I looked at my credit report and noticed an account that was not reporting accurately. Please accept this formal letter as my first request to investigate and remove derogatory accounts/items from my consumer report. Going over my report, I have found it has errors. It has come to my attention that you are reporting what I believe to be inaccurate data, which I dispute, and this letter is an appeal for your assistance. As a consumer reporting agency 15 U.S.C. $ 1681a(f), you are governed by the Fair Credit Reporting Act ('FCRA"). 15 U.S.C. 1681, et seq., which protects consumers from inaccurate, outdated, or invalidated information reporting of their consumer file. The **** states that it's the consumer reporting agency's responsibility to ensure that all information contained within consumer files is accurate and free from errors. Your company is regularly engaged in the business of assembling, evaluating, and disbursing information concerning consumers for the purpose of furnishing consumer reports, as defined in 15 U.S.C. $ 1681(d), to third parties.

This company ran my credit report (6) times in one day, June 1, 2024. I have no business with this company nor have I asked for credit or a loan from anyone. My credit report is frozen as to intrusion issues with my personal information. Many data breaches with several accounts have been breached of my personal information including my personal law enforcement records and affidavits with state and federal authorities. I have active military alerts on all three of my credit reports along with opting out of any advertising or soliciting services from all three credit reporting agencies, which includes soft pull inquiries. This company, without my permission or knowledge, ran or pulled a soft inquiry of my personal credit six times in one day. I’ve already filed a complaint with the department of consumer affairs on 08/03/2024. That complaint # is ***************. To date, 09/04/2024 this company has still not responded back to that complaint, (see attached). This company sent me a letter dated August 24, 2024 that I just received today in the US Mail , requesting information related to a request for a copy of my Clarity credit report!! No, I never ask or request such information from this company, Clarify Service other then the complaint to the department of consumer affairs, not a request for a credit report. I don’t even know this company exists. I receive my credit report from Experian, Equifax an TransUnion directly from them with a log in as a member. I have no idea how this company is or why they ran a soft credit pull from my personal credit report 6 times on obe day. As a law enforcement official, my personal safety as well as my family is paramount to my identity and responsibilities. Since I haven’t received any response yet from the complaint with department of consumer affairs, I’m filing this complaint with the BBB to demand this company explain why they did a soft pull of my credit report without my consent, knowledge

    Customer response

    09/05/2024

Attached is a copy of a receipt letter I received from this clarity, requesting additional personal information from me as to , they say, I request my clarity credit report.  I never requested such and will not provide this entity any personal details or information of me.  They need to explain WHY there name came up on my credit report as pulling a soft credit report. Period.  If they refuse to this explanation, I would request that the BBB immediately report this company/ entity to the federal trade commission for further investigation

    Customer response

    10/03/2024

As to this unresponsive complaint by this company, please be advised that a similar complaint filed with the department of consumer affairs was also filed against this company as well on 08/03/24 and sent to the company on 08/15/2024 with additional information.   This company also has still to date, 9/03/24 has not responded to the department of consumer affairs as well, with last communication on 08/16/24 with the company responding back as to still working on my complaint but as of this date, 09/03/2024 has also refused or declined to comment back to the department of consumer affairs.   This, as you indicated in your response letter is a very serious issue as to identity theft and related matters to my personal information.   I hope you can forward this information to the appropriate agency for further review or investigation of this company as they have ignored your many requests for a response to my complaint but has also not responded back to another government agency, the department of consumer affairs.   Any assistance in furthering a more robust investigation of this incident and this company would be appreciated   Attached are pic of department of consumer affairs complaint agent this company as well for your view

    thank you!

    Sincerely,

I am writing to formally lodge my second complaint against Experian and Clarity Services for reporting highly inaccurate and misleading account information. The information reported by your agencies is so erroneous that it is alarming and must be addressed immediately. I suspect that these inaccuracies may be a result of the data breaches involving T-Mobile, Experian, Equifax, and ***** in which my information was compromised. While I am fortunate that no credit has been obtained in my name to my knowledge, the false information on my report is extensive and requires urgent deletion. For reference, #CJLVYUYF contains the latest inaccuracies. Here are the specific issues I have identified:1. I do not have any alternative lending accounts nor have I inquired about such accounts.2. A random account from 2023 is listed, which has zero association with me and appears to be linked to another individual.3. The date of birth listed reflects 1976, which is over a decade off 4. I have never resided at any of the addresses listed except one.5. None of the phone numbers or email addresses listed are associated with me.6. I am unfamiliar with the employers listed, and work phone numbers 7. The bank accounts listed are not mine 8. I never use full name ever 9. I have not inquired for credit of any kind in Given the severity and extent of these inaccuracies, I demand immediate action to correct my credit report by removing all erroneous information, including but not limited to:- All inaccurate accounts - All incorrect phone numbers - All incorrect email addresses - All incorrect employers - All incorrect bank account information - Incorrect date of birth - My full name where inaccurately used Since this is my second dispute and no corrective action has been taken following my initial complaint, I am prepared to escalate this matter to the appropriate regulatory agencies for further investigation and resolution if necessary.

Late June someone used my information to apply for loans at 2 businesses. One is OppLoans. **** was luckily declined. Received email from OppsLoan which identified reasons for the denial and information for Clarity Services, which provides credit information to OppLoans.Im aware theres 3 major credit bureaus. Necer heard of Clarity Services. They are tied to Experian. On Clarity Services website they have an option to request a copy of your credit report. I entered the requested info. Name, address, phone number, email, ss#, etc. I was able to easily access my credit report. There wasnt any special verification questions that adds an extra layer of security. Anyone who has my info could easily pull this. Report includes full bank account information. Anyone with my info, which it appears multiple bad actors have, now have all of my banking info. Called Clarity Services on 07/09 at 9:10 AM EST. Spoke with *******. Told him to put a freeze on my file, then explained concerns about my full banking info being visible to anyone that has my info and how easy it was to pull report.Asked him if he could tell how many times credit report was pulled so I could gauge damage and make a decision to call my banks, tell them what happened and ask for new account numbers. Told me he cant do that. I also told him how easy it was to get the report and he said it asks verification questions. Told him it only asks for general info that any identity thief has. Other credit bureaus have extra layers of security. Before I engage my state attorney general I want an explanation as to why my full banking info Is on this report and do they recognize how easy it is for any identity thief to pull due to the lack of extra security layers. If full account numbers are on, for whatever reason, dont put the entire account number. Put the last 4 to protect identify victims. This is ridiculous and irresponsible for this business to do considering their lack of security measures.

When I checked my credit reports, I noticed that the following accounts are being Re-aged and reporting derogatory information on my consumer reports every month. This is illegal and not in accordance with the Fair Credit Reporting Act. This is double jeopardy and unfair credit reporting. This is also a violation of my consumer rights according to what I've read in the Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. 1681c(a)(5). Delete these accounts off my credit report because I am not liable for them. CRAs are mandated to provide 100% accuracy in reporting, and they are not. Other violations include 15 U.S.C. 1681a (2)(i): Exclusions, Late Payments are Transactions and aren't to be reported on credit reports. Charge Off Account: FIRST PREMIER- Report Date: May 26, 2024- xxxxxxxxxxxx 9111. Other violations under the Fair Debt Collections Practices Act- 15 U.S.C. 1681g: Disclosures to consumers, and Fair Credit Reporting Act 15 U.S.C. 1681 for willful noncompliance. According to 15 U.S.C. 1681 Section 602 A, and 15 U.S.C. 1681 Section 604 A Section 2, I have the right to privacy, and I never gave consent to any CRAs or anyone to furnish my accounts without my written instructions. Late payments are are also reporting late payments on closed accounts, violating my rights under 15 U.S.C. 1681e: Compliance Procedures and Accuracy of Report, and 15 U.S.C. 1681s2: Responsibilities of furnishers. There is also a violation of 15 U.S.C. 1666(b): Billing Error. Creditors can't treat a payment as late for any purpose. Delete this account and mail me a consumer report/ file with corrections please. I'm making this complaint without third-party assistance.

On October 2021 I placed a freeze on my credit report with Clarity Services **** A part of Experian and was informed and I received correspondence on October 28, 2021, noting that I will be able to remove this freeze with my pin number. I have tried three times within the last week to get my freeze lifted (both online and via telephone) and I am now being asked to submit a copy of my social security card and other sensitive data which will further expose me to my identity being compromised and Clarity Services will not accept the *** number sent to me to remove this freeze.

While reviewing my Credit Reports, I realized that my rights protected by the **** (15 U.S. Code ****(b) Billing error) have been violated. Additionally, I've identified multiple inaccuracies under 15 U.S. Code ****(b)(4). This also contradicts 15 U.S. Code ****b - Permissible purposes; I've never gave TRU permission to share my information with any entity. The Accounts are as follows: REGIONAL ACCEPTANCE - ********, CREDIT ACCEPTANCE CORPOR - ********, KOHLS DEPARTMENT STORE - ****************, ******************* - ****************, THE **** OF MISSOURI/ MI - ****************, CB INDIGO - 534348xxxxxxxxxxxx, CREDENCE RESOURCE MANAGE - 350018XXX, and ************************* - 197506XX. Other violations involve the creditor's failure to accurately reflect a payment made or credit issued on a statement. I have the right to privacy according to 15 U.S. Code **** Section 604 A, Section 2. My Never giving consent to the *** to report anything on my consumer report, amounts to Fraud. I request the immediate removal of all late payments associated with these accounts. It's essential to adhere to 15 U.S.C ****b, which prohibits treating a payment on a credit card account as late under an open-end consumer credit plan. My rights are also being violated according to 15 U.S. Code ****a(2)(A)i - Definitions; Rules of Construction states that a report containing information solely as to transactions or experiences between the consumer, and the person making the report. This means that late payments/ transactions are illegal, and I demand that they get deleted now. I researched and composed this complaint without any third-party assistance.
