      I have been living the most worst living situation with my apartment. I have tried to contact my own leasing office for months now and I have not had a single email or voicemail returned. Its negligible and unacceptable and unprofessional. Its almost as if they are dodging calls from residents, The managers never return emails or phone calls even when stated as urgent.

      To explain in further detail of my living situation, I have been having a noise complaint issue with my neighbors for the past 7 months. First dated June 12, 2023, 8:31 AM. I submitted a complaint to my landlord detailing the unbearable noise I was hearing from the above tenant(s). As I work from home, I implied the urgency of this matter and the fact that I was unable to have peace in my own home and at times could not sleep at night because of the noise. ******** responded June 21, 2023, 2:33 PM about looking further into the matter and I didnt hear back from the landlord until July 6, 2023, 3:33 PM, and that in fact was the last time I heard back from the landlord. I called and left numerous emails following that (which can be seen in the attachments) and still no communication back from them; and it is now December with Monday December 4, 2023 8:51 AM

      After further research, I have been advised the my right to complain about noise is covered under the ************** Covenant of Quiet Enjoyment as well as the local ****** county Landlord/Tenant law, and the fact that I still havent received any resolution or response to my living situation is concerning and may result in me seeking legal action.

      I entered into a lease agreement with Indio Management DBA **************** Apartments at ************************************************* on 8/2/2022. On 8/15, I filed a work order reporting a sewage smell which was promptly closed by maintenance staff despite them never inspecting the unit. On 8/22, my kitchen roof started to leak from the rain, and rainwater began pooling into the lights. I submitted another work order with photo evidence, which was again closed by maintenance without an inspection or comment. On 8/29, I filed a work order re-reporting both the roof leak and sewage smell, which was closed once again with no resolution. On 9/26, I emailed the property manager about both issues, and attached video and photo evidence of the leak. The manager responded saying she would meet with maintenance and get back to me. On 9/28, she followed up stating that maintenance would perform an inspection to check for both issues, and that she would follow up with me. I never heard from her again, and maintenance never came. On 10/15, I spotted roaches in the unit. On 10/16, my bathroom roof began to leak. On 10/28, the living room roof began to leak. These issues persisted with no response from maintenance or management. I reached out to code compliance, who inspected the apartment and issued them a code violation for the leaks. Pursuant to the ***** Property Code, I issued The ****** several written notices for repair before waiting a "reasonable" amount of time for the landlord to perform said repairs. They did not. I exercised my rights under the property code and terminated my lease on 11/30/2022. Since then, The ****** is alleging I owe $3,417 in fees, including fees for re-letting and early termination. These fees are not only inapplicable, as I adhered to ***** statute in vacating, but also inaccurate. Please see the attached account statement provided to me by Indio Management's contracted collection agency the fees for re-letting and early termination are double-billed.

      The nature of my dispute is that this apartment Im living in the district apartment on **************** ****** ***** I have a flooded bedroom apartment this is the second time this week its then flooded Maintenance came the first day to get water up and left machines in my unit and now its then flooded again they suppose to had came back the same day and put same bags at my door and never showed up again also the leasing company and corporate office has not return my phones calls nor emails at all been 48 hours now

      We understand your concern, the heavy rains were not something we were prepared for. We regret that we were unable to meet your expectations in a new apartment home. We did not charge you for breaking your lease. The amount owed is the amount of rent for the days you stayed in the apartment. Had you moved sooner, the amount due would have been adjusted. We apologize for not being able to repair your apartment in the timeframe you wanted.

      I applied for ********* Apartments On 9/22/23 paid the Amin fee and app fee of $215 total . On Tuesday 9/26/23 I received a call from Alona apartments from ******* stating I had been approved and also ********* sent me an acceptance email as well as a ************* link . A hour after I received the call and email ******* called back saying She got me confused with someone else and that I actually got denied . I havent received a reason was I was denied nor have I received any emails , or paperwork about the denial.

      Hello my name is ******************************* in since I moved in the ***** apartment I have had multiple problems lack of communication , they dont never fix anything I put in request they put they resolve the issue in never show up I have proof showing that in the comments online I have been reaching out to Indio management since the issue started on the phone she would answer put me on hold in say someone else is calling in I would wait over 10 to ********************************** to email ***************** the manager so I have been emailing her no response several times in I have even tried to talk to the new manager in the ***** apartment office in she has a bad attitude in is not trying to work with me I am trying to pay towards my rent she keeps changing how much I need to pay in its not my fault that I did not know I hate late fees on my account if no one told me there where late fees in she has been calling in harassing me every week or day asking what am I doing about my balance in I would explain to her I am trying I not accepting nun of my payment Im trying to pay she also sent out an email stating no more money prefers after Aug. ******************************************************************************************************************************************************************** I tell her I dont want to argue I in we cant talk over eachother she said well let me go first it seems u cant or dont have the money just go ahead in move out I said I do have partial of the money I get paid weekly she still went on to say dont worry about Ill just give you a eviction notice in I said I will just call your boss she said are you threatening me I said no but u just threaten me so since then she had my car tow want take any payment I even went to get help with rent assistance she denied the help of them in it was ******* they would pay in I have $1000 in my name at this point Im reaching to someone hire then her because she is very unprofessional

      As of May the 2023, I finally succumbed to the inhumane living conditions I was plagued with since the very beginning of the lease. It was with thorough, consistent communication and no resolution that this came to be. I begin renting a unit in the Bentley apartment community managed by Indio management and was forced to deal with unexplained cost differences, unsafe and unhealthy conditions, lack of communication or resolution from management and no explanation when charges where placed on my credit report. I left with more than enough notice and was never provided a detailed explanation of what and why these charges exist. Because of this, I have no way of resolving and moving to a safe dwelling for me and my children. I have reached out to the management company in order to find a resolution and can not get in touch with the people I previously spoke with or anyone who is willing to assist in solving this matter. I do not feel as though I should be obliged to pay any fees when I was not given a product worthy of even the modest compensation. I requested a different unit or at least repairs to the unit I was assigned and no relief. I would like the matter removed from my credit report with proper explanation as well as an agreed upon solution for resolution.

      On several occasions I had personal property damage that was caused by maintenance staff and the property was not replaced. Also, my car was registered with a parking pass and was still towed. Finally, my car was vandalized in the parking lot causing 8k of damage (1k I had to pay out of pocket) and no help was provided. I also left the lease 2 months early due to a stalker they nor the police would help me with and are charging me an additional fee even though my lease states it can be broken if stalking occures.

      On 7/10/2023 I applied for an apartment at Indio Managements building "The ****** Apartments." I was asked to send the admin fee via VENMO to the management company, after paying the application fee through the website portal. The admin fee was supposed to be refunded in the event my application was declined. My application was declined the same day. I asked to have the $100 admin fee that was paid to the companies venmo account refunded per what I was told my my leasing agent. On July 16th, I reached out to the person who requested me send the monies via Venmo about receiving my refund. I was told that the owner of the company was supposed to getting a refund with a week. I have not received the refund and the business will no longer respond to my requests.

      I stay in the apartment called *************** formally known as the residence at Lakehighland..I put in a work order for ac repair on the 20th of june 2023 and I got a response in the 21st of june 2023 and I quote We are currently working to get you a fan ************* outside units for the meanwhile mainte-*****. Already installed you a window unit as soon as the part comes in somebody will go out there and install it for you. later that week they said the maintenance guy went on vacation and no one is available to fix it then after a week they said they order the part for the ac and hasnt arrived and they alone gave us 2 window units for a 3 bedroom apartment then on the 11th of July 2023 they canceled the work order I went to their office on the 20th of July and complained about the same thing they stated they would reach out to the sister apartment to see if they have the part to fix the ac still yet nobody came and my mum was involved in an accident few months back and is unable to walk and she has been staying in the house which is very inconvenient and also the weather is very hot..please I would appreciate if you could help solve the situation

      Our records indicate that your a/c was repaired and on 8/21 you put in another request saying that the a/c had stopped working that day.       Falsely placed an eviction on me. Made an agreement with leasing agent to give up my apartment to erase any fees from previous owners who refused to fix anything which is why I had a balance, went without AC all of summer my son also suffered a asthma attack from it being so hot in the apartment Before Indio Management bought the property when Indio bought the property I explained to them why I had a balance so leasing agent through Indio management at the time ***************************** came up with the agreement that I give up my apartment terminate my lease early to wave all fees from my account. We had written documentation which she signed and I also signed. ****** apartments through Indio management filed an eviction in March 2023 and I gave up my apartment in December 2022. As well as placing a balance on me they also sent me a ledger in January of 2023 when I had already been out of the apartment. I emailed the manager stating that it was false information I never got a response. They have made my life very difficult. I applied for apartment after leaving ****** apartments and the leasing agent told the apartments I was applying for that I was asked to leave for disturbances when thats not the truth at all. So o got denied and had to live in a hotel with me two kids for a month of possible I would like a refund for the month I had to stay in a hotel its because of them I didnt get the apartment and to move into a hotel. I dont understand how theyre still in business s******* peoples lives over. PLEASE HELP!
