This company owes me a $7606 refund and they will not return my money. I placed an online order about 7 weeks ago. Directly after placing that order, they sent so many marketing emails it triggered a spam filter and I no longer got any of their emails. A couple weeks went by and I followed up by calling. They said they sent an email directing me to contact them to confirm the order which got spam filtered. Since the order hadn't been processed they agreed to cancel the order. They gave me instruction to have my bank request a recall of the funds. Since sounded suspect from the start, and the local branch manager at my bank verified they can only recall funds in the initial 24 hours. Called APMEX back, they gave me the same bogus directions to request the refund through my bank and a second bank branch manager said that's impossible. They need to send the refund. So here we are. My next steps are an SEC compliant, State and local authorities, and lawyer up.Business Response

I am rejecting this response because: 1st there was never anything mentioned on either phone call that funds would have to be held for 60 days. Secondly, I tried twice to recall my funds with my bank. Both branch managers said this was impossible after the initial 24 hours of the transaction and the mercahnt should know this. This is the 3rd time they have lied regarding a recall.

The US *********** themselves said they couldnt locate my package and wrote that they are sorry for the non-receipt of my package and APMEX should be notified. APMEX was notified and refuse to look into the new findings of the latest investigation.
APMEX did not allow for a complete investigation to be done by the US Postal Inspectors and they are going against the US Postal Inspectors and Consumer Affairs Decision and Investigation.
Whats even more interesting Consumer Affairs have allegedly found patterns of theft by this carrier and would like me to pursue this case with the Postal Inspectors. Which the postal inspectors have now sent me Inspector General.

The US *********** has said that APMEX can make a claim for the non-receipt of my package because no one in my building signed and they are sorry for the non-receipt of my items.. APMEX REFUSE to look at the new findings from the post office and are ignoring the facts from the US Postal Inspectors Findings. The refusal of my claim shows the incompetence of APMEX to look at the new facts and they continue to use false information to deny my claim. I am rejecting this response because:APMEX KEEP USING the old findings from the postal service and APMEX refuse to see the letter which was provided by the US POSTAL INSPECTORS on 9-18-2023 which states the package is lost and missing. The carrier was not allowed to sign for my package and she seems to have a history of alleged theft. You keep bringing up the local post office findings which where a cover up. My letter isnt just made up and it shows proof which you can verify it yourself. Whats so hard to understand that youre wrong and so was the local post office. APMEX doesnt understand that the post office has changed their decision from the time they investigated until now. They can just call them and see that the postal lady was at fault and never delivered to anyone in my building nor anyone in my building signed for it!
So basically youre rejecting the new decision from the post office even though it wasnt my fault! It was the carriers fault and you are being given the letter again for the 6x. This is the 6x Im sending it to you. Lets see if you can read and understand it and verify it. You cant go by a past decision which the post office themselves dont agree with. The US POSTAL SERVICE DOESNT AGREE WITH YOU AND CHANGED THEIR DECISION ON 9-18-2023!! Look at the letter and verify it and stop these games. They do not have the returns correct. I told them the two coins with damages on several occasions along with photos and neither of them have APMEX on the coins. They also was asked what information that caused the failed attempts that they had on file and didnt want to verify it. Sold gold bullion to Apmex, double boxed with shipping labels on each box per their instructions. *********************** was well aware of the fact they were doing inventory and wouldn't pay out until after labor day, a week later. He let me ship the box overnight for no reason. His boss called me on Tuesday afternoon to let me know of the delayed payment. She admitted ******* knew of this and offered me free shipping. The box was a apmex 2 days ,when opened the gold had been stolen. ******* called me to inform me of this and told me the insurance claim takes 2 weeks. Another lie. It takes 4-6 weeks. When I had called to ask if the apmex footage had been looked at, they assured me *********************** had no idea inventory was going on. Another lie. They won't confirm thier footage has been looked at. The claims department has no direct number. They will not provide proof Apmex did not steal the gold. They will not provide the name of the insurance company. They will not verify they have looked at the *** store footage of me packing and sealing up the 2nd bigger box. The claims adjuster said they are not willing to press charges when and if the insurance company concludes thier investigation. I'm out my money and gold. I do not recommend Apmex to anyone. I asked my neighbors if they had received my package and was told no so I contacted the post office and the claims department of APMEX to get a replacement or refund. They told me I needed to wait for two weeks and if I didnt receive my items to reach back out to them to start an investigation and to file a police report which I did within the 30 day time frame date of police report:07/03/2023 17:00, DET ************** 1 0 3 9 3 dn2 Prec DB when I inquired to see if the report was filed I was told that the detective was on vacation! I ordered a tube containing 25 ******* silver Britannia's. Because APMEX shipped the coins without taping the tube lid, the coins came out of the tube and were damaged during shipping. I initially agreed to a replacement of the coins. However, because of various delays in APMEX "processing" time for the replacements, I decided to request a refund instead. I've received various run arounds from APMEX. For example, after a frustrating experience with APMEX's customer service, I asked to speak to a supervisor, I was connected with a supervisor who was on vacation for a week. The reason I know this is because I later talked to another customer service rep who told me that supervisor was on vacation. Obviously, the first customer rep KNEW she was connecting me with a supervisor on vacation. APMEX later told me they have two such supervisors so I COULD have been connected to the other supervisor who was in the facility. APMEX claims they are now "processing" my refund, but refuses to tell me the amount of the refund - claiming they don't know the amount until the refund processing is completed. I have been talking to APMEX for two weeks now and I have neither the coins nor my refund.Business Response

I am rejecting this response because:I read the BBB reply from APMEX, which stated that a refund would be provided ONCE THE SHIPMENT IS RETURNED and the item checked in. I returned the original shipment (which was damaged in shipping due to AMEX's negligence) and initially agreed to a second replacement shipment, but once additional problems arose with APMEX, I decided to request a refund instead. I never received a second replacement shipment and APMEX KNOWS this. The second replacement shipment was being processed when I decided to request a refund instead. I received a 06/12/23 email from APMEX stating:
"This email is to inform you that APMEX has received your package for RMA214490 and is processing your return. This will take approximately three to five business days. You will be notified by email once the return process is complete.
Thank you for your patience. We appreciate your business."I appreciate the BBB's efforts in resolving this matter, but APMEX is now making untrue statements. Let's try this once more and if we can't get resolution, I'll pursue this matter with the state attorney general. Again thanks to the BBB for your efforts.

I am rejecting this response because:The response from APMEX sounds promising, but until I receive the echeck, I have to regard it as another "the refund is on its way" message from APMEX. I've had weeks of these messages. So, unless the BBB objects, can we keep this compaint open until APMEX finally makes good on what they've promised? Thanks.

I am rejecting this response because:
1. I have provided proof that the gold coin was shipped by *** as instructed using Apmex shipping label. Video proof from the *** store.2. I have received no proof that the package arrived empty at Apmex.
3. Apmex claims department refuses to respond to emails or phone calls.
4. I am out a $2k gold coin and Apmex won't communicate nor make payment.
In my opinion, this is a very dishonest company.

As the *** Area Manager stated, the staff member who assisted you on the date of shipping is the local Center Manager. As seen in the footage, after you approach the register, he reviews your labels and once you hand him the small bubble wrapped item he sets it on the back counter directly behind him where it remains undisturbed for another 7 or so minutes. Our shipping instructions clearly advising you to package your items in a new, unused box. This will protect your products during transit and arriving to the destination safely.

I am rejecting this response because:Apmex claimed package arrived empty but refuses to file a claim with ***. Package was shipped using Apmex' *** account and only they can file a claim with ***. Apmex has been provided with proof that gold coin was packaged and shipped. They refuse to pay for coin and refuse to file a claim with *** while I'm out almost $2,000. I am suing Apmex in small claims court.
