1/3 deposit was paid for a kitchen remodel that was set to start in July 2023. Start timeline was delayed multiple times because of contractor excuses. No materials were purchased for project. Contractor agreed to cancellation and refund and signed a cancellation contract and had notarized. Never refunded any money and have multiple communications saying they would pay back. We contracted Marioth Custom Construction to complete a large renovation and addition on 12/17/22. Total contract amount: $106,776.00. A check was written for 20% to “purchase initial materials.” Shawn M****** stated at the signing of the contract “if we have a mild winter,” work was to begin in "early spring." It was a mild winter. Work began the 8/14/23 removing a structure to prepare for the addition. We have currently paid 81% of the initial total but it appears to be closer to 60% complete; he states this is because of material costs. He repeatedly misrepresents the facts, provides implausible excuses for delays/no-shows or is deceptive about info we can verify. He has stated inspections are scheduled, but we verify they are not on the Delaware County website. We inform him of the discrepancy and then moments later we can see it is scheduled. After the initial structure tear-off in August, it took a month to actually pour concrete. Excuse after excuse was given for delays. He told us concrete was scheduled for a certain day and it was repeatedly cancelled. We called the concrete company he stated he scheduled with and they stated it was not paid for or confirmed. His crew does not show up multiple days in a row despite his written commitment to a new schedule. We have repeatedly asked for a realistic schedule. Marioth has provided us new finish dates 3 times, he currently is working on a 4th. The Marioth contract states completion in 90 days. Today he informed us -- "We were not approved on the roof structure and I have worked every way possible to make it work out and have failed to do so, this is what the hold up has been." I called Delaware County to ask about inspections and they stated on 10/16/23 we failed inspection due to work being completed outside of the scope of the plans. An alteration to the plans needed to submitted after the 10/16/23 inspection, and it was not. I have repeatedly asked for explanations, but clear explanations are not provided.Customer response

I reject this response because: we were given an updated schedule, and once again, he has not worked all week. Work was to start on 11/28 (see attached), and as of today 12/1, he has not begun work. So his response stating work will restart 11/30 is incorrect. The only work he has completed is to adjust the temporary roof covering because it leaks into our kitchen every time it rains. Today it is raining and the addition room has pools of water which are leaking through to the concrete pad below. We continuously ask for verification that the materials have been purchased for the remedy of the project; he will not provide us with any documentation. The reason we ask him for proof is because he has repeatedly lied or made misleading statements about materials, permits and plans regarding this project.

Date of contract was September 1, 2022 for Kitchen Remodel with total 20,874 and down payment of approx $6300. It was for my 81 year old mother in Westerville. Work to start end of 12/22-started 2/15/23. Payment was to be weekly based on work completed. Payments paid on time and every Friday Shawn picked up a check. Around March to April the work stopped or slowed down, waiting for countertops, sinks or whatever. Multiple excuses given ranging from delays with sinks, workers and fabricator. Shawn went as far as to schedule counter top placement twice claiming first time "fractured" counter top and second time, no workers (July 2023). Finally after multiple delays, excuses and lies, I called both ********** ***** **** and ********. All three places said nothing had ever been order, no sink or countertops. ******* *********** said they had been reaching out to Shawn since April but he had no money to finish job and they did not even have a piece of stone there in our name. They said Shawn had 5-6 more jobs, mostly seniors, in the same boat as us. In the meantime, I get a text from Shawn stating "not sure why the fabricators contacted you, they are not the ones that have your tops, I'll get it sorted out". I called him immediately and told him to quit lying-we are aware of the lies and parts not ordered. We called all the places and they have never had an order for us. We want a refund for what work has not been completed and he should be ashamed and disgraced by lying to seniors and cheating people out of their hard earned money. Marioth owes us $10,000, $6100 in parts for countertop and plumbing and remainder of work that needs completed - but we were charged for ahead of time. We had to hire someone to complete the reno-the stove blocks kitchen cabinets and has to be moved. He took advantage of my mom's kindness and understanding. She has been living in disarray with a multi-handicap child for a year in a torn up kitchen. UNACCEPTABLE!Business response

It was not our intention for the project to go this way by no means. We would submit the following resolution to Mrs. ******* on behalf of Mrs. ******* The amount in contract for the tops, backsplash, sink and faucet is $6,045.00. This amount did not originally include a copper sink that was requested after the project has started and would have been an upcharge to do so that Mrs. ****** agreed and stated that is what she wanted in lieu of the stainless one in the contract amount. The full amount of $6,045.00 would be refunded after agreement of this amount and a "contract cancelation notice" we would send for signature, had been executed. Please let me know if you agree to this amount and we will get the document to you.Customer response

I accept the business's response to resolve this complaint, provided the information in the cancellation of contract is accurate and the refund is in a timely manner.

We hired Marioth Custom Construction on 11/1/22 to complete a kitchen remodel and bathroom remodel. When we signed, Marioth advised that the services would be complete within 6 weeks of the start date. The contract stated all work would take absolutely no longer than 90 days. We have paid Marioth Custom Construction in full for the project. However they will not complete the work according to the contract and are no longer responding to communication. Our bathroom is unusable and kitchen work is incomplete / defective. Marioth failed to complete contracted work within 90 days of start. In an effort to get Marioth to complete the work, we agreed to the 6+ revised schedules from 6/12 - 8/23. Marioth consistently failed to have the full team and materials on site Mon - Fri to complete the work in a time efficient manner. At the time of writing, it has been 18 weeks since the project started. Marioth refuses to deliver and/or install all purchased materials.This includes, but is not limited to, shower glass, shower frame, shower fixtures, custom bathroom vanity, and custom bathroom cabinet. We have requested these materials be delivered on site every week, in writing and in person, since mid June. Marioth has failed to comply each and every time, resulting in their employees and subcontractors leaving early due to lack of materials and direction. Marioth has failed to correct deficiencies and defects in delivered work including, but not limited to: Popped nails in exposed shelving, chipped and scratched cabinets, no durable finish applied to cabinets and pantry, malfunctioning pantry door, flickering lights, wrong cabinets installed in bathroom etc.Business response

It is 12/21 and I have not received any refund from the business. This is very much in line with my experience with Marioth where they promise to do something by a certain date and then fail to follow through.Business response

We contracted Marioth for a complete garage remodel on Nov. 15, 2021. Contract total: $18,170.00. Work was to begin "in the spring." Tear out of the floor began Aug. 6, 2022. Now, eight months later, the job is still incomplete. Mr. M****** ordered the wrong replacement garage doors, but failed to notice this until the planned day of installation. Note that he promised to order the doors when we signed the contract in 2021, using our $5,451 deposit, since he said the order could be delayed due to supply chain issues. He had nine months to secure the correct product. On the morning scheduled for door installation, September 13th, he called to say that the manufacturer had mistakenly sent the wrong doors, asking if he should install them anyway. He promised to order the correct top sections, with windows and grids instead of solid panels, and replace them upon arrival. We agreed on this condition since we had been without a functioning garage for so long. As with every stage, he demanded payment for the completed work after installing the new doors and tracks. We owed, he said, for everything but the product cost of the replacement panels. We paid in good faith, though I worried that it left us no leverage. Less than a week later, the new doors and tracks began screeching horribly. On Nov. 1, 2022, we inquired about the status of the replacement panels and asked if he would come adjust the doors since something was obviously wrong. His response was, "I will check at our shop to see if they have arrived, and get it scheduled." There have been no further updates from him. He never came to fix the screeching doors. I repaired them at my own expense. Five months later, it is clear that he has no intention of completing the job, but we still want the doors specified by our contract. We have emails, voicemails, and photos documenting every step of the remodel to substantiate our complaint. It was not our intention for top panel the garage doors to take so long to be replaced with the window panels. We have had a terrible time with getting the panels from the supplier. We will absolutely schedule a time to get them installed and make any other adjustments needed to the installed garage doors. We had planned to do those adjustments when the panels were swapped out with the glass ones.

We have went to another dealer given to us by ****** to secure the top glass garage door panels and are scheduled to arrive by 5/19. We can schedule to install on the following Monday 5/22. If they arrive before hand we would obviously install the day after they arrive to make this right with *** & Heidi *****.Customer response

I will accept the response from Marioth Construction conditionally. Note that my contention has NOT been refuted with proof that the product was already on order. I still have no reason to believe that it was. Since the proposed installation date is thirty-two days from today, I will expect an update on Monday, May 8th - two weeks prior to the proposed installation - confirming that all is proceeding as planned. If I do not receive an email confirmation on this date, I will open a new complaint with the BBB on Tuesday, May 9th. I have no other leverage, because the company has been paid in full. I realize there may be further delays that are beyond the control of Marioth Construction, but I will expect any such delays to be communicated to me promptly. Timely communication has been a problem from the start, so now I must insist on it.
