We purchased a new roof in January 2010. it was shingled with Malarkey Legacy 50yr class 4 shingles. Upon inspection this year, I was informed that the sand coating on the shingles is coming off and that the roof should be replaced. I contacted Malarkey and they informed me that unless the roof is leaking, they would offer no warranty. I find this totally unacceptable as even a tarp on the roof would prevent a leak! In addition, the denial letter referenced an entirely different class of shingle (Highlander) than I have so obviously the pictures and receipt were never reviewed. I am requesting that Malarkey replace this defective product and compensate me for the cost of a new roof.

September my roofer looked to see if we had suffered wind damage to our roof. He said no wind damage but our roof was blistering, losing granules and cracking. This is something he had seen as a defect in the manufacturing of some Malarkey shingles. He said since they were less than 10 years old they would still fall under warranty. I explained that we did not own the home when the roof was put on but he assured me that Malarkey was good company and always stood behind their products. Sept 26 I filed a claim, *****, including photos. Nov 5th they requested a Transfer of Warranty letter. I told them I did not have that letter but had all of the necessary documents that would have been used to do the warranty transfer. Unfortunately, when we bought the home we did not know such a thing existed. Nov 12 they asked for the letter again. Again I told them I did not have it. Nov 13 they noted in my file that we did not have the letter and then continued to ask for more photos showing the damaged roof. This led us to believe that the process was continuing despite not having the letter. After two more requests for photos and my roofer coming out to take more photos and document more, they decided to deny my claim Dec 2. The denial was due to missing Transfer of Warranty letter. If that was the real reason then why didnt they deny me right away; instead we were asked twice to provide more information on the roof. I called the company to speak with someone to explain that I had all the documents they needed, just not the specific letter. I was told exceptions could be made but only by claims management. The local *** and my roofer also said they had seen exceptions made in the same scenario. When I spoke to Claims Manager I was told they dont have that power. Someone must have that power. If I can prove everything that this letter proves they should be willing to stand behind their defective product. Instead they are using a technicality to deny.

Dear Ms. ******************** understand you are reaching in regards to claim number *****, created in September of 2024. We have reviewed the claim and the documentation provided. We apologize if part of the communication from our internal team or the contractor you were working with was misleading after the claim was submitted, however we do stand behind our decision to deny this claim due to the transfer policy not being followed.

As shared in our determination letter sent via email on 12/2/2024:

Your shingles were reportedly installed in March 2018. Please note that the applicable warranty states the following regarding transferability:

To transfer the warranty, the current holder of the warranty must notify Malarkeys
Warranty in writing within sixty (60) days from the date of title that the property has
changed. The following information must be provided; the name and address of the
current holder of the warranty, the date of the original completed installation, proof
of purchase, the address on which the shingles are installed, the name and address
of the new owner, and the date of title transfer.

If Malarkey is not notified of the transfer as outlined above, the warranty shall not
transfer and Malarkey will have no further liability.

I apologize for not getting back to my case in the 7 calendar days.  I was not satisfied with the response from the company.  It is the same I have been getting; however, I don't know if they are going to change their mind in any way.  I was hoping this was an avenue to try.

We had malarkey shingles placed on our roof in 2017. We are selling our house and the inspector said the shingles are all cracked and they are defective. The company is only wanting to pay for the shingles and not the labor for putting them on , the cost of disposal or the labor to de-install and re-install the solar panels, which is a significant cost. If the shingles have been found defected then they should be covering the cost for replacement including labor and removal of solar. They are saying we did not buy that warranty but is there a warranty to for defected shingles and if so why would you buy those shingles. They shingles where a grade impact resistant shingle and if needs replaced because of defect they need to cover the entire cost. The cost in 2017 for solar removal and install was 3400 and will be around ***** this year. The cost to replace and install is ****** without the solar cost. They need to cover the entire cost. This was their product and I should not have to pay to have replaced for a defective product

Malarkey shingles come with a limited lifetime warranty that provides coverage for manufacturing defects pursuant to its terms and conditions. It is not a guarantee that nothing will ever go wrong with the shingles. This claim was submitted to Malarkey on November 6, 2024 and, although Malarkey acknowledged the claim and reached out to the homeowner regarding scheduling, Malarkey has not yet had an opportunity to inspect the roof to determine whether any manufacturing defects exist. If Malarkey determines that the shingles are defective, we will offer the homeowner a settlement in line with the warranty's terms. In the meantime, we request that the homeowner withdraw the complaint and allow the claim process to proceed.

I am rejecting this response because their shingles are what is defective and must be  replaced. Their inspector was here today but I had already had it inspected also. I have called the office and was told they will only pay for the shingles and not any labor or cost for the solar to be taken off and put back on. This is their fault due to the fact of the shingles being  faulty. I should not have to pick up the extra cost of replacement due to their poor manufactory made shingles. This is very costly.

In August 2011, we paid Solterra Solar Company to install a new roof using Malarkey Legacy shingles. The shingles have failed, granule loss, after only 13 years on the south side of our roof. We filed a warranty claim with Malarkey in June 2024. A Malarkey inspector came to look at the roof in July 2024. In October 2024, Malarkey reached their conclusion that the granule loss was due to "scuff marks" which is not an adequate response. The granule loss is widespread on the south side of the roof so we just had to replace the entire roof. No one ever walked on the roof on a hot day. We had one person on the roof to wash our solar panels and he did the work in spring when it is still cool in *******. Legacy is their highest grade shingle and should not have lost granules. The company's response does not show their commitment to standing behind their products. We did not use Malarkey for our new roof and will continue to share our experience until Malarkey corrects their response to our warranty claim. (************** no longer installs roofs and is under new ownership which does not have record of our shingle purchase.)

      Ms. *********,

We apologize that you had an issue with your roof, however our inspector took a lot of photos of your roof, including under the solar array, around the array, as well as the opposite sides. The Legacy shingle is a polymer modified shingle, and in warm weather, will scar if proper shoes are not used, or proper care on walking on the product. The only area around the roof that was damaged was where the solar array was installed. I included a close up from around the array that appears to be the heel print of someone turning their foot.  This will scar the shingle. Our inspector noted the other slopes looked fine, and pictures, including close *** showing no deformation and no granule loss were taken on those other slopes. There were even pictures taken under the solar array, and these shingles show no granule loss. We also tested a sample from the roof for granule adhesion and it looked very good. While it is distressing that the shingles were damaged, this was not a manufacturing defect, but an issue with the solar installer. I am sorry they are no longer in business for you to be able to contact them, but as I said, this was not a defect of the shingle, but damage caused by an installer of ancillary equipment.

      Customer Answer

      Complaint: ********

I am rejecting this response because: someone turning their heel does not account for all of the granule loss patterns on the roof.  The photos clearly show granule loss along the edges of the shingles on the south side of the roof.  The south side of the roof is exposed to the hottest sun - so it makes sense that the shingles under the solar array look different.  They have not had the same exposure to the elements.  As is also true of the north side of the roof where it does not have the same exposure to the elements. Malarkey is explaining away all of the shingle damage/granule loss by saying that someone walked on the roof incorrectly.  This simply is not the case.  No one ever walked on the roof when it was over 70 degrees outside.  In addition, although some of the granule loss is circular shaped (being explained away as caused by a boot turning), there was also lots of granule loss along the edges of shingles on the south side.  Their photos do not document the granule loss on the shingle edges but my photos do show this.

I do appreciate the more in-depth explanation than what was received previously when Malarkey said "The granule loss is due to scuff marks" in the reply letter.  The process took months to complete and was disappointing.

      Sincerely,

      ***** *********

      Business Response

      Date: 11/22/2024

We regret that you had issues with your roof, and we are disappointed to learn that you replaced it. Our inspection showed that the roof looked good except around the solar array. The inspector only noted two shingles that showed granule loss. In the pictures that you submitted, we saw one shingle with granule loss, and since it is unclear whether it is one of the shingles the inspector called out, we will give you the benefit of the doubt and call it three shingles. We do not see the purported granule loss at the edges that you cited. Based on decades of roofing material experience, I am confident that the marring you see on other shingles is not granule loss; it is foot traffic.

As a manufacturer of sustainable, environmentally friendly shingles, we are always delighted when homeowners want to take it further and put up solar panels. However, because Malarkey shingles are different from other brands, extra care is called for when walking on them in warm weather. Malarkey makes all polymer-modified shingles, which have improved granule adhesion, yielding a better life cycle than traditional shingles, but they can be more susceptible to foot traffic in warmer weather than traditional oxidized shingles. Roofing contractors usually know  how to walk on the roof without causing damage and, indeed, have special types of shoes they wear to avoid damaging the roof, such as Cougar Paws, or even a flat soled tennis shoe. Unfortunately, many solar companies are not familiar with roofing shoes and may use traditional work boots, which can easily cause damage on any shingle, even when the weather is not particularly hot.  This was the major problem seen on your roof.

In situations like this, where only a few shingles need replacement, we typically would pay a contractor to replace those shingles, rather than do a total roof replacement. Because the shingles were still performing, replacing the entire roof was not necessary. Replacing certain shingles typically costs about $250-$400, so we can offer you the high end $400 to resolve this claim.

      Customer Answer

      Date: 12/02/2024

We replaced the roof due to solar panel failure.  Our solar system needed to be replaced due to delamination.  I consulted with 6 different roofers/contractors all of whom said that the south side shingles needed to be replaced as they did not have enough life in them to mount a new solar system on top of.  All of these roofers/contractors cited granule loss. So the shingle issue was discovered as part of the roof assessment and the roof was replaced because it did not have the needed longevity.  We chose to replace the entire thing because it did not make sense to only replace the south side and then have a roof that has halves of it on different replacement timelines, thus increasing the cost.

This response finally acknowledges granule loss which I appreciate - although it says it was present on two shingles based on inspection and one based on my photos. Clearly, I did not take a photo of every roof shingle that had issues as this expectation was never communicated to me in the warranty process (that took almost three months to complete.) The photos show widespread damage on the edges of shingles on the south side...well beyond three shingles and well beyond foot traffic issues. I trusted the process and the inspector to submit an accurate assessment of the issues.

Malarkey's offer of $400 compensation is not adequate.

      Thank you.

I filed a claim at the end of April regarding the defective Malarkey shingles that were installed on my property. Despite being initially informed that an inspection would take "a few weeks," the process dragged on for months with little to no communication from Malarkey. After countless emails and phone calls, I was eventually told that the timeline for resolution was 2-12 weeks. However, at ****************************************************************************** the lack of communication.Following the completion of the inspection, Malarkey offered only partial payment for the replacement of their defective shingles, despite months of back-and-forth. I reluctantly agreed, only to find that I have not received any information about the reimbursement check that was supposedly mailed to me. This company consistently fails to deliver on its promises, engages in deceptive practices, and provides the worst customer service imaginable.

We purchased Malarkey Vista high impact class 4 shingles due to the warranty and cost cut on Insurance August 2011 they were put on our brand new home we had built. I saw my light fixture in the garage full of water. Called my grandson who is a builder he went in the attic and was leak from roof. Called out 2 roofers and ****************** The adjusters and both roofers explained it was a defect in the shingles they are blistered. These blisters are covering our entire roof. We did pay to have a temporary fix this was the end of Feb./March 2024. Our roofer then began to try to get these warrantied with little to know response. I filed a warranty inspection claim & have been told they have to get more claims to justify a flight to come look at them. In the meantime, I am 81 years old climbing in attic making sure we do not get MORE damage on a single we paid additional for with Absolutely no support or help from Malarkey. I ask if they could at least give me a date and NOTHING! At this point I do not care if they come or not but they must get ahold of our roofer who has all the info and tons or pictures showing the defect and get this roof replaced! It is their product, their warranty if I have a fire over wet electrical or more serious damage it will be their fault. I really do not want to be nasty or hard to get along with but want a resolution. ********************* Luxury ********************************** ************ c **********, Tx

Please close the complaint, after sending 23 pictures and very slow response the warranty adjuster did come out today and stated these are not their shingles. I am unsure why the Insurance adjuster said they were or Why this company did not recognize from all the pictures but it appears they do not belong to them.

When our inspector was on the roof, he was able to clearly identify the company who manufactured the shingles, and it was not a Malarkey shingle. There is a tape on the backside of the shingles that very clearly states the manufacturer. I was told the homeowner was given that information. I am not sure why the insurance agent and /or roofing contractor could not do that to correctly identify the shingle. If a contact is needed, the homeowner can contact us to get the information. The company can be contacted online.

In August 2023, I was on the roof of my house when I noticed that there was a problem with some of the shingles. Many of the shingles appeared to be shedding the granules, revealing fiberglass on the shingles. This roof was installed May 2008 with a 30 year lifetime warranty.I contacted the ************* responded immediately. An inspector was sent to my house to look at the suspicious shingles. The inspector went directly to his supervisor who then came out to do another inspection. It was definitely confirmed that there was something wrong with the shingles & these shingles were located all over the roof. It was determined the damage was not weather-related. The roofer came back with an offer on roof replacement, which was not satisfactory. It was time to involve the manufacturer of the shingle, Malarkey Roofing. The beginning of October a representative came out from Malarkey Roofing (******, ****). He removed several shingles to send back to ********, ****** for testing. He was overnighting the shingles to their lab & stated that we should have an answer within a week. Three months later & we have not heard a word from Malarkey. Our roofer gets a weekly text from my wife asking the status of our roof. The roofer came back with another offer, which we rejected. Malarkey needs to be involved in this process since the damaged shingle is their problem. To date, Malarkey has been silent & will not even return phone calls/messages from our roofer. It is clear that they do not want to rectify this situation & have very poor customer service. We have been dealing with this situation going on six months. This issue should have been rectified by now. Malarkey doesnt seem to have any interest in providing customer service to me or the contractor (Able Roofing). I have noticed that Malarkey has had similar complaints elsewhere (out of state) & were either silent, rude or didnt give satisfactory compensation for their substandard materials. Through BBB, I am hopeful that we can come to some sort of restitution between the contractor, *************************** so that a new roof can be installed this spring free of charge as stated in the original warranty.

The claim is actually a claim with Mr. **** and Able Roofing, not Malarkey. ********************** information was not included in information that was sent to us, and we have not received samples. Mr. **** was a private label customer for ********************** years ago. The company, Mr. ****, sold a few years back and it was our understanding they were to honor the warranties of the prior owner, but we are not sure of the terms of the sale. We will try and get in touch with Mr. **** to see what their plans are. At the time your roof was installed, Malarkey offered a pro-rated settlement, which we would be willing to honor, but we will see if Mr. **** will honor their warranty. We should have more to report to ****************** soon, now that we have his information.

We are working with the installer, who had their own warranty on the materials. Malarkey's warranty was different than the installers. We have finished evaluation of the product that was submitted into the lab. There was a chemical present on the shingle that should not have been there (urea / uric acid). We are working with the contractor and we anticipate they can fix the roof in the spring, but I don't have confirmation on that. .

It appears the shingle product had a defect as reported in a response from the manufacturer, Malarky.  They stated they will be in contact with the installer.  No other action from me is needed at this time.  I will allow the manufacturer and the installer to handle this issue.

Gutters are cleaned yearly as normal. My neighbor had his done at the same time, same roof, different color, and he noticed excess granule shedding so he checked mine and I have the same issue. I sent pictures, warranty copy, copies of all paperwork completed at the time, warranty was registered with the company, all the Malarkey. That was received by *********************** in claims on 7/24/23, claim #*****. They had their inspector check both our roofs and take pictures on 7/25/23. I followed up them 8/11/23 and was told it's with the claims manager on his desk. My neighbor also followed up in August and the person who responded said the same thing, was rude, and hung up on him. It is now 9/20/23 with no response. There are complaints now on the internet abut Malarkey roofing shingles loosing excess granules and it appears they treated those complaints the same way.

We regret the delay. Due to the heavy storm and hail activity, we have had more claims than normal. We have hired on additional staff and should be getting back to you shortly. Please keep us informed if you do not hear back from us within 2 weeks.

I am rejecting this response because:  There has been no recent rain/hail events in the Denver ***** area.  The complaint to the company is several months old now and the company has ignored the complaint  probably hoping I will go away.  I feel the product is defective and want it rectified. If defective roofing shingles are not corrected building problems can escalate and this is through no fault of my own.  I will also apply negative comments on the internet to beware buying this product and the non-response with warranty from the company.

      Sincerely,

Malarkey claims manager, ***********************, sent an offer of replacement of the roof, via email dated 10/4/23.  They have requested a detailed estimate to replace the roof.  This is the outcome I asked for and it is acceptable.  Certainly not done yet but I do have it in writing, from the claims manager, on Malarkey letter head.  I thank BBB for assistance and believe your part has been accomplished.

We had a new roof installed in June 2009 with MALARKEY shingles permit at ***********************************************************************************************************************. Over the past year we have noticed that after every rain the path around our home is covered with granules from the roof. In November 2022 we noticed a few shingles fell off the roof. We had a licensed reputable roofer complete an inspection and he showed us the shingles were brittle and would snap if he bent them. He advised that most of the granules had come off the shingles and the fiberglass was now showing. He indicated we would need to replace the roof sometime soon otherwise we could have a potential leak. There is also discoloration on parts of the shingles (looks like green algae). We contacted MALARKEY ROOFING as the warranty showed we had a 30 year warranty. We sent pictures to Malarkey; however, they did not spend an inspector but instead offered us $1,106.82. I contacted them again (see their response below). We have only had this roof 14 years and are now having to put in a new roof. $1,106.82 is nothing towards the cost of a new roof which is in the *****k price range. We have heard from the roofer that he has had to replace many Malarkey roofs due to similar issues. Is there anything we can do? "We understand the circumstances of the roof may be beyond loose granules and that our offer does not cover the cost of brand-new roof. The amount we offered is the most that can be recouped to you under the terms of your warranty and include the entire size of the roof. As indicated in your letter and your warranty terms, the Right Start portion of the warranty has expired and any settlement at this stage is pro-rated based on the cost of materials only. Unfortunately, our offer cannot go beyond this amount. Once we receive the signed settlement agreement returned, we can forward to our accounting department to issue payment."

We do apologize for the problems the ******** are seeing on their roof. We actually see very few of these complaints. I have attached a letter, the warranty for the shingles as well as the original offer to the ********. Malarkey believes we have gone above the warranty requirements with the offer, but we do understand the homeowner's disappointment. The warranty does not provide coverage after the Right Start Period for a roof that is not leaking, and yet Malarkey offered the ******** the maximum payment allowable under the terms of the warranty, $1,106.82.

I am rejecting this response because:  this is the same offer they gave to **.  Do I need to wait until the roof leaks before they will honor their defective product.

      Sincerely,
