Paid this shop to rebuild transmission for 2007 ****** Tundra on October 18, 2022. Within a month began having issues with the trans not operating properly and making weird noises. Called *** after this didn't improve and he had truck towed back to the shop for inspection. I was also worried it was leaking as there was "oil" in my driveway. He informed that I had an oil leak and that the trans was fine and that I had to pay him back for the towing which I did. It was true that I had an oil leak but the trans never stopped acting strange and started giving me more issues recently (end of April 2023). It finally got the point where it would not go in reverse and would not shift into upper gears. On Saturday May 13th and friend of mine crawled under the truck and saw a very large leak ocuring around the entire trans oil pan. We then checked the bolts for tightness and none of them were more than hand tight. We took it to Kwik Kar to get fluid put in the transmission because we figured it was low. The following Monday, the 14th, we took it back to ***. He agreed there were issues with it and that it was leaking but refused to honor his warranty and repair the truck properly. I will be suing him in court. I want me entire $4730.56 paid to him refunded to me immediately.Customer response

This customers original repair was a rebuilt transmission on 10/18/22.The customer was 100% satisfied with the repair and the operation of the transmission. The customer made contact with us two months after the repair stating that he had a transmission leak. No complaint of any type of performance issues with the transmission. We towed the vehicle to the shop and found that the leak was not our transmission but was an oil leak from the motor. The transmission was operating properly with no issues. The customer did not want us to repair the oil leak. He payed for the tow and picked up his vehicle. Then again on 05/15/23 he returned to our shop stating he was having problems with the transmission. He stated that he took the vehicle to his local merchanic, his mechanic found that the transmission was 5 qts low on fluid and that the transmission was leaking. He stated that he had his mechanic put transmission fluid in the transmission and drove it over to our shop. When the customer drove it to our shop it was over a quart low on fluid. Though this customer had a warranty on his transmission from the original rebuild, this warranty does not cover failure due to neglect. Driving the transmission one quart low on fluid is neglectful and will damage the transmission, but allowing it to get 5 quarts low on fluid and still driving it will cause damage every time. Due to this customers neglect of our transmission his warranty was voided. No monies will be paid to this customer.Customer response

I am rejecting this response because when the shop "repaired the transmission" the bolts (which are under the truck and can only be accessed by raising the vehicle) were not tightened which resulted in a leak. More than likely, based on conversations I have had with other repair shops, those bolts loosened over a long period of time, meaning the leak was slow from day one and took months to finally be noticed and damage the vehicle further. Had the repair been done properly it would not have leaked at all (kind of the whole point of the repair!) and these types of repairs should certainly not leak even 6 months later which I have on video that it was.I have filed a lawsuit already. We let the evidence fall where it may and a judge decide.

My 17 year old son saved up $1300 which he paid to this business to fix his truck. The truck has been sitting there for weeks not being touched, and we were just told by the owner that the person working on my son's truck "disappeared", along with my son's $1300. His truck is still sitting at that shop, still does not work, and he doesn't have another $1300 to take it to a different shop. We would like to either have his truck finished in a timely manner, or be refunded the full amount.Business response

There is a ***** Truck at my facility that an employee towed to the shop back on 12/29/22. The truck was towed from the employees home address. The employee always made me believe that it was a vehicle that belonged to a close family member and he was doing repairs on it after work. There has never been a customer related to this truck that has walked through my front door, signed my workup sheet that we have all customers sign. Nor has anybody paid money to me for any repairs. The employee in question was hired as a mechanic. He was not in a position to negotiate with customers nor take payments from customers for this company. As of the middle of March the employee in question no longer is employed with this company. If there is anyone associated with this truck that has a Joe's Pit Stop written computerized estimate or a Joes Pit Stop Repair Order showing that they have paid for any type of repair we will be glad to deal with this in a different manner. MY opinion now is that this is a scam from a family member or friend of the previous employee that is trying to get something for nothing. If the truck is not towed from our facility by a titled owner by Friday April 7th, 2023 the truck will be towed by a local *********** to a Automotive Storage Facility which will cost $250 in tow bills plus $25. per day in storage fees.Customer response

I am rejecting this response because: This is a complete lie! YOUR EMPLOYEE who is NOT a family member as I've never met this man, took money from my son IN YOUR SHOP! My son paid him $1300 in cash, which was handed to your employee in the middle of your shop. How would anyone know that YOU are the only one allowed to take a payment? That's absurd.I also understand from other employees there that this same employee that stole my son's money also stole a truck from you, so please help me understand how you hiring a thief is now somehow a scam that we're trying to pull?! My son was ripped off by YOUR employee who was paid inside of your shop. This is not a family deal. The 17 year old you stole from is my son, and I can 100% confirm that the person you had working for you is not family or even a family friend. Based on numerous reviews I've read, this is not the first or even the 10th time you've done something like this to someone, and I'm struggling to comprehend how you can sleep at night after stealing from a teenager who literally worked for months to save enough money to get his truck back. His life has been ruined by this, as he has no vehicle now, and can barely get to work because of that fact, but you want us to pay your shop AGAIN for the services he's already paid for? This is WRONG!

I am rejecting this response because: You know very well that the same employee who stole a truck from you did not provide my son with a receipt, and at 17 years old, he was unfortunately naive enough to trust that your business would not steal his money. Most likely, this was your employee's plan all along. Regardless, this person worked for you, and represented YOUR business.It looks like you have cameras in your shop, and if they're recording, you should be able to go back and actually witness my son handing this money to your employee. This would have taken place on or about March 16th.
After the recorded conversation you had with my husband and brother when they came to visit you, you made it very clear that you were aware of the fact that my son paid your employee this money, and you admitted on the recording that your employee stole this money. Once again, you are liable for what takes place in your shop, including money stolen by people you hired to work for you.
