also provide the warranties, therefore this clause is required to be in the contract as well. I wished the client well. I have copies of the emails saved and are available upon request if you need the proof.
