I was leasing my car through ally bank. I went to get out of it so I went to the dealership on 15 January. They called my bank first, the dealership payoff was too much and they did not wanted to pay that much but then they negotiated and they told me I have to pay $1000 and they can take care of the rest. So we agreed signed all the papers gave them $1000 dropped the car and left. On 26 January I get a call saying they cant do the deal because my bank changed their mind they want more money again I have to take my car back. I try to fight back that you want me to get my car back after 12 days for which I had no clue what you guys did with that car? But I went to take my car back and they dont have the car. They told me they send it to auction and they are trying to get it back. I tried to fight again asking how they can send it to auction if they dont even own the car. I told them I dont want that car now since it has been through auction. They said its still your car you wanna leave it here you can leave it here. We not gonna pay for it. I went there yesterday night with cops asking where is my car because they were not getting my car back. They told me its is ****** and we are trying to get it back. So I reactivated my Sirius Xm and tracked it. It is *********** ***** about 10hours of drive. So I went to the dealership e again asking them what is going on. All they do is yell at me and telling me to let them do their job apparently I found out they sold my car to another dealership already and now they are trying to get it back. But the car is still in my banks name. I am still the owner on it. And I have to do the monthly payment for something I dont even have and they dont wanna commit to anything like they gonna help me do the monthly payment or give me a rental car or anything. Thats all I could explain through text because there are not enough characters remaining. Please call me so I can tell you more.

I bought a new ***** on 1/10/22. I specifically asked how much tag, title and tax would run. I was told $1200 to $1500 *** and was not told it was a estimate. I had exactly $7500 to cover down payment and tax. The tax ended up being $2400 and when confronted put the blame on me instead of attempting to fix it. I put 6k as a down payment so I had enough left to cover tag, title, and tax. I informed my salesman and sales manager that my down payment would depend on how much the tag, title and tax was and was still fed a fake number. So now I have a truck that I cant tag because I was straight up lied to when buying. Before all this happened I also referred a friend to buy from them and was told I would get a referral fee for anybody I referred and they bought. Well my friend bought and they now say he didnt refer me and he says he did. Just another way for them to s**** there customers. I would like them to cover the extra cost of the tag, title and tax or at the very least pay the referral fee.

      Business response

The dealership is not an official tag office, so we can only estimate the fees.  That is why this customer was quoted a range.  Since the dealership did not agree to pay any portion of the customers TTL at the time of sale, these fees would be the responsibility of the customer.  We apologize if this was not clearly explained to the customer when he purchased the vehicle.  The dealership has since communicated with the customer, and we believe the parties have come to an understanding regarding this issue.
As it relates to the referral fee, we absolutely agree the customer is owed this fee, and we apologize for any delay in getting it to him.  The check was placed in the mail on 2/2/22.  We appreciate this customers business and thank him for the referral!

I had my 2013 ***** Equinox towed to David Stanley around 8/22/21 to be looked up due to engine issues. The service manager *********************** contacted me during the week of 08/25/21 after receiving the vehicle. He told me they'd look at it and would let me know the finding. He then sent me a text to respond to authorizing service updates through text. He later calls me and tells me that my engine is bad & I'd need a new one, it:d cost around $9,000 for David Stanley to replace. I told him I didn't have that kind of money so he told me David Stanley could possibly finance the repair costs. He told me he'd send a link by text to fill out for financing. I received the text on 8/26/21 and filled out the application the same day. I texted him back letting him know that he had only approved me for $2,080 which is less than the cost of repair. I asked him if they took Carshield and he said he didn't know. I later told him that the finance company I purchased the car with would be picking up the vehicle since I couldn't pay to fix it. He followed up with me on 9/7/21. I apologized for the late response on 9/9/21 and explained I had been moving over the weekend and that I had given the finance company Exeter Finance the location and phone of where to pick up the vehicle. I texted him back on 9/27/21 asking did the finance company pick up the vehicle because I had received an email saying engine repairs had been done on the vehicle. I never received a response. Around 12/15/21 I received a letter saying the car was impounded. I thought the car had been picked up or sold. I later find out David Stanley had it towed for abandonment when it wasn't abandoned. ***** had my contact information and never told me it was picked up or asked would I be picking it up before it was towed. He had all my contact information, this situation could've been avoided. I live less than 5 miles away from the dealer and have AAA towing & could've picked it up. It now costs over $800 to get out of tow.

      Business response

      01/03/2022

The vehicle was considered abandoned because the customer voluntarily left it at our dealership for her lender to pick up.  The vehicle remained at our dealership for approximately 4 months but Exeter never retrieved it.  David Stanley Chevrolet is not privy to what occurred between this customer and Exeter, nor do we get involved once we are told a vehicle is being surrendered to a lender because of inability to pay for repairs.  Since the vehicle was never picked up, we had it towed off our lot.

Our system sends generic text messages automatically when a repair order is closed; it does not necessarily mean work was done.  David Stanley Chevrolet did not perform any work on this vehicle except a partial tear down to diagnosis the issue.  The dealership wrote off this tear down cost and all storage fees incurred during the length of time the vehicle remained on our lot.

We sympathize with this customer but cannot agree to pay the tow/impound ****.  This issue appears to be the result of a miscommunication between the customer and Exeter.  Generally lenders are willing to pay the costs necessary to get possession of their collateral, so we suggest the customer get with Exeter to see what can be done about the tow/impound ****.

      Complaint: 16402494

I am rejecting this response because: The business on 9/27/21 to ask about the vehicle. I called the dealership when the receptionist kept leaving me voicemails wanting feedback for the service. I asked her was the vehicle picked up and she said yes, this was before the vehicle was ever towed away. David Stanley also removed my license plate off of the vehicle to make it look like it was abandoned. Also, the vehicle was not not left on the lot for 4 months, 11/25-11/29, is 3 months. Each time I inquired about the vehicle I was told it was picked up when in actuality it was still there. If I had abandoned the vehicle, I'd not continued to inquiry about it. David Stanley purposely towed my vehicle & removed my license plates to make it look abandoned. They also told me my engine had gone out and wanted $9,000 to repair it. Since I've retrieved the vehicle, I took it to another shop & was told it's the timing chain and nothing is wrong with the engine. David Stanley wanted unnecessary money and did not have my best interest at heart. *********************** is rude $ when he called me to discuss my complaint he was very dismissive and nothing was resolved. He needs to learn how to treat his customers better. He knows he was wrong and all of this could have been avoided with a simple phone call for me to come get it or it will be towed. I never told him I didn't want the car, I said I didn't have $9k to fix it so I'll talk with the finance company. The finance company said they wanted their car back if I couldn't fix it. Either way, I'm still responsible for the vehicle regardless of me surrendering it to the finance company I still have to pay for that vehicle. I got a copy of the tow receipt from the tow company where David Stanley listed the vehicle as abandoned with no license plates. I want to be reimbursed $886.00 (the cost to get it out) for my vehicle being towed unjustly.

      Sincerely,

      *****************************

David Stanley Chevrolets (DSC)technicians are highly qualified, and we stand by our diagnosis. We agree the vehicle had a timing chain/gear issue; however, when our technicians opened the valve cover there was significant oil sludge buildup in the valves. This can cause the engine to lock up or go out at any time, requiring the engine be replaced. DSC will not perform a temporary fix if there is a significant safety concern with the engine, as here. ************** always had the option to get a second opinion if she disagreed with our diagnosis or estimate. Instead of doing so, she decided to voluntarily surrender the vehicle to her lender. Oklahoma statute dictates that a vehicle may be considered abandoned after 48 hours. ** **** ****. The vehicle was on our property for over 3 months.  DSC had reasonable cause to believe the vehicle was abandoned because neither ************** nor Exeter retrieved the vehicle, despite Ms. ****** representations that Exeter would be doing so. In text messages between ************** and DSCs service manager *********************** (attached),************** explicitly stated she was going to arrange to have it picked up and confirmed that she was letting the vehicle go back to her lender. Our records show ************** only communicated with **************** regarding the vehicle, and *************** never told ************** that the vehicle was picked up by Exeter. It was Ms.****** responsibility to communicate and/or coordinate with Exeter to confirm they retrieved the vehicle as she had requested; it appears she failed to do so.DSC did not remove the license plate from this vehicle, and the presence (or lack of) a license plate has no bearing on whether a vehicle is considered abandoned under OK law. Since the vehicle was on DSCs property for well over 48 hours,we were legally authorized to have the vehicle towed and will not agree to pay for the tow bill. However, we will agree to waive any storage fees associated with her vehicle.

On 08/18/21 me and my husband went to David Stanley Chevrolet because we saw a Tacoma Trd offroad they had. The next day we saw is was just a sr5 and they charged us $1056 more than the internet price we saw without explanation and added ext. warranty, gap and maintenance service without asking if we wanted them, that added $5985. They also made us sign two contracts so we could take the Tacoma with us and came back with the $5000 down paymnt the next day, and they never provided us with a copy of that contract so we are not sure if they really voided that contract. They promised to send the title in 30 days and we havent received it, I had to drive there to get a sencond tag for 2 weeks and it expired. I talked to Wells Fargo to find out the aplication for finance expired and they never let us know, they made us think we finalized it. After 51 days they keep cheking our credit. They are telling us we need to sign a 3rd contract or they will hurt our credit if we return the Tacoma.

We regret that the customers had a bad experience at our dealership.  Unfortunately, there were delays receiving the title to the vehicle they purchased which were outside our control.  We apologize if this was not adequately communicated to the customers.  We are currently working with the customers to rescind the deal as requested.

False and misleading information as to the sales price of vehicles listed on the website and when calling the dealership. It’s not until you ask for a purchase agreement that you are informed the price shown on the website is only the price if you are trading in a vehicle. This information is not listed on the website. Likewise when calling the dealership and asking for the sales price you ARE given the price listed on the website. But then told differently when asking for purchase agreement for bank financing. False, misleading information.

We regret that this customer had a bad experience with our dealership, and we apologize for any confusion that was caused.  It is our policy to honor the internet price.  If the vehicle at issue is still available and the customer is still interested in purchasing it, we will sell it for the internet price listed.  The customer should ask for David *****, who can assist them moving forward.

We regret that this customer is dissatisfied with his vehicle purchase. The used vehicle he purchased passed all dealer safety inspections prior to sale.  David Stanley Chevrolet cannot guarantee the condition or history of a used vehicle, and for this reason all used vehicles are sold as-is.  This customer signed the attached As Is-No Warranty Agreement acknowledging he purchased the vehicle as-is, that paint and metal work may have been performed to the vehicle, that David Stanley Chevrolet has no knowledge as to the vehicle's accident history, if any, and that he had an opportunity to have the vehicle independently inspected prior to delivery.  While all sales are final, David Stanley Chevrolet is willing to make an exception in this one instance as a gesture of good will.  As such, the dealership is working directly with the customer to unwind the transaction.

I am rejecting this response because:David Stanley stated that I should have independently had this car inspected before I bought it. I also feel that David Stanley should have had this car independently inspected before it was sold to me. Before I left the lot damage was found to the car. I was told to bring the car back on Monday morning to repair the damage. After I got home other damage was found to the car. I have not heard from David Stanley since I returned the car so there has not been a good wheel gesture.

      Sincerely,

The dealership agreed to unwind the deal due to the customer’s dissatisfaction with his vehicle purchase.  This was the goodwill gesture referenced in the dealership’s original response.

As of this date, the deal has been completely unwound.  The vehicle has been returned to the dealership, and David Stanley Chevrolet has paid off the customer’s loan associated with the vehicle purchase.  See attached correspondence from the lender confirming loan payoff and lien release.

We hope this clarifies any confusion regarding this matter.  Since the customer is no longer obligated on this vehicle purchase or loan, we believe this issue has been fully resolved.
