I agreed to a payment plan involving Portfolio Recovery collection. I have been paying them as agreed. They have is***d 2 summons for judgements against me and I showed up for court both times. The first time, their attorney asked for a continuance after waiting 3-4 hours for my case to be called. The second one, their attorney didnt show up so the judge dismissed their case. Now when I go to the website to make my payment, it says the file number is invalid. Do I continue to try to pay or did they drop it without telling me? Or are they not accepting my payment in an effort to *** me again?

Scott & Associates is attempting to collect an alleged debt on behalf of ***************************************************** previously attempted to collect the alleged debt on behalf of **************.Scott & Associates states thats ************** is the original creditor. According to all three of my credit reports, I have never had an open account, closed account, or charged off account reporting entry ever from ************** for the alleged account ending in 0140.The only reason I became aware of the alleged debt was through *************************************************** was wrongfully and negatively reporting the alleged debt through Experian. I informed ************************* that the alleged debt is listed in my maiden name which I have not gone by for 10 years. I sent *************************. copies of my credit report showing every open and closed account Ive ever had. The ************** account in question was NEVER listed. When I filed a complaint and dispute showing the copies of my credit report proving the account was not tied to me, *********** Solutions removed the entire negative reporting history from Experian as if it never happened. I thought this nightmare was over until I received a notice from Scott & Associates stating they are attempting to collect on behalf of *************************. I am not liable for this alleged debt.I would like all attempts for collections to cease immediately in regards to case file #*******

I am not satisfied with the response.
I confirm receipt of the affidavit instructions and have responded to Scott & Associates providing the affidavit from the FTC.

The statement that CCS updated the dispute is correct, however the claim stating the collection reporting was not deleted is false. CCS was reporting to Experian from September 2022 through November 2023 causing my credit score to decrease significantly.

The FCRA states that any information that is inaccurate, incomplete or unverifiable must be removed or corrected. And that if the information is accurate, complete, and verifiable it may continue to be reported.

When I pulled my credit report in March of this year, I found that CCS was no longer reporting and had completely expunged the account as if it never existed. There was no statement or comment as to why is was no longer being reported and had been completely removed.

As a consumer, I am concerned because Experian told me the only way a collection can be removed is if the reporting information is unverifiable, inaccurate or incomplete. IF the information was accurate, complete and verifiable then the reporting would stay on my report for 7 years until it fell off. This leads me to believe my findings as true that the account in question is unverifiable and inaccurate.

CCS also reported the alleged account opening as March 19, 2022, but Scott & Associates states the alleged account opening as August 28, 2017.

The alleged account in question is listed in my maiden name, which I have not legally gone by in 10 years. That was the first red flag. The second red flag was when I pulled all three of my credit reports there has never been a reporting of the alleged account in question. There is no open date, no closed date, no charge off date, no delinquency date, or no credit limit. All of these are required by law for businesses who regularly furnish CRA information. (I would assume that a big bank who relies on CRAs to determine creditworthiness would report any and all accounts they are lending to and if they dont, one would think thats a big problem.) This leads me to believe the alleged account in question is a result of fraud. Again as a consumer, this concerns me because consumers are told to rely on their credit reports.

I responded to CCS with copies of my credit report as they requested and did not hear any further from them until I was contacted by Scott & Associates.

When Scott & Associates responded to a validation request the alleged amount in question differed from the alleged amount stated by CCS. This differing amount showed a payment/credit applied to the alleged account that I did not authorize nor make on my behalf. There was no amount validation or itemization showing where this payment came from or who authorized it.
This required itemization information was not provided within 5 business day per FDCPA.

Its incredibly deceptive, frustrating, and confusing that an attorney and their client continue attempting to collect an already disputed debt by sending conflicting information on an alleged debt that I have no record of.

I believe this to be a FDCPA 12 CFR ******* violation: Falsely misrepresenting the amount of the alleged debt. This credit/payment that I did not make or authorize would cause the alleged debt to become renewed. Its illegal for debt collectors to re-age debts. Again as a consumer, this is concerning.

As previously stated, I have responded to Scott & Associates with the requested FTC affidavit.

I hope this matter is resolved quickly and amicably.

I was garnished in a well known Finance position for a 2017 debt that was fraudulent and filed back in 2017 during my divorce. Now this has caused me to go on Administrative Leave while they determine if something from 2017 that was not me makes me a criminal. I have been treated worse than dirt over this error. I need this billing adjustment done refund sent to the company I worked for and maybe just maybe Ill get an opportunity to prove this is not my debt and Im not who every portrayed me to be over this!

My personal information was breached between 2018 and 2021 without my knowledge. I had some credit repair done but I couldn't afford to get much done, most of it I cleaned up myself. Someone or person's used my information for multiple things, such as car insurance, bank loans and so on. Most of the fraudulent activity was taken care of, such as credit one. Now this Scott and associates or whoever they are, saying that I owe 1600.00.I didn't keep most of the information I had on the data breach because of personal reasons. This is ridiculous, I have enough going on with my health and I don't need anymore of this issue information mess harassing me.

I have been going back and fourth with Scotts and Associates and have been paying on time...they keep changing terms and agreements with out contacting me. I initially was working with Credit One...then they were sold to another company that I was working with. However they then turned into ******************************************* They were debiting my money out of my account automatically and were receiving payments on time. Even then I contacted them to see if we could settle...I was told I would get a call back. I even attempted to reach out and speak with a manager and never got a call back. So imagine my surprise when I get a letter in my mailbox. This company has been harassing me for years and I am pretty sure they are violating laws and attempting to *** people for debts that they may not owe. This company even had someone banging and knocking on my door late at night. I live alone...I could have been put out of my apartment complex because of them. They are taking advantage of people and using illegal practices to take advantage of people. Now they are saying I owe way more money than I should.

On 12/23/24 this company took $710.04 (Garnished Wages without any notice). Its not on my credit report, and this is not my debt. Zero communication, or documentation with me! My employer contacted me. It is from a judgement issued in 2017 on an account dated back to 2013. I an truly at a loss as to what to do. I will be contacting legal counsel just can not believe a company can just garnish wages without any communication. Feel very violated.

On today I attempted to make a payment to this agency and their website went back to home page. I called to see if payment was initiated on their end and spoke to 3 different people that were unable to help. How can a company have you on a payment plan but fail to be able to assist if their site glips. If I miss a payment then they will say I didnt honor agreement and if I double pay itll be more time and energy to be refunded. The agent was rude and sarcastically told me it was above her pay grade and when I asked for a manager was told it would be 5 minutes
