    On 11/15/2023 my grandmother in laws keep was damaged in an accident. It was rear ended from behind. The driver was taken to the hospital and the police had missionary auto tow the vehicle to their shop. Nobody was asked where to tow it and nobody requested missionary be used. They towed the vehicle less than 2 miles and when my grandmother reached out a couple hours later to get the car they told her she needed $400+ in cash. They would only accept cash. They refused credit card despite displaying they accept credit card. They refused it despite consumer protection laws saying they have to accept it. When I called to talk about it, both Tom and Chris were rude and dismissive. They made it clear they didn’t care about law. Chris said that’s the price to get your car back and hung up the phone. It’s predatory and illegal.

    A tow was ordered by the Brentwood Borough Police Department after a crash occurred on a state highway. We are licensed, bonded and insured to tow and store vehicles for this Borough. We will accept credit cards and company checks from businesses for impounded vehicles. The company policy does not permit credit cards be used  from private individuals for impounded vehicles. The company policy is clearly displayed in writing at our office. The policy and procedure to pick up the vehicle was plainly and professionally explained to three different family members each time that they called in reference to this vehicle. 

    The registered owner of the vehicle arrived at our company on 11-16-2023. The vehicle was returned to her without incident.

    I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    The business admits to not accepting credit card payment for the vehicle that was towed. They admit the owner did not call to have to the vehicle towed. They suggest it’s posted they do not accept credit card but the owner did not request the tow or visit the site until the car was towed and locked behind a fence. It is against consumer protection law to refuse credit card in this circumstance. It’s predatory towing and in violation of Pennsylvania Statutes Title 73 P.S. Trade and Commerce § 1971.3
