28. Objective Superlative Claims
Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, "Nashville's only pediatrician recommended nanny agency!" can be proved or disproved.
BBB's Code of Advertising requires businesses making such claims to be prepared to supply proof. BBB requested the business' voluntary cooperation in providing documentation that supports the advertised claims of "Nashville's only pediatrician recommended nanny agency!" BBB advised the business if it could not provide this substantiation, BBB asked that this claim not be included in future advertising or to be modified. However, the business failed to substantiate, modify or discontinue the claim.
