      Got a letter from the ***************** saying I got a ****-c from this company back in 2019 which I never received. I have never even heard of this company before, now the state and the irs are trying to collect taxes on these supposed wages of $16,250 from this company. This is absolutely insane and cant be legal for a company to send fake ****s to the irs!

      In the Complaint, the consumer states that she was recently notified of a ****-C sent by RTR that she never received. The consumer also states that she has never heard of RTR and the *** is trying to collect taxes on supposed wages of $16,250 from RTR. The Complaint states that this is a fake ****-C. RTR will respond below.

      RTR issued the *** Form ****-C with respect to the attached mortgage debt. RTR was servicing this account on behalf of **** of America. RTR began servicing this debt in 2014.Enclosed is RTRs initial letter from that time. RTR expects that the above information and attached documentation clarifies that the Form ****-C was not issued for wages and is not fake.

      In 2008-2009 during the recession,I lost my job in mtg industry due to housing market crisis. It was difficult to find re-employment during this time, especially because I was pregnant second child. My husband's company had to do temporary layoffs on and off. We wiped out all our savings then cashed in my 401k to live and keep our home. We were in NEG AM loan, though we made our regular scheduled payments every month, we owed more than value. In desperation, I reached out to the Gov-funded program "Making Homes Affordable Act" Our agent assisted with 1st mtg and turned it from a NEG AM to low step fixed rate. As for our 2nd Mtg, originally held by American General, advised us to default. Stated most likely would be charged off, at worst case scenario, a lien would be put against the home charged off amount of $17094. It was in fact, charged off and stopped reporting on our credit reports. It was then sold off to Springleaf, where they offered us a lump sum of ***** to settle. Unfortunately, we didn't even have that. Statements stopped all together, so we assumed that was the last of it.Still with financial struggles, we had no other option but to file bankruptcy. So this should have definitely took care of it!! Then all of a sudden started receiving statements again from Shellpoint. We figured this was just scare tactic from a debt collector and paid no attention to it. But when statements started again payment amount was amount was for only $9000. Sadly, all statements prior to Hurricane **** were destroyed in flood. However, I have attached a statement from Shellpoint showing that as of 01/01/2018 payment amount $13,584. So amount was not consistent, so surely in our minds-fraud? Then Real Time started sending statements, threatening our home could be foreclosed on, and statements with random, no explanation $420 "FEE" in addition to regular payment of $239.35. Is this even legal to do this to people? Please help!! Thank you for your time.

      In the Complaint, the consumer acknowledges that she and her husband defaulted on this obligation and then received a discharged in bankruptcy. The consumer states that she received billing statements from Shellpoint, the prior servicer, after her bankruptcy discharge, but believed it was solely a scare tactic. More recently, the consumer has received statements from RTR and does not believe the amount therein is accurate, including a fee of $420.00. RTR will respond to these items below.

      As a preliminary matter, RTR recognizes that the consumer and her husband jointly received a Chapter bankruptcy discharge. As a result, neither the consumer nor her husband have any personal obligation to repay this account. Nevertheless, the lien of the subject mortgage continues to encumber the subject property. ********** transferred the servicing of the mortgage to RTR in 2020. At that time,********** transferred a late fee balance of $420.00. Due to nonpayment, the balance of the account has grown over time, as indicated in periodic statements sent by RTR (like the one enclosed with the Complaint). If the consumer has any specific questions about the balance of the account, she is welcome to contact RTR. Otherwise, RTR believes that the balance of the account is accurate as detailed in RTRs letters and statements sent to the consumer.

      I am rejecting this response because:  RTR states Springleaf transferred the servicing of the mortgage to RTR in 2020. Claiming at that time, Springleaf transferred a late fee balance of $420.00. We stopped receiving statements from Springleaf all in together 2015, it was AFTER we filed chapter bankruptcy we started receiving statements again but at this time from SHELLPOINT, NOT Springleaf. Please find attached letter dated 03/13/2020 that again (Shellpoint) NOT Springleaf transferred to RTR in 2020. And there was no late fees of $420 on any of those statements from Shellpoint. Again, proving how dishonest RTR has been by adding in some random fee $420 to each monthly statement thus violating state and federal laws on false representation of a debt and proving their other unfair practices.

      In the Complaint, the consumer takes issue with RTRs prior response. Specifically, the Complaint states that RTR wrongly stated that ********** transferred this account to RTR,when it was in fact Shellpoint. The consumer also states that none of the statements or correspondence from Shellpoint contained a late fee balance of $420, which the consumer continues to dispute. RTR will respond below.

      The consumer is correct. The account transferred to RTR from Shellpoint, not Springleaf. RTR misspoke in its prior response and apologizes for the confusion. Despite the assertions in the Complaint, the $420.00 late fee balance transferred to RTR from Shellpoint. RTR has never assessed late fees against the consumers account.Unfortunately, RTR does not possess copies of billing statements sent by Shellpoint.Nevertheless, to resolve this matter in the consumers benefit, RTR will voluntarily waive the $420 late fee balance from the consumers account.

      I am rejecting this response because:   RTR is blatantly being deceptive. We strongly feel that RTR has violated several FDCPA laws. Along side with, Springleaf and Shellpoint.

      The original Lien holder was American General AG CHARGED OFF ACCOUNT at $17,734 this included defaulted interest and late fees in 2010. The interest and late fees alone almost doubled the amount we owed before defaulting. Again, we were advised by the Making Home Affordable Program to default.

      Account then collection sold to Springleaf, whom at one point offered settlement letter of approximately $6000. We rejected as we were already were in the ** proceedings. All Statements ceased all together from Springleaf after **, we assumed all settled. Thats what bankruptcy is for right? To get relief from being contacted by the collection agencies? 

      SHELLPOINT, then obtained account. The first statement payment amount was with Springleafs settlement offer amount. Shellpoint was then adding original principal payment amount from AG to each monthly. (Please see statement attached) Over course of the years Shellpoints total amounted to more than original 2010 charged off/ 2015 discharged amount.

      There was never at any point through transfers of account any late fees from Springleaf or Shellpoint. It wasnt until RTR obtained account from Shellpoint 03/13/2020 that late fees started to accrue monthly. RTR  first statement started with original charged off amount of $17,734 with a $420 late fee monthly. 

      RTR states they will voluntarily waive the $420 late fee balance from the consumers account This has not been a one time late fee as RTR tries to present in the last BBB response. 

      I would like to reiterate: To date, RTR has added a total of $12,365.08 in late fees to the original 2010 charged off/ 2015 Chapter discharge amount - $17,734. RTR is claiming as of October 2023 statement total is now $30,033.

      Filing bankruptcy is very embarrassing and a long process to bounce back after. But to be HARASSED 8 years after is a another thing. RTR was the first to threaten possible foreclosure on our home and the first to add on such ridiculous late fees. 

      So I hope you can understand why we feel Scare tactics by all 3 of the collections companies.  WE FILED BANKRUPTCY, IT WAS DISCHARGED. Statement amounts were never consistent amongst the 3 of collector. Statements stopped and started. How could we take this seriously? 

      Ultimately, we feel we dont owe RTR anything! This is harassment and if anything we feel they owe us for the stress they are causing onto our family. If we cannot come to some sort of resolution soon with RTR we will reach out to anyone and everyone FTC, CFPB, FCC, Attorney General for ******* and *****. Please help ** figure this out!

The account then transferred to Springleaf, who offered a settlement of $6,000, which the consumer rejected due to her bankruptcy. The account then transferred to Shellpoint and the first statement received was in the amount of the $6,000 settlement amount from Springleaf. Shellpoint then sent statements adding the original principal payment monthly to the charge off balance of $17,734. RTR then obtained the account and the consumer again asserts that RTR assessed a new $420 late fee each month. The Complaint contends that RTR has added over $12,365 in late fees to the original charge off balance. The consumer also states that RTR threatened possible foreclosure, which was concerning. RTR will address these items below.

      Unfortunately, RTR does not possess copies of the billing statements sent by prior servicers.However, the principal balance of the loan per RTRs records is $17,734, which aligns with the purported charge off balance from ************************** Services, as well as the balance listed in the consumers bankruptcy petition that was filed under penalty of perjury. Since RTR began servicing the account,RTR has not assessed any fees to the account of any kind. Rather, the $420 late fee balance was transferred to RTR by the prior servicer. And as advised in RTRs last response, this $420 balance has been waived. Additionally, this late fee balance was not being assessed each month. This distinction is evident in the billing statement enclosed with the Complaint, which lists the Total Fees and Charges balance as $420. The only balance assessed to the account by RTR has been interest.

      RTR sent correspondence to the consumer referencing foreclosure because this letter was required by law. The consumer may review Regulation X, 12 CFR *******. RTR denies that it has violated the ***** and hopes that this response is helpful. If the consumer wishes to discuss a resolution of the account for less than the full balance reflected on RTRs statements, she is welcome to contact RTR to do so. RTR would like to determine if a mutually agreeable resolution if possible.

      In the Complaint,the consumer states that she does not agree with the amount being requested by RTR to resolve the consumers debt for less than the full balance owed, particularly because the consumers current offer is higher than an offer extended by RTR in a prior year. As a result, the consumer states that RTR is not acting fairly and states that she feels pressured and requests an apology. RTR will respond below.

      RTR empathizes with the consumers position and is hopeful that the parties can come to a mutual resolution. Nevertheless, RTR believes that it has acted fairly in all of its interactions with the consumer and believes that it has extended a fair offer to the consumer to resolve this debt for far less than the full balance owed. While RTR offered a lower amount in a prior year, that offer expired.

      RTR remains open to continuing negotiations to explore the possibility of a mutually agreeable resolution. Please note that the consumer is under no obligation to accept any offer provided and should not feel pressured to do so.

      my real concern is that I asked ******* the account representative for Real Time Resolution who is the payment made to ir who hired them to collect. She said with certainty that the payment was being paid to **** of America. I reached out to **** of America on two separate occasions and spoke to two separate employees of **** America who clearly stated that they do not know who the collection company Real Time Resolution was and that my Heloc Loan was sold to Green **** Servicing a different company. I requested to see a copy of the documents who hired real time resolutions to collect and the document they sent me stated ****** hired them. Please understand that I would like a resolution with this collection for payment but clearly their Representative ******* information on who the money is paid to clearly conflicts with what **** America says. 
      i would like to speak with a manager for Real Time Resolution so we can clarify all information given and also a new negotiated amount for this collection payment of the Heloc

      In the Complaint,the consumer states that she was advised by RTR that it was servicing the consumers account on behalf of **** of America. However, when the consumer contacted **** of America, they advised that they did not know RTR and that they transferred her loan to Green **** Servicing. The Complaint also references Ditech. As a result, the consumer requests clarification as to the entities associated with her account. RTR will respond below.

      RTR is subservicing the consumers account for **** of America. Because **** of America is such a large organization, it is possible that the consumer spoke to individuals unfamiliar with RTR. Rather, those individuals likely consulted **** of Americas records, which indicated that **** of America previously serviced this account directly. **** of America then transferred the servicing to Green **** Servicing, LLC (later known as ***************** LLC), who then transferred the servicing of the consumers account to RTR in August 2016.

      RTR hopes that this explanation is helpful. As stated in RTRs prior response RTR remains open to continuing negotiations to explore the possibility of a mutually agreeable resolution.

      Plain and simply, I paid in full the second lien on my home with Real Time Resolution. I received a copy of the wire transfer to Real Time Resolution from the closing attorney which showed they received the funds on 5/25/2023. Real Time also sent me a paid in full letter stating a zero balance as of 5/25/3023.Well today is 7/6/3023. I have been on the phone constantly with Real Time Resolutin requesting a copy of my lien release. Keep getting the run around. I was told by the last person I spoke with that they requested my lien release with ***** Mortgage on 5/25/2023. I called Ocen and gave them loan information but they stated that that loan number is in no way associated with my name. They said they are looking into it and would get back to me. SOMETHING IS NOT RIGHT HERE. MORE TO COME!

      Sometime within the last few months Real Time Resolutions began reporting a mortgage account that has been closed for numerous years as OPEN on my credit report with Experian and Equifax. Additionally, they have also began reporting 120 day late payments every single month to my credit report with Experian and Equifax which is erroneous, unfair and is significantly hurting my credit scores. Again, the mortgage in question has been closed for over 5 years now! I have been disputing this information with the credit bureaus and directly with Real Time Resolutions with no resolve or response for 6 months. Please remove this inaccurate information from my credit reports immediately! I have attached a copy of the inaccurate reporting.

      In the Complaint, the consumer states that he recently noticed information furnished by RTR on his credit report. The consumer states that this is unfair because the subject mortgage has been closed for over 5 years. The consumer states that he has been disputing this information with no resolution.       RTR is servicing the consumers junior mortgage loan that previously encumbered the property located at *********************************************. RTR recognizes that the property was foreclosed upon by the consumers senior lienholder in 2018. The proceeds from the sale went to the foreclosing lender and did not satisfy this junior mortgage loan, which remains owing as an unsecured balance.

      RTR has responded to several credit disputes submitted by the consumer to the credit bureaus. RTR believes that it is furnishing accurate credit information in compliance with applicable law. The consumer is welcome to contact RTR to discuss a resolution of this account.

      Back in 2012 I went through a loan modification with **** of America and made arrangements to restructure my loan to save my home. I had a first and second loan on the home. We signed all of the paperwork and I have been paying on my home ever since. The loan has since been sold To ***************. No issues as I make the payment every month. Out of nowhere Real Time Resolutions contacted me in lat 2017 threatening foreclosure my house for a $54,000 second on my house that was unresolved. The original second loan amount was nowhere near that dollar amount. They could not even show my how they came about that dollar amount. I made agreements to pay the about $350.00 a month to resolve the foreclosure. In 2020 COVId hit an I lost my income and cars. I had to file bankruptcy. I did miss some payments as I had no money. I have been paying $500.00 a month nearly every month. Today I could not make a payment. They informed my that my account is in foreclosure again. And I need to fill out yet another application to make payments. This place is unethical. I can not even access my account to print proof of payments. I need help. *****

      I and my family were told that when we got a loan modification on our ******************, the second loan was forgiven.I during that time, suffered a catastrophic injury in a vehicle accident and I am a parapalegic.I am bed ridden.We were contacted by Real Time Resolutions regarding that forgiven second loan and shockingly told that it was not forgiven and that it must be paid.Different family members have tried to help me talk to Real Time Resolutions and I am trying to get this solved. I just asked again for documents on March 1, 2023 that I never received from ************************************* after repeated requests to Real Time Resolutions so that my family members could read and understand what happened. The documents finally were sent to me Thursday, 3/2/23 by *************************. I sent a email Monday, 3/6/23 back to **************** saying that the family would review the documents and we would be in touch with them.Suddenly, I receive a notice of Foreclosure from Real Time Resolutions recorded March 9, 2023! I was not told this might happen! I am a nervous wreck. I called Real Time Resolutions and asked representative ********************* to let me speak with Supervisor ********************* because I wanted to find out why I was slammed with this unexpected Foreclosure when I had been working in good faith to try to solve this.When I spoke with ********************, she said I was giving them the runaround repeatedly asking for the same documents. I told her I needed all of the documents (not just some of them) to talk with my family and I had not received all the documents until 3/2/23. ******************** said that I was giving them the runaround and that they could file foreclosure whenever they wanted to. This is very distressing to me. I am sick as a result of this threat. I have been working in good faith with Real Time Resolutions and I believe I should not be subjected to this abusive treatment. I told ********************** would be asking for outside help regarding this bad treatment.

The consumer states that he was shocked to discover that his second loan still existed after he was contacted by RTR. As a result, the consumer states that he requested documents from RTR, which were recently delivered. While reviewing these documents, the consumer received a foreclosure notice from RTR. The consumer states that he believes this behavior is abusive and proposes paying RTR $500 per month for a total of $25,000.00.RTR will respond below.

      RTR previously addressed the consumers claims regarding his senior loan modification in response to his dispute submitted to the ***** Enclosed is a copy of RTRs response. If the consumer possesses any documentation to demonstrate that his second loan was forgiven, he should provide this documentation to RTR for review. Further, as stated in RTRs response to the consumers prior dispute to the ***** RTR has been servicing the consumers second loan since 2013 and has made numerous efforts to contact the consumer since that time.

      In October 2020,RTR received information from the consumers retained representative, who identified himself as a Loan Workout Specialist. Again, the parties had limited contact and the consumer did not respond to RTRs letters seeking to resolve the Account. Accordingly, in August 2022, RTRs retained counsel sent the consumer a pre-foreclosure notice. In September 2022, as referenced in the enclosed CFPB response, the consumer submitted a loss mitigation application.RTR provided loss mitigation options later that month, which were ultimately not accepted by the consumer.

      In October 2022,RTR received a written dispute from the consumer. In November 2022, RTR provided a response that included a copy of RTRs initial correspondence from 2013,which advised of the transfer of servicing to RTR. Thereafter, RTR received another dispute from the consumer and RTR supplied an additional written response addressing the consumers concerns.

      A Notice of Default was recorded on March 9, 2023. Under ********** law, RTR cannot schedule a foreclosure sale for 90 days after the recordation of the Notice of Default. During this time, RTR remains committed to negotiating with the consumer in good faith to determine if there is a mutually agreeable resolution.

      Mother suffered a panic attack and was hospitalized four days as a result of
      the foreclosure action and her worried about where was I going to live.



      Family friends are also puzzled about this treatment in violation of my accomodation rights in

      ********** as a disabled person.


      I am asking if I can make payments of $500.00 a month for an amount of $25,000.00 to settle this
      matter.

      Please allow this letter to serve as Real Time Resolutions, Inc.s (RTR) response to the follow-up complaint submitted to your office by **************** (the Complaint).  RTR is committed to customer service and we hope that this response addresses the concerns raised in the Complaint.

      In the Complaint, the consumer states that RTR he believes RTR has violated his accommodation rights in **********. Further, the Complaint reiterates the consumers prior to make payments of $500.00 per month for a total of $25,000.00. The consumer states that RTR is not working in good faith to provide alternatives to foreclosure. Further,an attachment to the Complaint once again states that the consumer has not received documents previously requested. RTR will address these items below.

      First, RTR rejects that it has violated any law or any of the consumers rights. If the consumer can provide reference to a specific statute or regulation allegedly violated,RTR will review the information provided and responded to same.

      Second, the Complaint reiterates the offer conveyed in the consumers initial complaint.This offer was previously rejected. More recently, RTR offered the consumer a two-year, post-maturity payment plan that required an up-front payment of $24,000 followed by monthly installments of roughly $1,700. RTR has not heard back from the consumer with respect to this offer but remains committed to negotiating a resolution in good faith.

      Finally, enclosed are letters from RTR dated November 16, 2022, and December 19, 2022, each of which contained the documentation that the Inquiry asserts was not previously received. As you can see, RTR has provided the requested documentation to the consumer on multiple occasions.

      RTR hopes this response is helpful. RTR again denies that it has acted improperly in its servicing of the consumers loan. If the consumer wishes to continue negotiating a resolution of his loan, he may contact RTR to do so.

      1- ************* RTR is incorrect. I have proof. RTR did not send me the documents I had been requesting for almost five months until March 2023.This is a violation of the Federal RESPA Response deadline. See as proof the attached email chain from ************************* of RTR.

      2- ************* Ms. ********* phone comments, which RTR has recorded were unnecessarily abusive and stressful to me and my family.

      3- When I finally got the documents to discuss with my family, RTR was simultaneously filing foreclosure against me creating havoc in my family.

      4- ************* RTR filing foreclosure at that time is not an act of good faith, this action has created devastating bad marks on my credit report. I do not have any money for a surprise mortgage.

      5- I need a settlement option that I can afford.

      In the Complaint, the consumer states that she is unable to contact RTR and that when she does speak to RTR, its representatives have been rude or and failed to call her back. Further, the Complaint states that RTR has not been sending her statements. RTR will respond to these items below.

      RTR's records indicate that it has spoken to the consumer on multiple occasions. While RTR recognizes that the consumer believes she has been treated rudely, RTR has reviewed its communications with the consumer and does not believe that its representatives have acted in such a fashion. RTR believes that its representatives have communicated with the consumer in a cordial and professional manner. Moreover, RTR does not possess a record of prior disputes or complaints from the consumer alleging any impropriety by RTR or its representatives. RTR will also instruct one of its representatives to contact the consumer in the near future to discuss her account.

      Finally, RTR has been sending the consumer items of correspondence. Unfortunately, the consumer is no longer receiving monthly statements because her account is beyond maturity.       Real Time Resolutions is appearing on my credit report in error. The debt was transferred from one debt collector to another. I have been asking RTR for proof that the debt is no longer owed to them, because it shows as owed on my credit report and that is an error. I have been reaching out to RTR to get a letter to say the debt is resolved since 12/2/2022 and I have called repeatedly with the help of a licensed mortgage broker in the *******************, who is working to help me buy a new home. I lost my home in 2021, in part because of this debt that is still showing unresolved on my credit. We have provided proof of the debt being paid off and we seek a letter stating the debt is resolved, so we can do a credit repair and then I am ready to start looking for another home to buy after losing my home due to a third party taking out a 2nd mortgage on my property, without me knowing it! This issue with RTR is in regards to this 2nd mortgage, that I lost my home to. We can provide the documentation we have that supports our claims.

RTR previously serviced the consumer's account from 2015 to 2020. Thereafter, the servicing of the consumer's account transferred to a new servicer. Any credit information furnished by RTR is accurate and reflects the status of the account for the period serviced by RTR.

      Nevertheless, in light of the Complaint and the current status of the consumer's account, RTR has submitted a request to the consumer reporting agencies to remove any credit information furnished by RTR. Please note that the consumer reporting agencies are separate entities from RTR and that RTR has control over the expediency or accuracy with which the agencies remove or modify any credit information.
