BBB promotes truth in advertising by contacting advertisers whose claims conflict with the BBB Code of Advertising.  These claims may come to our attention from our internal review of advertising, consumer complaints, and competitor challenges.  BBB asks advertisers to prove their claims, change ads to make offers more clear to consumers, and remove misleading or deceptive statements.  

On March 17, 2023, BBB contacted Hempster Store regarding advertised claims on their website https://hempsterstore.com.  

BBB requested Hempster Store to modify, substantiate or discontinue advertised claimed results of third-party products they sell.

Specifically, Hempster Store's product descriptions advertise health and disease-related claims including pain, anxiety, heart-healthy, sleep, mood soothing, relaxation, focus, and anti-inflammatory claims.  

BBB Code of Advertising states claims relating to performance, energy savings, efficacy, or results for a product or service should be based on recent and competent testing or other objective data.  

BBB requested Hempster Store to substantiate the claims advertised by providing evidence from recent, reliable, and competent studies or other objective data to substantiate the claims or discontinue the advertised claims. 

Hempster Store also advertises claims of the bioavailability of products sold on its website.  

BBB Code of Advertising states claims relating to performance, energy savings, efficacy, or results for a product or service should be based on recent and competent testing or other objective data.  

Furthermore, advertisements claiming bioavailability claims require competent studies and tests to be performed on human subjects.  

BBB requested Hempster Store provide recent, reliable, and competent studies of tests performed on human subjects from the specific manufacturers to support the advertised claims or discontinue the advertisements to address BBB's concern.

BBB also requested substantiation from manufacturers of any CBD products labeled as "dietary supplements."

BBB Code of Advertising states the primary responsibility for truthful and non-deceptive advertising rests with the advertiser.  Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast.  

The Food and Drug Administration (FDA) also states THC or CBD products cannot be sold as dietary supplements.  

Hempster Store responded to BBB stating the advertised claims are from third-party products and failed to substantiate, modify or discontinue the advertised claims to address BBB's concerns.
