    Agreement 1/22-12/22 22 Aug it was asked to terminate with 30 day notice Mess Management was not willing to allow out of agreement or negotiate / mediate new terms and cleaning date but wants to hold me to 3 months of unpaid service even though there is no damages incurred on their behalf. I wanted to allow them out of the agreement due to very bad service. They were not cleaning as described. Wanted to transfer services to but they were not willing to move time and there services were horrible Mess management was un willing to be flexible and therefore should allowed me the 30 day notice to terminate without penalty. Especially if they cannot prove damages. Account is address

    Business Response /* (1000, 5, 2022/10/05) */ ** ****** freely entered into an annual (12 months) cleaning subscription with Mess Management cleaning services LLC. Our contract clearly states that the client may terminate service and deny entry but will be held financially responsible for the remaining service appointments left in the agreement. ** ****** terminated services via email stating that he decided to move out and rent his home and for that reason alone he wished to stop service. He did ask if we would allow his tenant (renter renting out the residence) to assume financial responsibility. We gave the tenant several opportunities to assume responsibility but the tenant declined via email and via voicemail (all documents saved and on file). We made several unsuccessful attempts to rectify the situation via email and via phone calls). We have no record of *.****** being unhappy with service. Before signing our annual agreement not only is it stated in big black bold letters at the top of the contract but we also verbally encourage prospects to read understand and only sign if they agree to the terms and conditions. This situation is unfortunate but we have to protect the interest of our business by holding *. ****** accountable to the service appointments he committed just as he would hold us accountable if the "shoe was on the other foot". Consumer Response /* (3000, 7, 2022/10/07) */ (The consumer indicated he/she DID NOT accept the response from the business.) Section 5.4 Cancellation notice of 30 days. This was given in accordance with the agreement. This section highlights it was created due to repeat offenders of cancellations which we were not and it is stated that the spirit or intention for this section was due to an increase in last minute cancellations. For this reason why would Mess Management choose to exercise this position. We were in good standing and asked to maintain the agreement after Mess Management wouldn't take an ethical position of accepting a noted industry standard 30 day notice giving them plenty of time to replace their lost business. We asked to keep the agreement and switch the cleaning time at which time Mess Management would not be flexible knowing they could exercise a position to obtain 3 months of cleaning fees for doing absolutely nothing and claiming they were to busy to move the time. Mess Management did not act as stated in their response. They did not give several opportunities to mediate an acceptable solution and why would they when they can lean on doing nothing for free money. It was not ever an intention to cause them to lose business and I would move that this would not stand if damages had to be proven for the loss of our business. We wanted to keep the service and rectify the issues by switching the cleaning time where we could monitor the cleaners while on property. I argue the ethics and the customer service culture is the real mess that needs to be managed.
