On 8/31/2022 I placed an on-line order for 1/2 hog with the seller through his website. I filled out the cut sheet, paid for my order, and scheduled pick up at 10am 12/1/22. I drove an hour and a half to the pick up location in Dandridge and arrived, on time, at 10am on 12/1/22. Employees were filling orders for delivery from the sellers freezers, using cut sheets. I told the young lady in the office who I was and she said she didn't have an order for me. Jason claims I refused to identify myself by giving them the credit card I used for the order but that is untrue. I gave her the card so she could search for my order but she was unable to find my order, or my cut sheet. She told me if I had a legitimate order I'd have to fill out a new cut sheet, but she told me some of the things they didn't have, at least two of which were what I ordered. After more than an hour searching for the order, the young lady was becoming more stressed and agitated so I told her I'd go back home and find what paperwork I had for the order. I was in no way "difficult" as Jason Has stated. I have filed a dispute with the credit card company but the response they got from Jason is so full of misstatements that they are hopelessly confused. When I got home, I found my receipt from Bryant Beef and my credit card records. I called them back with the information and faxed them the paperwork. Again they insisted I fill out another cut sheet. The young lady I spoke with earlier in the day was extremely rude and antagonistic to my wife and we decided it would be best since they lost our order and didn't have what we wanted we just wanted our money back. Jason was not present during any of this, so his information is either second hand or simply fabricated in an attempt to keep both money hi is not entitled and the product he was obligated to provide. I did what I was supposed to do, tried to help locate the order, and he did not. He claims he donated my order. What did he donate?

Customer placed an order through our website. Customer came to pick up their order and would not verify themselves at pick up. Customer was rude and later verified their identity for conformation to pick up their order. Customer then refused to come pick up their product out of our storage facility.

    Customer Answer

(The consumer indicated he/she DID NOT accept the response from the business.)

The response from Bryant Beef is absolutely false. He claims I drove and hour and a half each way (3 hour round trip),stood in the office for an hour and refused to identify myself. In his response to my dispute claim with the credit card company, he claims I refused to give them the last 4 digits of my credit card number as ID. In fact, I handed the clerk the actual credit card so she could try to trace the order. I did everything they asked to help find the order, which they were never able to do. I later that day sent them the receipt for my order and my credit card record verifying my order was legitimate and I was not attempting to steal anything. I did not identify myself later as he falsely claims. He's trying to hide the fact that there is and never was an order set aside for me. Jason has no idea what I ordered and can't tell you what items I selected on the cut sheet because he lost it. Ask him! He managed to hang onto the $391.40 with a death grip, but never processed my order. I've included the dispute records from the credit card company dispute someone can read to get a better understanding of this situation. What makes more sense, I drove 3 hours, stood around for an hour refusing to ID myself while being accused of being a thief, and sacrificing the payment, or is it more likely the order was misplaced? Bryant Beef has both the meat I ordered, which in no way would I dare consume a this point, and they have my money. How is that right? Citi Bank agrees with me that the refund should happen, but they are powerless to force his bank to return the money. Jason also makes claims about a refund unavailable because it goes against Tennessee agricultural law. I can't find anywhere on his website where it talks about the law he references, but it wouldn't have mattered, I purchased the meat in good faith expecting to pick it up 12-1-22. They have not tried in any way to contact us to pick up the non-existent order as he claims. No emails , no missed calls, nothing from Bryant Beef. Another incorrect claim. He also claims in his response to Citi bank that if I don't pick up the order before 12-9-22 he will donate it. We didn't get his response back from Citi Bank until 12-15-22 , so according to him it's gone. He can't do that during a credit dispute. Ask him what he donated and to who. He has no idea what I ordered and can't tell you. If he claims he didn't donate it, then according to him it's still in his freezer. Simply ask him what it is. Below is the Credit Card Dispute:

    Product Description

Customer purchased a live share of a hog from our company. This purchase under Tennessee state law is a non refundable

transaction once ownership has been transferred and the pork has been harvested it becomes no longer refundable. The

customer was asked to give the last 4 of their credit card number for their purchase whenever they arrived to pick up their

packaged pork to verify they were the correct recipient for this purchase. The customer would not comply to verify their

purchase and made a scene with our office personnel and left. Later that day the customer sent over verification from the

phone number on file for their account to prove they were the purchasers. We informed the customer that it is standard

protocol to verify our bulk package sales to make sure no one steals orders and we informed them they would need to pick

up their package. The customer has refused to pick up their package and is continuing to cause a scene.

We will not be refunding this order as it goes against Tennessee agricultural law, we are continuing to contact this client

during office hours to try to get them to pick up their package from our freezers, if the package isn't picked up by Friday

December 9th we will have to donate the packages as we are not set up for long term storage of clients products.

Our website states under our bulk package page that all bulk shares of livestock are non-refundable under Tennessee state

law at the time of purchase, and our donate clause for customers who refuse to pick up their packages within a timely

manner is also stated on our page within the same page. We do not wish for this to result in lawsuit but we will also not be

on the wrong side of it, we legally decline the request to refund a custom harvest processing transaction.

On top of continuing to contact this customer to ask them to pick up their product this week, I will also reach out to the

Department of Agriculture to ask them to explain to the customer that this is not a refundable transaction to try to further

encourage them to come pick up their package before we have to remove it from our facility.

MY response: On December 1,2022, at 10am, my scheduled time for pickup, I arrived at Bryant Beef. There were three employees present, one young lady running the office, and the other employees gathering cuts of meat for delivery. When you order a full, half, or quarter beef or pork, they do not harvest the order from one animal. They have freezers filled with the various cuts of meat and pull the orders together from the freezers according to customers cut sheets. Your cuts of meat are not necessarily from one animal. It's from cuts from several animals they harvest according to what's been ordered. That's why it takes one to two weeks to complete an order. As orders come in they harvest the animals and produce the cuts of meat they need. They replenish their freezers according to demand. I mention this because I watched orders being pulled from the freezers according to the cut sheets, and another customer came in to pick up their order and made their selections from the freezer. The customer was not asked for any ID, in particular a credit card number to pick up their order. None of the orders are set aside for a customer in a bundle as Jason claims he did with my order. When I told the young lady who I was and that I was there to pick up my order, she responded "you're not on the list, I don't have an order for you". This is where Jason claims I became difficult and refused to identify myself by providing the last 4 digits of the credit card I used to pay for the order. Jason makes several claims in his response that are simply untrue. A drivers license would certainly identify me and they never asked. He was not present as he was in his other location many miles away in Watauga, TN. All of his information is second hand, or simply made up. I had no reason not to give the young lady the last 4 digits of the credit card I used since they should have already had it. I did not refuse to give her my credit card number and in fact handed her the credit card so she could search her on-line orders and find mine. She called Jason several times while she searched for my order, using my credit card in hand. I wanted my order and didn't refuse to cooperate. I complied with everything they asked to help find the order.

My order was never found in their computer and they have no record of my order except for the receipt I sent them. They lost my order. No meat was ever harvested for me and therefore couldn't be taking up any room in his freezer. I did not make a scene and have had no contact with Bryant Beef since filing the dispute with Citi; so, his claim I continue to cause a scene is once again totally untrue. Though Jason claims to try to contact us, that is also untrue. We have no missed calls, email, or messages from them. I was in the office while the young lady searched for my order and she became more frantic and frazzled. She told me "if" they found my order I'd have to fill out another cut sheet but that they were out of some things, two of which I knew were requested on my order; so, I was going to have to modify my order. I declined to fill out a modified cut sheet and told the young lady I'd go home and find the order history from Citi to prove I'd placed an order. I did not storm out leaving my order behind as Jason claims. I did not refuse to identify myself to prove I had an order, I gave her my credit card to assist in finding it, but they simply lost my order. Again, the only record they have of me placing an order is the copy of the receipt I emailed them. They never processed it, they never harvested any meat and set it aside for me, and claiming to have donated it to clear up space is another untruth. He's making that claim to be able to keep the payment , and be able to sell again the part of the animal he didn't provide for me. I did exactly as I was supposed to do. I filled out the cut sheet, I paid for the order, and I scheduled a pickup date and time. I was where I was supposed to be when I was supposed to be there , expecting to pick up my order but Bryant Beef did not do what was required of them.

Is a merchant not required to provide what a customer paid for, agricultural law or not? can they just keep the product and the money on a whim? Jason ******** statements are entirely false, an attempt to keep
