There charges were forced on to me by a company (Appliance Warehouse) throughout the year 2023, without providing functional washer and dryer.In the past 18 months, I have been making payments to them without fail. The business committed to provide me a washer and dryer which are in working condition.But when I raised a complaint about washing machine not working in Feb 2023, they replaced it with another non-functional one in April 2023, but they charged for the entire duration. I called back several time asking to replace but they neven responded to me, finally they picked their non working washer and dryer in July 2023 or early Aug 2023. But they illegally charged me for 5 months when the washer and dryer are sitting in a non-functional state. They continue to threaten me that my case will be handed over to collection, without discussing the issue of illegally charging my account and forcing me to pay.I do not have any other kind of service agreement with appliance warehouse where I agreed to pay for non-functional equipment.I want to fight these cowards including the collection company (RS CLARK and Associates), which did not attempt to solve the issue, whose sole aim to report to collections for which I don't give a **** about either of those two companies. If you look at my payments history, it's been prompt everytime, why will i take so much pain for just $300, I don't want these idiots to win by doing these illegal practices.Business response

I am not liable for this alleged debt or account. I don't have any contract with this collection agency "RS Clark & Associates, ***** I have previously requested proof and documentation bearing my signature. I never had any business nor applied for an extension of credit with this company.As per FTC guidelines reporting this account in my consumer credit report is a collection activity. therefore, you are in violation under 18 U.S. Code 894 - Collection of extensions of credit Under (a)Whoever knowingly participates in any way, or conspires to do so, in the use of any extortionate means (1)to collect or attempt to collect any extension of credit, or (2)to punish any person for the non-repayment thereof, shall be fined under this title or imprisoned not more than 20 years, or both. Your continued derogatory reporting of this alleged account in my credit report is a form of punishment and hurts my chances of improving my living situation.CORRECT THIS REPORTING IMMEDIATELY. I am rejecting this response because:
I disagree. This platform is provided to us, as a consumer by law. I have disputed this account with the credit reporting agencies and requested that you provide authenticated documentation of the contract with your company name on it with my signature. I never applied to any extension of credit with your company. under 15 U.S. Code ****j - Furnishing certain deceptive forms and Under 18 U.S. Code 894 - Collection of extensions of credit by
by extortionate. FTC guidelines reporting this invalidated alleged account in my consumer credit report is a form of collection activity. This is damaging my character. I am in the process of improving my living situation. DELETE ASAP!

I am writing to express my concern regarding RS Clark Collections' violation of the ***** Finance Code pertaining to Account Number ********************. Despite sending a certified letter requesting debt validation within the 30-day timeframe, as mandated by the ***** Finance Code, their organization failed to respond within the stipulated period. As a result of their willful negligence, I have suffered statutory and actual damages.I am making every effort to resolve this matter without litigation, I respectfully request the following actions:Promptly remove Account Number ******************** from my credit report.Provide written confirmation of the removal to me and the credit reporting agencies.Thank you for your assistance in this matter.Business response

I am not liable for the debt with RS CLARK & ASSOCIATES. I do not have a contract with surgical consultants of ****** nor did i PERSONALLY see them. I attempted on multiple occasions to solve the problem directly with the collection company who continues to report verified without any proof or documentation. I also did not not provide a third party hipaa release. .You guys need to handle this issue. This has been going on for a long time now that I have seen my information. .They are in violation & told me 30 days when I had fraud. they are in major violation. i am attempting to refinance my house and this fake collection is causing harm and will soon lead to damages.Business response

I recently received a copy of my credit report and found that RS *********************************** is illegally reporting inaccurate, noncompliant, and false information about me. The following alleged account is listed as a collection with a PAST DUE BALANCE of $1559 Account Number, **** This is a violation of the **** and is also in violation of requisite METRO 2 Compliant reporting standards.By the provisions of the Fair Credit Reporting Act and per the standards of reporting compliance implemented with the **** enacted CDIA Metro 2 COMPLIANCE regulations, I have the right to a fair and accurate credit report, and you are required to remove any information that is not true, accurate, compliant, and verifiable. I recently pulled my credit report and notice there was a collection that I have no knowledge of and doesnt relate to any transaction made by me. I have been reaching and am fully aware that a debt collector must send me written communication prior to furnishing anything to a consumer reporting agency. I have not received a single piece of mail form this company I only became aware of them when I saw the collection on my consumer report. I sent a letter to the company requesting validation of these unknown debt and I have yet to receive any communication from them. It has come to my attention that you have violated several provisions of the Fair Debt Collection Practices Act (FDCPA), specifically 15 U.S. Code **** because they didnt validate the debt and 15 U.S. Code ****f for false and misleading reporting furnishing to my report without following FDCPA guidelines. They have engaged in false misleading reporting by saying I owe a debt without providing any supporting documentation or evidence to validate the legitimacy of this alleged debt. The lack of information provided by violates my rights under the ****** which require that debt collectors provide clear and accurate information regarding the debt. The actions taken by this company are unfair practices under 15 U.S. Code ****f. By attempting to collect a debt without providing proper validation and verification. They have caused me and my family unnecessary distress and anxiety. These actions are not only unjust but violate the ****** which explicitly prohibits unfair practices in debt collection.I never received written verification of the alleged debt within five days of communication. To date, I have not received any such validation or verification from the company. This failure to comply with the statutory requirement deprives me of my rights as a consumer and further strengthens my claim that your actions are in violation of the ******Business response
