We have had a long-standing relationship with ***. Weve spent hundreds of thousands if not over $1 million working with them. On Friday, September 12, 25, we had 66 yards of concrete scheduled for a job in ****** *********. After our second truck was delivered, unbeknownst to us thelocal plant supplying our concrete had went down. We didnt find out about the issues at the plant nor the associated delays in concrete delivery until nearly 2 hours after the second truck arrived. Every truck after the second one had around 1.5 to two hours of turnaround time. We were barely able to save most of the concrete pour. The very last load that they sent us was so late and the concrete mix was so dry that we were not able to use it. Our customer has no confidence in the ********************** and wanted us to rip it out and repour it. We were able to convince the customer to let us repair it. We asked SRM to cover the cost of the concrete (5 yards), and the cost of repair materials (we were going to cover the repair labor, not because we were at fault, but to help keep the project moving quickly). After meeting with our sales **** a quality control manager and another manager from ***, they let us know that they were not going to be helping us out with any of the repairs and would only supply us 5 yards of concrete for free, leaving me to handle the bill for the rest of the repairs which are necessary because of their delays and inability to communicate with us. If you notice in the attached picture, we have a trowel machine still trying to finish concrete while the concrete next to it has hardened enough to cut the expansion joint. This should never happen. Due to the inconsistency of the concrete that we were finishing, there are low spots in the concrete which has to be leveled as well as cutting out and pouring the 5 yard repair. Also, we have to cover the entire slab with an epoxy coating to regain continuity.Business Response

On September 12, 2025, our Dayton plant experienced an unexpected outage that caused delivery delays. The crew onsite was notified of the issue while we worked to restore operations.
All loads delivered met *** specifications. The only concern raised was with the final call-back load, which was ordered for 6 yards when 7 were actually needed to finish the pour. This shortage, along with timing, created finishing challenges.
To assist, *** offered multiple remedies, including 5 yards of free replacement concrete, a rebound hammer test to verify strength, and even removal and replacement of the final load. These offers were declined. Despite the delays, the slab finish was completed successfully.
We regret the inconvenience this caused, but stand behind the quality of our product and believe our resolution efforts were fair and appropriate.Customer Answer

I am rejecting this response because: While Smyrna Ready Mix did offer us 5 yards of free concrete (which we accepted, the cost of this repair is well beyond the $775.00 of concrete they're offering) and the rebound test, however, these accommodations don't even come close to the cost of making this right for the customer, all of which falls directly on me. Since the trucks were delayed so much, we were attempting to finish new concrete next to hardened concrete which cause our trowel machine to dip and deflect from the level plane required for a flat, monolithic slab. We have an area approximately 128 sq.ft where water is ponding 1/2" deep. The last truck they sent was so far delayed that it was unusable to reestablish the level value of the pad with new concrete. Because of this issue with the slab, I now have to re-level the low spot(s) with a hydraulic leveler and cover the entire ***** sq.ft slab with an epoxy coating to regain continuity. Again, these issues are a direct affect of the concrete trucks being delayed. Also, to restore customer confidence and alleviate his warranted desire to pull the rest of this $110,000.00 project from us, all of the repairs are falling squarely on me. I reached out to ***** ****** (Sales **** for SRM) and asked for them to cover the cost of the epoxy coating and I would absorb the labor costs, the answer was a quick "No, I'm sorry...". We have done hundreds of thousands of dollars worth of business (possibly over $1m) with SRM without issue, and now they won't even assist a faithful customer with less than $8,000.00 worth of repairs to make this right.In short, yes they informed us about the plant issue when one of the replacement drivers came to the job site from the ****** plant. No call from dispatch to let us know about the situation or the resulting circumstances. They know and understand concrete, and the mix that we were pouring, under the conditions that we were pouring in, was not able to be poured 1.5 to 2 hours between trucks. The ***** psi mix and low humidity demand that the concrete be poured much quicker than they delivered. They were aware that these conditions were present and they knew that the concrete would ****** before the next truck was on site. If we would have had a heads up about the delays, we could have bulk-headed our pour and made time for another pour on another day. Lack of communication and lackluster delivery performance have nearly cost me my business. We are a small operation and we're being taken advantage of.

This is a very sadistic business that makes employees work like crazy slaves , they dont follow any state regulations at all and they treat them like slaves. It is unbelievable that this type of business operates in 2025Business Response

On 5.19.25 at 6:57 a.m. driving between **********, ** and going towards *******, just past the ********** station, one of the *** trucks, truck 786, did not stay on the road and went onto the shoulder going over all the rumble bumps with its left tires. When it did this my car was showered with rocks and the last rock that hit my windshield and caused a chip with cracks radiating from it. I had just gotten my car repaired for being rearended and now this happens. I called the company and spoke to an **** Such who told me that I would be contacted by someone in the company with 3-5 business days. That was at least 3 weeks ago and I have not had any communication from them.Business Response

We reviewed the report regarding the incident on May 19, 2025, involving SRM truck #***. After careful consideration, we must respectfully deny liability for the damages described.
Our trucks are operated in line with all safety requirements and are equipped with mud flaps and other devices designed to reduce the chance of debris being thrown. Rocks and other materials on public roads, however, are common conditions outside the control of our drivers or the company. On May 2, 2025 I received certified mail notice of a lien being placed on my property by Smyrna. Prior to this notice there was no communication from Smyrna. I hired ****** Excavation to add a driveway extension and sidewalk. They may have used Smyrna to supply the concrete but I had no direct contract or communication with Smyrna. I have attempted to contact ****** about this but get no response either by phone or email and there was no one at the office when I went there. The work by ****** was paid in full as per our contract after the job was finished.Business Response

I contacted ******************** who came out and gave us an estimate to rip out our old patio and replace with a new one. This was on 06-28-24. This contractor works with ***, and they came out to pour their concrete, on August 1st. Weather was fine, and dry. We followed all instructions on after the pour. Following year spring we noticed the concrete crumbling or what they are calling it scaling. We are devastated over this as this job cost $6000.00. We called, ******************** to complain who then called SRM. It took awhile but finally *** the salesman for *** came out and gave us the same speech he gave past customers who had same problem. And quite frankly it was more of a social visit than a problematic solution to a problem. Our contractor from ******************** told us, *** used cheap concrete. And he stated there was another pour the same day and those customers had the same problem. Which we noticed a problem when it was curing but thought it was just taking longer. Now its all chipping away, getting worse everyday! *** stated right out, that SRM was not going to rip anything out, that our drain pipe caused it, and if not it was the weather from mild to cold temperatures and moisture under the concrete causing the problem. We have never had a problem there from the old concrete, I just wanted to put concrete against the house so I would not have to plant there anymore and it was suggested we change the pitch. Now we have to look at this mess for $6000.00 I will not settle for their solution of doing nothing. If they dont fix this we are contemplating the advise of an attorney. Smyrna Ready Mix Concrete, LLC (SRM) is a ready-mix concrete producer. *** does not finish concrete or select the concrete product to be used in a particular customers application. In this case, the homeowner and/or their contractor ordered concrete to their specifications from ***. SRM delivered the concrete that was requested and there is no allegation that the concrete failed to meet the specifications that were ordered. Concrete scaling is primarily caused by freeze-thaw damage (which would be exacerbated in this case due to the presence of the homeowners downspout directing water over the concrete pad), poor finishing practices, and/or improper curing. Therefore, the scaling observed by the customer is very likely a result of poor choices made by parties other than ***.Initial Complaint

I was driving I-24 West near **************** when truck 741's loose rocks practically jumped from the truck bed itself and put multiple chips in my brand new windshield, along with another vehicles. The driver pulled over and was very rude, running his fingers over my windshield and asking if I had a camera to prove it. I contacted the company immediately when it happened and there was a supposed contact of the 'Safety Manager'. I have had no contact or response from this manager. This occurred at 7:16AM on a busy highway. Hopefully *** makes this specific employee perform better safety checks especially because people can no longer afford to take the brunt of making repairs from an apparent multimillion dollar company.Business Response

2/25/25- is when this incident happened, so I am reaching out due to lack of communication of the company, and the training that they may not have in place. So, the ** working at my house ordered the concrete and the remainder of his guys do not clearly speak English, with that being said maybe some miscommunication happened between them not sure. But what I do know is the camera footage from the truck (the company says) shows the guys giving motion to move up. I do not know, as I was working but there is a blame game going on between them, and I am very disappointed on the communication and ownership from ***. The owner of the ** company has offered, to help repair and fix already and all SRM did was fight to get out of it when part of the problem was their driver. He was on the phone playing with that as well as not being able to quite understand the guys working, but as a driver driving a 30k truck, you would think that it would be part of their training to enforce they get out of the truck and simply ask a question or two like where can I drive?, or like maybe if there is a septic tank or not. Right now, I have small children and tank is wide open. I have placed a piece of plywood over the whole for now. But this could be a safety, and an environmental impact. On December 31, 2024 *** was delivering concrete to my home and drive was told to stay put driver decided to driver over my lawn and sidewalk creating significant damage to the lawn and sidewalk. When contacting them they ***** much ignore all phone calls and messages till I finally got the number to corporate and complaint to the *** about what had happened and he did nothing the area manager to *** also didn't care and said they were not going to fix the damage that they caused. I am rejecting this response because, the driver was told in the surveillance that wheelbarrows would be coming to the driver regardless of signature it's common sense not to know to run over someone's grass and sidewalk. As I stated before *** is responsible for the grass damage so I work damage.

Our mixer operator reported the following statement:
"On December 31, 2024 when I arrived at the job site, one of the crew members told me where I should position the truck to deliver the concrete. So I indicated to him that there was a risk of cracking the sidewalk, so I asked him to sign both the square box, the receipt, and the release of liability for property damage. Once the owner of the property saw that the concrete was broken, he told me to take the truck out."
The video is consistent with the operator's testimony. The ticket was signed, and it is attached here.
The customer signed the property damage release on the ticket agreeing to the following language printed on the release: It is the policy of Smyrna Ready Mix Concrete to Guarantee Delivery to the curb only. We will not be held responsible for towing bills for stuck trucks not on public roadway, damages to driveways, sidewalks, buildings, parking lots, trees, or property after leaving the curb. Furthermore, the undersigned agrees to pay for any towing charges incurred after our trucks leave public roadways."
The customer signed this ticket before the operator pulled onto the property, releasing SRM Concrete of liability.

One of their trucks, which is truck number 759 which is a CONCRETE company some concrete and rocks came out of his truck and put a crack in my windshield. I have contacted a couple of people and they are trying not to pay for my windshield. They are a concrete company and I believe it is their responsibility to replace my windshield.Business Response

SRM Concrete is sending out bad concrete. They sent out quality control and admitted it was bad, we cut it out, then upper level management denied to repair it. I have the recording of QC. They will not warranty their product.Business Response

Smyrna Ready Mix Concrete, LLC (SRM Concrete) ***************************** sent a sample of the concrete to have a petrographic analysis done, and the report showed nothing was wrong with the mix. Rather, Mr. ********* failure to properly finish the concrete and plan for rain in the forecast on 9/25/24 (forecast attached) is to blame for the poor finish on the slab. I am rejecting this response because:This response is Not what happened please listen to the recording of my meeting with Quality control from SRM. At no point did this slab have any low areas or did the employees that came out from *** say that . The area in question was squeegeed off after 48hrs of not drying. This was the top ,approximate, 1/2" to 1 inch of the concrete. Even if the concrete tested out, the employees from *** didn't even want to test it stating that there was no need to(meaning they can see it was bad). they stated that after it gets removed that they will prioritize to get me the 14 or 15 yards to replace it back. Well that didn't happen after being on the schedule to do the repour, I was notified that morning that I will not be receiving any concrete to replace the "bad" concrete. The new manager *** ****** has been very unfair and very unreasonable. I have now hired legal council to represent me. I honestly hope this goes to Jury trial. (If I didn't have this recording I would have been stuck with no recourse of doing what I was instructed by **** employees.) they could have easily settled this with a credit to my account and I would have continued to use them but I've since hired Titan Concrete and have poured over 70 yards with them on just this project.

Smyrna Ready Mix Concrete, LLC (SRM) is a ready-mix concrete supplier. **** obligation is to deliver concrete that meets the specifications indicated by its customers.SRM has not been privy to the recording referenced by Mr. ********* however,*** does not dispute that the finished concrete Mr. ******** is complaining about had issues that were observed by SRMs quality team.
After observing the issues with the concrete, SRM ordered a third-party petrographic analysis. A petrographic analysis provides an in-depth look at the mineralogical and chemical composition of the concrete. In other words, it examines the qualityof the concrete. The petrographers report concluded that the concrete did not have any quality issues, and it met the specifications indicated by *********** when he placed his order. Practically speaking, this means that any observed issues with the finished concrete were a result of finishing errors,including, but not limited to, low points and the finishers failure to properly prepare for inclement weather.
